Announcement
In view of the misconduct of student Mushir Naji Yaqoub in the first grade outside the college for his actions that bring
a bad reputation to the college and the university, and for his continued display of lack of decency and manners that must characterize

of this week, effective from Monday morning, January 23, 1960.

Presented to your Excellency:
On Tuesday, 29/12/1959, one of the teachers at Frank Iny School called my brother, the student
Bashir Naji Bashir, in the third intermediate grade at the aforementioned school. He did not hear the teacher's call until the
third time, at which point my brother Bashir apologized for not hearing due to a pain in his head. The teacher did not accept his apology
and called the school principal, Mr. Abdullah Obeidia. Upon the principal's entry into the classroom, he called out to my brother Bashir, and without
knowing anything about the subject of what had occurred, said: "I will make you an example for the class, and you know the relationship between me and
your family" (meaning by that a misunderstanding between him and our father for a reason unknown to us). He uttered words that defy
good taste and the principles of teaching and education, as he said, directing his speech to my brother Bashir: "You are a donkey, and you are all
degraded and donkeys (meaning the family)" etc... "And I will refer you to the disciplinary committee."
The following day (Wednesday), my brother Bashir went but was prevented from entering the classroom, as they told him that the
Principal requested that. The same occurred the following day (Thursday). We were surprised on Thursday
evening by a telephone request for Bashir by the school administration for investigation before the teachers' council. Upon his arrival
at the council meeting held at the school, the principal received him with the vilest insults and abuse. When nothing could be proven
against him (meaning against my brother Bashir), he left the school. The next day, a notice was posted in
the school expelling the student Bashir Naji for the remainder of the current year. The principal spoke in one of the classrooms
saying: "I will expel every student whose family speaks ill of me," without us knowing what he meant by that.
I would also like to mention to you that my brother Bashir is of good conduct and has never been expelled or given any reprimand,
warning, or notice throughout his academic years.
As I place these lines before your Excellency, I hope you will kindly cancel the aforementioned teachers' council decision,
which is unjust and unsupported by any fact, and wastes a precious year of the life of a student who committed no sin, in our
eternal Republican era. Therefore, I hope you will kindly order to provide him with a transfer certificate to another school.
This is for your Excellency's order. Please accept my utmost thanks and respect.

Sub/ Petition of Mr. Albert Naji Yaqoub Biniri

With reference to the petition of Mr. Albert Naji Yaqoub Biniri dated January 2, 1960 regarding
his brother Bashir Naji Yaqoub Biniri, the student dismissed from the third intermediate grade at Frank Iny Intermediate School. We attach
herewith a copy of the Teachers' Council decision for this school taken on Thursday, December 31, 1959 regarding
the aforementioned student and regarding his brother Munir Naji Yaqoub Biniri, currently attending the first year of the College of Engineering,
with the request to kindly review our following observations on the subject:
1- The petitioner Albert Naji Yaqoub Biniri was the first to attack the administration by telephone on Monday,
December 28, 1959, immediately after dismissal, and the Director's response to that was to hang up without answering
his attack, which had no justification. Note that the petitioner is not the student's guardian, but rather his father is
the guardian.
2- What was mentioned regarding the incident referred to in the petition having occurred on Tuesday, December 29, 1959
is incorrect. The reality is that the incident occurred on Monday, December 28, 1959.
3- The petitioner Albert Naji Yaqoub Biniri claimed that one of the teachers at Frank Iny School called his brother, the student
Bashir Naji Yaqoub Biniri, and that the latter did not hear the teacher's call until the third time, at which point
his brother apologized for not hearing due to a headache, but the teacher did not accept his apology. The reality is that he (i.e., student Bashir
Naji Yaqoub Biniri) hid in the classroom behind the students and did not respond to the teacher's repeated calls despite the teacher
searching for him inside and outside the classroom for a full ten minutes. This led to a disruption of the classroom order
in a disturbing manner. He did all this with the intent of causing confusion and chaos inside the classroom and with the intent of evading the
oral examination that the teacher was conducting.
4- Albert Naji Yaqoub Biniri stated in his petition that the teacher summoned the school principal Mr. Abdullah Ovadia to
the classroom. The reality is that the teacher removed the student Bashir from the classroom and sent him to the administration, and the principal was not present in
his room at that time as he was teaching Algebra in the fourth secondary grade.
5- Albert claims in his petition that the school principal went to the classroom at the teacher's request and called his brother Bashir
telling him, without knowing anything about the subject that took place, (("I will make you an example for the class etc.")). The reality is that the student
Bashir Naji Yaqoub Biniri, when he came to the administration and did not find the principal there, returned to the teacher and asked him to
close the case, and when the teacher refused, he said to him ("don't make it a nuisance"), so the teacher submitted a letter to the school principal
this is its text:
Dear Respected Principal,
The student (Bashir Naji Yaqoub) from the third grade, I asked him to perform the oral examination and it was said
to me that he was absent and he did not answer my request. When I counted the students, I found the students complete in number, so I asked him
to answer, so he stood up and claimed he did not hear, even though I spent ten minutes looking for him and sent the monitor to the
assistant to ask about him. Then he was insolent toward me by saying ("don't make it a nuisance!!"). Please punish him as he
deserves, and thank you in advance.

The original letter of the teacher is still kept at the school administration.
When the principal received this letter during the break, he summoned the student Bashir to the administration room and reprimanded him for his
misconduct in the form of a reproach that included both advice and guidance.
From this, we see that the principal's going to the third intermediate class on Monday night, 12/28/1959, which is
the day the incident occurred, and his uttering words that offend taste as claimed by the petitioner, is a fabricated matter intended for fabrication
and camouflage. In fact, the principal contented himself with reproaching the student Bashir Naji Baniri inside the administration room and informed him that he
was forced to refer his case to the disciplinary committee. As a show of good faith and tolerance toward this student by
the administration after reproaching him, this student was provided with a paper allowing him to enter the classroom for the remainder of the session. The student did
actually attend his class for the rest of that day.
6 - The petitioner also claimed that the school principal had uttered words that touch upon the dignity of his family. In fact, the school principal
did not say anything of the sort, neither in the classroom ((since the principal did not enter that classroom after the incident on that day)) nor
outside of it.
7 - Then the petitioner says in his petition ((And we were surprised on Thursday evening by the school administration requesting Bashir by telephone
for investigation with him by the Teachers' Council)). In fact, the summoning of the student Bashir to appear before the Teachers'
Council was one day before the meeting of the Teachers' Council and also on Thursday as well. It was
not a surprise to him as he claimed.
8 - The meeting of the Teachers' Council took place on Thursday after school hours because many of its members teach
in double-session schools, and the most suitable time for all members was Thursday after school hours.
9 - The petitioner also mentions in his petition that when his brother appeared before the Teachers' Council, the principal greeted him with the most foul
insults and swearing. This is not true at all. The petitioner cannot fabricate his false claims against
the principal in the presence of ten members of the Teachers' Council.
10 - Then the petitioner mentioned that the Teachers' Council did not establish anything against his brother as a result of the investigation with him, and this is
also incorrect. The Teachers' Council questioned him, and his brother confessed to everything he had done. It is worth noting
that the student Bashir's behavior was that of a reckless student throughout the duration of the investigation with him by the Teachers' Council.
11 - Then the petitioner claimed that the principal spoke in one of the classes saying ((I will expel every student whose parents speak ill
of me)). This claim is also incorrect. The fact is that due to the recurring attacks and transgressions by
some deviants among the students' parents against the teaching staff and the administration without there being a correct viewpoint
for these parents regarding issues related to their children, which is intended to serve their private interests that
conflict with the public interest and observed regulations—the Teachers' Council, among the decisions it made,
decided to leave it to the school principal in the future to take the necessary steps to sever the relationship of students' parents of
this sort with the school, by transferring all their children to another school (and not by expelling them as stated in the petitioner's
petition) in order to ensure no recurrence of what disrupts the school system and the regularity of its progress in the future, especially since the transfer of
a student from one school to another cannot be considered detrimental to the student's interest, nor can it be considered a punishment for him.
The ultimate goal aimed at by this measure is to remove the student's guardian who harms the public interest from the school
environment, which must be calm so that regulations can be applied in it easily to ensure the progress of the school and raise
its scientific and educational level.

12 - The aforementioned petitioner claims that Bashir's dismissal was not preceded by any reprimand or warning, and this is also contrary to
reality. This student has previously committed acts that breached order, especially in this year in the classes of more than
one teacher, including the mathematics teacher and the life sciences teacher. The fact that no action was taken against
the student at the time does not mean the student was not at fault, but his dismissal at the time was for the purpose of giving him opportunities to reform
himself.
13 - At the time when the student's father, Mr. Naji Yaqoub Biri, was visiting the Discipline Committee during its session on
Tuesday 12/29/1959, sometimes threatening and at other times asking for forgiveness for the misconduct of his three sons
toward the school and administration, and at the time when he was claiming that he would ask his sons to apologize for
the misconduct they committed, at this very time, while the father was showing apparent regret regarding the matter,
his son, the student Bashir, exited the administration room and began uttering obscene phrases that are not appropriate for a school student
to utter, especially in a mixed school, in front of the students and in front of one of the school staff members, with the intent
to undermine the dignity of the Discipline Committee (and this indicates that the father, Naji Yaqoub Biri, has no influence
on his sons). Furthermore, both the petitioner Albert Naji Yaqoub Biri and the student Bashir Naji Biri, who is currently
attending the College of Engineering, made themselves guardians over their younger brother Bashir, while they both still lack
maturity and good conduct before making themselves guardians over their younger brother.
14 - What was done by Bashir Naji Yaqoub Biri, currently attending the first year of the College of Engineering, in terms of action toward
the principal of his school from which he graduated a few months ago and where he received his lessons for six years (and
in the last two years, he received some of his lessons at the hands of the principal himself) - what this student did
is an act contrary to education and manners, specifically on the first day of the incident, Monday 12/28/1959, before he understood
anything about the behavior of his brother Bashir in class which violated order and before any decision was made to take action against him -
what this student did has never been done by any student in this school in the past, no matter how reckless he was,
and not much time has passed since the certificate of good conduct provided to this student by the administration of this school,
by which and by other documents provided to him he was able to join the College of Engineering. It would have been more appropriate for him
not to forget the favor of the school that embraced him and covered him with its care throughout his studies there. The administration of
this school hopes that the punishment he deserves will be taken against this student by the authorities to which he belongs
at the present time.
15 - The Teachers' Council, which includes members who are still practicing the teaching profession in official schools in the Ministry of Education,
has taken these decisions within its powers granted to it by the Secondary School System No. (54)
for the year 1954 after it reached full conviction of the correctness of its decisions. All members
who reviewed the content of Albert Naji Yaqoub Biri's petition were astonished due to the lies and fabrications it contained, especially
after they conducted a thorough investigation with his brother, the student Bashir, during the Teachers' Council meeting.
16 - It is clear from all of the above that what was stated in the petition of the petitioner Albert Naji Yaqoub Biri has no relation to truth and reality
and that everything he mentioned in his petition is a form of misleading, fabrication, and deception to justify his request to mitigate
the punishment of his two brothers. The administration of this school reserves its right to take all regulatory measures against the petitioner
Albert Naji Yaqoub Biri and against his brother Bashir, in retaliation for the former's attack and leveling of false accusations against the principal
of this school, and the latter's commission of an act contrary to protocols toward the administration after his relationship with the school had ended.

17 - This is at a time when the school principal and all members of the teaching staff believe in the necessity of
granting full freedoms to all students in our prosperous Republican era within the scope of regulations, laws,
and established procedures. The entire teaching staff of this school is keen to observe the public
interests before the private interests of individuals. We hope that the Ministry of Education will support the school in its keenness to
apply the regulations of the Ministry of Education to eliminate what may lead to chaos as a result of the tolerance that
the school administration and the teaching staff previously showed on many occasions in the past towards many

Decision
The Discipline Committee met on Tuesday, 29 / 12 / 1959, chaired by the School Principal and with the membership of
Mr. Munir Nassim, Mr. Heskel Ephraim, Mr. Amin Marei, and Ms. Samha Nassim, based on the request of Mr.
Muhammad Saeed Abdul Wahab to look into the case of the student Bashir Naji Yaqoub Beneri from the third intermediate grade, for
committing acts disruptive to order on Monday, 28 / 12 / 1959, and hiding in the classroom with the intent of evading
the exam and disrupting order, and his failure to respond to the teacher's repeated calls for the purpose of his oral exam for
a period of ten minutes despite being present in the classroom, which led to a disturbing disruption of classroom order. And when
the School Principal summoned him on the same day and reprimanded him for that, he conveyed to his guardians words that were completely untrue
with the intent of covering up his disruptive acts. Consequently, his brother, named Mushir Naji Yaqoub Beneri, who is
one of the graduates of this school in the summer of 1959 and currently a student at the College of Engineering, came
to the school during the lunch break on the same day (Monday 28 / 12 / 1959) and entered the Principal's office without
permission and behaved toward the Principal in an abnormal manner that exceeded the limits of politeness and decency. When the Discipline
Committee met the following day, it decided to refer the case to the Teachers' Council to consider it and determine the necessary punishment.
When the student Bashir Naji Yaqoub Beneri was informed of this during the Discipline Committee meeting, he left the administration room and began
uttering foul language unbecoming of a school student. He uttered those foul phrases in front of some students and in front of
one of the school staff members, challenging the Discipline Committee with the intent of undermining its dignity. Accordingly, the mentioned
student was notified on 30 / 12 / 1959 through his father to appear before the Teachers' Council, which convened on
Thursday, 31 / 12 / 1959, to look into this case. Upon the attendance and questioning of the mentioned student, he confessed to:
1- Hiding from the teacher's sight behind the students in the classroom and admitted his failure to respond to the teacher's repeated calls
despite the teacher searching for him for ten minutes.
2- He also admitted that when the classroom situation reached an unbearable level of noise, only then was he forced
to appear before the teacher.
3- He admitted that he said to the Arabic language teacher (don't make it a "laghwa" [nonsense/chatter]).
4- He admitted that he uttered a foul phrase about the Discipline Committee unbecoming of a school student.
The demeanor of this student during his questioning before the Teachers' Council was that of a reckless student throughout
the duration of the investigation. As a result of this investigation, the Teachers' Council unanimously decided the following:
First - Punishing the student Bashir Naji Yaqoub Beneri, a student of the third intermediate grade, by expelling him from the school
for the remainder of the current academic year 1959 - 1960, based on Article (40) paragraph
(7) of the Secondary Schools Regulation No. 54 of 1954, and not accepting him into this school
in the coming year.
Second - Recording the penalty of misconduct in the file of the student Mushir Naji Yaqoub Beneri, kept with the files of
graduated students of Shamash Secondary School, and including a note about his misconduct in all documents.

the names of those who participate in the general examinations, it was found that his name is Albert Naji Bneiri.
3- Upon auditing the non-drop identity card No. 242 dated 25 / 4 / 955 and attached herewith, it was found that the name of
the aforementioned is Albert Naji Bneiri.
Therefore, please correct the surname of the aforementioned person and make it Bneiri instead of (Bteri).
