Greetings;
With reference to your letter numbered 6432 and dated 1956/3/31 regarding the request of our school's janitors for their rights according to the Labor Law, we would like to inform you of the following: -
-1 Ordinary Leaves
It is no secret that our school is a private school and classes are suspended between the first of June and the middle of October of each year, i.e., approximately four and a half months; add to that the spring break, official holidays, and religious holidays specific to the Mosaic community, bearing in mind that during all these holidays, the five janitors of this school take turns on duty, which means that the duty of one janitor does not exceed an average of six days per month during the mentioned holidays. Therefore, the janitors' request is legally invalid as they enjoy the holidays mentioned above; this is with the knowledge that Labor Law No. (1) of 1958 has specified the projects and shops that are required to apply the mentioned law in the fifth paragraph of the first article, which were listed exclusively. From this, it is clear to you that private schools are not covered by the mentioned law. And that they apply the school holiday system. Greetings,
Your letter No. 7470 dated 19 / 4 / 1959
After reviewing the petition of the janitor Lafta Baqul sent with your above-mentioned letter, we would like to
inform you of the following:
1 - The aforementioned person had worked in our school as a janitor for the period from 1/1/1951 until
he left the service on 30 / 1 / 955.
2 - The mentioned janitor claims that he was dismissed from his work without cause, and this claim is incorrect as
the aforementioned person had left the service of his own accord following a quarrel with the rest of the janitors of this
school, and another janitor was appointed in his place at the time.
3 - As for his request for his rights, we would like to inform you that our school is a private school where studies are suspended
between the first of June and the middle of October of each year, i.e., approximately four and a half months.
In addition to that, the legislative holiday and all official holidays and religious holidays specific
to the Mosaic community, and during all these holidays, the five janitors of this school take turns
on duty. This means that a single janitor's duty does not exceed an average of six
days per month during the mentioned holidays, and therefore the aforementioned person is not entitled to claim any rights in
terms of regular leaves.
4 - In accordance with the school administration's policy of promoting its employees and assisting them, the aforementioned person
was granted, upon leaving work, an additional half-month's salary for one month against a receipt signed by him,
in addition to the gratuities that were granted to him on the occasion of holidays and the end of exams when
distributing school certificates to students from time to time. This is noting that the aforementioned person has not been
unemployed, by his own admission, since leaving service at our school until now.
5 - Add to that, the aforementioned person was not covered by the repealed Labor Law No. 72 of 1936
and its amendments, nor by any other laws during the period of his employment in our school which ended on 30/1/1955,
but rather the observed procedures for employing other janitors at the time were applied to him. It is no secret
that the employees of the Ministry of Education schools do not enjoy regular leaves because the summer vacation
takes the place of these leaves.
6 - Since the aforementioned person had left the service on 30/1/1955, i.e., more than
three and a half years ago, he has no right to claim any rights, if any, in view of the expiration of
the legal period required for the claim according to Article 925 of the Civil Code, which states
