Dossier 156
There appeared before this Sharia Court Menahem Effendi Saleh Daniel, residing in the Ras al-Qariya quarter
of the districts of Baghdad, whose identity was verified by the testimony of two witnesses: Juki Anbar Effendi from Jadid Hassan Pasha quarter
and Ibrahim Ishaq from Qanbar Ali quarter, and he repeated the contents of his petition to this court dated 1 June 1924
and registered under number 156-1924, stating: I, being in a state of sound mind and health and of my own full free will and consent, have removed
from my ownership and established as a valid, legal, and perpetual endowment (waqf) my common half of the pharmacy numbered with door numbers
246-158 located in the Souq al-Ghazal quarter on Al-Attarin Street, which currently comprises
three adjacent units containing the apothecary shop numbered 246-158, the tea house numbered
246-158, and the shop numbered 244-158. The entire property is bounded on the front by the public road and meets the shop of
Abbas bin Hussein Jarjafji and partners 248-158; it meets the shops belonging to Aisha Khatun daughter of Sayyid
Abdullah and her partners 250/158 and 252/158; on the left the pharmacy of Muhammad bin Sayyid Kazim Zaki and partners
256/158; and it meets the furnace of the bathhouse belonging to Sayyid Yahya and partners 264/158; on the right the shop of the heirs of
Abdul Razzaq al-Khudairi 244/158; and it meets the house of the heirs of Heskel Alieka 176/50; and it meets the house of Shaul bin Ibrahim
and partners 48/179; on the back the furnace of the aforementioned bathhouse 64/2/158, which belongs to me according to the Title Deed
dated January 922 permanent and serial 35 in this installment. I have removed it from my ownership and endowed it for the pleasure of God
Almighty and have appointed for it two trustees, namely my son Ezra Effendi and Saleh Effendi Shlomo Abdullah, and after
them the trusteeship passes to the eldest of my children and the children of my male children as they propagate and succeed, generation after generation
and layer after layer, jointly with the eldest of the children of the second trustee Saleh Shlomo Abdullah and his male grandchildren
as they propagate and succeed, generation after generation and layer after layer. Upon the extinction of the lineage of one of the trustees, the trusteeship is restricted
to the second trustee or whoever takes his place, and upon the extinction of both lineages, the trusteeship then passes to the Spiritual Council
of the Israelite community in Baghdad. If one of the trustees travels, he has the right to appoint the second trustee or someone else
in his stead, provided that the common half of the aforementioned pharmacy is leased at a fair rent with the knowledge of the trustees, and the amount
obtained from the rent shall have ten percent deducted for the trustees in exchange for their services and what is required for the aforementioned endowment
regarding the collection and gathering of revenues, overseeing repairs and restorations as necessary, spending the revenues on
the designated purposes, and keeping the books, and in general everything that leads to the benefit of the aforementioned endowment. After
that, a portion shall be given for the necessary construction and restoration of the mentioned endowed property, and the surplus that remains after that
shall be spent on the construction and restoration required for the (Gan Yeladim) school site named after me. If there is no need
for that and a surplus remains from the yield, it shall be spent on charitable and benevolent deeds, and shall not be restricted to the opinion and designation of one
of the trustees only, namely my aforementioned son Ezra Effendi, regarding the remaining matters; the two aforementioned trustees
have the right to participate together in implementing them in accordance with and within the conditions explained above. After them, the condition
pertaining to spending the surplus yield after the cessation of the need for construction and necessary restoration for the pharmacy and the aforementioned
(Gan Yeladim) school site on charitable and benevolent deeds shall be nullified, and instead it shall be spent to meet the needs of the (Gan Yeladim) school
named after me. If there is no necessity for that and a surplus remains from the yield, it shall be spent on the poor Israelite children
who attend one of the Israelite schools in Baghdad or among the group of schools designated by the
trustees present at that time for the purpose of improving their education and teaching. After the present trustees, it is required...

Those who act as their deputies must submit an annual account every year to the management association of (Khan Heldbism) school
marked with my name, and a copy of it to the Lay Council of the Mosaic community in Baghdad. Furthermore, I have authorized the two trustees
to change or exchange the common half of the aforementioned pharmacy and replace it with something else if it is more beneficial for the endowment
in terms of growth and preservation of funds. I have also authorized them, if they see fit for the interest of the endowment, to purchase properties adjacent to the property of the aforementioned pharmacy
or outside of it, using the surplus revenue, and to annex them to the aforementioned endowment under and within the conditions listed
in the declaration of this endowment deed.
Upon inquiry from the Land Registry Office (Tapu) of the Baghdad region, it was understood from the written appendix received under number 2962
dated June 3, 1924, that the Imperial Title Deed (Khaqani) dated January 24, 1922, registered in February 1922 as permanent,
under number 28, representing the entirety of the pharmacy located in the Souq al-Ghazl neighborhood, numbered 158-246, by Menahem
Effendi and Sassoon Effendi Saleh Daniel on a half-and-half basis, has been found to match its record, and is neither mortgaged nor seized,
nor has any transfer occurred upon it.
After reviewing the aforementioned conditions, it appeared that they comply with the legal rulings of the endowment, and thus a judgment was issued for the validity
of the mentioned endowment and for its binding nature and implementation. it was entered into the court register under file number 117, and this endowment deed
was issued accordingly. Notification was sent to the Land Registry Office in Baghdad for registration, and that was on the first day of the month of
Dhu al-Qi'dah 1342, corresponding to June 3, 1924.

The person named Menachem Effendi Saleh Daniel, residing in Ras al-Qarya neighborhood

and established as a valid, legal, and perpetual endowment (waqf) my undivided half of the pharmacy numbered 246 - 158, located
in Souq al-Ghazal neighborhood and Al-Attarin Street, which currently consists of three adjacent pieces
comprising the dispensary numbered 246 - 158, the tea house numbered 246 T - 158, and the shop numbered
244 - 158. The entire premises are bordered: Front: Public road, ending with the shop of Abbas Hussein Jawahji and partners
248 - 158; also ending with shops belonging to Aisha Khatun daughter of Sayyid Abdullah and her partners 250 / 158
and 252 / 158. Left: Pharmacy of Muhammad bin Sayyid Kazim Zarki and partners 256 / 158; ending with the furnace of the bathhouse
belonging to Sayyid Yahya and partners 64 / 158. Right: Shop of the heirs of Abdul Razzaq al-Hasiri 244 / 158; ending
with the house of the heirs of Haqqi Alaka 50 / 179; ending with the house of Shaoul bin Ibrahim and partners 48 / 176. Rear: The furnace
of the aforementioned bathhouse 64 / 158. These properties, belonging to me according to the permanent Tabu deed dated January 1922 and serial
35 in this register, I have removed from my ownership and endowed for the sake of God Almighty. I have appointed two persons as trustees (mutawallis),
namely my son Ezra Effendi and Saleh Effendi Shlomo Abdullah. After them, the trusteeship shall pass to the eldest of the male children and male
grandchildren, generation after generation and layer after layer, jointly with the eldest of the children of the second trustee
Saleh Shlomo Abdullah and his male grandchildren, generation after generation and layer after layer. Upon the extinction of the lineage of one of the trustees, the trusteeship shall be restricted to the second trustee or his successor. Upon the extinction
of both lineages, the trusteeship shall then pass to the Spiritual Council of the Israelite community in Baghdad. If one of the trustees travels,
he has the right to appoint the second trustee or someone else as a proxy in his stead. The undivided half of the mentioned pharmacy shall be leased
at the market rate with the knowledge of the trustees. From the rental proceeds obtained, ten percent shall be allocated to the trustees as a commission
for their services and for what they must provide to the mentioned endowment in terms of collecting and harvesting revenues and overseeing repairs and restorations
as appropriate, spending revenues on the designated channels, keeping registers, and in short, everything that leads to the
benefit of the mentioned endowment. After that, a portion shall be given for the necessary repairs and restoration of the endowed property.
The surplus remaining after that shall be spent on the necessary repairs and restoration of the (Gan Yeladim) school site
bearing my name. If there is no need for that and a surplus remains from the yield, it shall be spent on charities and good deeds.
This shall be restricted to the opinion and discretion of only one of the trustees, namely my aforementioned son Ezra Effendi, regarding
the remaining matters. Both aforementioned trustees shall have the right to act jointly in executing them according to and within the conditions
listed above. After them, the condition regarding spending the surplus of the yield—after the completion of the needs for
repairs and restoration required for the pharmacy and the aforementioned (Gan Yeladim) school site—on charities and good deeds shall be void.
Instead, it shall be spent to meet the needs of the (Gan Yeladim) school bearing my name. If there is no such need
and a surplus remains from the yield, it shall be spent on the children of poor Israelites who attend one of the Israelite schools
in Baghdad or any of the schools designated by the trustees present at that time, for the purpose of improving their education
and teaching. After the current trustees, those who succeed them must submit an annual account year by year.

To the Management Association of the (Kahn Heldim) School, designated by his name and image, to the Corporeal Council of the Mosaic
Community in Baghdad. Furthermore, I have authorized the trustees to change and replace the common half of the
aforementioned pharmacy and replace it with others if it is more beneficial for the endowment in terms of growth and preservation of assets, and I have also authorized them,
if they see an interest for the endowment, to purchase properties adjacent to the property of the aforementioned pharmacy or outside of it, using the revenue
of the proceeds and annexing them to the aforementioned endowment within and according to the conditions listed in the notification of this endowment deed.
Upon inquiry from the Land Registry Office (Tabu) of the Baghdad region, it was understood from the written postscript received under number 2962

permanently and under number 28, regarding the entirety of the pharmacy located in the Suq al-Ghazl quarter, numbered 246 - 158, on
behalf of Menahem Effendi and Sassoon Effendi Saleh Daniel in equal halves, has been found to match its record and is not mortgaged
nor seized, and no transaction has been conducted upon it.
After reviewing the aforementioned conditions, it appeared that they are in accordance with the Sharia rulings for endowments, and therefore the validity
of the aforementioned endowment was ruled, along with its necessity and enforcement, and it was entered into the court register under file number 117, and this endowment
deed was issued, and notification was sent to the Land Registry Office in Baghdad for registration, and that was on the first day of the month of
