No. / Number: 59/1000

To the Directorate of Labor and Social Security of the Central Region Baghdad (Al-Shawi)
Greetings;
With reference to your letter numbered 6432 and dated 1956/3/31 regarding the request of our school's janitors for their rights according to the Labor Law, we would like to inform you of the following: -
-1 Ordinary Leaves
It is no secret that our school is a private school and classes are suspended between the first of June and the middle of October of each year, i.e., approximately four and a half months; add to that the spring break, official holidays, and religious holidays specific to the Mosaic community, bearing in mind that during all these holidays, the five janitors of this school take turns on duty, which means that the duty of one janitor does not exceed an average of six days per month during the mentioned holidays. Therefore, the janitors' request is legally invalid as they enjoy the holidays mentioned above; this is with the knowledge that Labor Law No. (1) of 1958 has specified the projects and shops that are required to apply the mentioned law in the fifth paragraph of the first article, which were listed exclusively. From this, it is clear to you that private schools are not covered by the mentioned law. And that they apply the school holiday system. It is no secret that the employees of the Ministry of Education schools do not enjoy ordinary leaves due to the length of the summer vacation in place of these leaves.
-2 Sick Leaves
All janitors in our school enjoy sick leaves according to the medical reports given to them by the doctor. In addition, the school administration bears the costs of the doctor's examination and the price of the necessary medicines for them. It is not reasonable to force a janitor to work in a sick condition as this is contrary to health rules, considering that our school is a school containing a large number of students of various ages. For the purpose of maintaining the health of the students, any janitor or student who falls ill is not allowed to attend unless the medical report confirms his full recovery.
-3 Official Holidays
Our school closes on official holidays without exception in application of the Official Holidays Law. In addition, the school also closes on religious holidays specific to the Mosaic community.
-4 Weekly Holiday
The weekly holiday for our school is Saturday of every week instead of Friday, as Saturday is the holiday of the Mosaic community. This arrangement is carried out with the knowledge of the Ministry of Education.
-5 In addition to what was mentioned above, in many cases some of the janitors are absent from work for the purpose of finishing some of their own business, and their salaries are paid to them as usual without taking their mentioned absences into consideration.
-6 Following the school administration's plan to provide recreation for its employees, it collects donations from within the school on various occasions such as holidays and exams, while granting them bonuses when certain occasions occur such as school parties and others. Also, all janitors are granted overtime pay when some of them work in rotation when summer courses are opened for some days of the week during the summer vacation.
-7 Social Security - In addition to all of the above, the school administration did not deduct their share of social security contributions from their salaries, but rather the school administration bears the cost of paying for the social security stamp on their behalf monthly.
-8 The administration of this school, taking into account the financial situation of the janitors, has granted them an increase in the monthly salary by one dinar annually for each of the past three years respectively. This is in addition to providing each janitor with clothes worth seven dinars for each of them per year.
Please accept our highest respect 55

To the Honorable Minister of Social Affairs
Presented to your Excellency
We, the undersigned, janitors of the Frank Iny Private School, have
been employed at the school for several years, but we are deprived of
legitimate regular rights, sick leaves, official holidays,
and weekly breaks. We were forced to stay at the school night and
day because the previous era held power over the vulnerable workers.
And now, after the passing of that era, we submit this petition
hoping for a review of our case and whether we deserve those rights or not.
The fact is that we do deserve them, and we have an official document with copies,
and in our hands is a social security letter issued by the Department of Labor and Security.
We have firm hope that you will look into our request because we are
heads of families and poor people. The matter is yours to decide.
