Sale Contract
First Party -- Seller --: Mr. Matty Ward ⟦in his capacity as⟧ President of the Lay Council of the Armenian Community in addition to his position
Second Party -- Buyer --: Mr. Tawfiq Darwish Al-Zubaidi
Agreement has been reached between the two parties to conclude this contract under the following conditions: -
First -- The First Party acknowledges that he has sold to the Second Party the property detailed below: -
Property Type: House (ruin), freehold property
Number and Sequence: Door number 1/28 and sequence number 2/1/47
Locality: Jadid Hassan Pasha
Second -- The agreed sale price is eight hundred Dinars and --- Fils
The First Party acknowledges that he has received from the Second Party a deposit of one hundred Dinars
As for the remainder of the price, it shall be received upon completion of the transaction and the declaration at the Land Registry Office.
Third -- If the First Party refuses to carry out the declaration or if he reneges on the sale in any form whatsoever, he shall be obliged to return the deposit
to the Second Party, and in addition to that, he undertakes to pay damages to the Second Party amounting to 50 Dinars
and --- Fils without the need for a formal notice ⟦provided there is no obstacle from the competent government authorities to carry out this sale⟧
Fourth -- The Second Party acknowledges that he has accepted the purchase under the aforementioned conditions and undertakes to pay the remainder of the sale price to the First Party
upon completion of the transaction and the declaration at the Land Registry Office. If he reneges on the purchase and the payment of the remainder of the price, he undertakes to pay damages
amounting to (50) Dinars without the need for a formal notice, and he has no right to claim
the deposit, and the Second Party has the right to register the property in the name of whomever he wishes.
Fifth -- All fees required for the sale and all other expenses are the responsibility of the Second Party (the Buyer)
Sixth -- As for the fees for release, transfer, subdivision, consolidation, correction, and property tax, they are the responsibility of the First Party, the Seller
Seventh -- Both parties undertake that each of them shall pay a brokerage fee of one percent to the broker Mr. Qasim Al-Rahina
who mediated the sale contract, immediately upon signing this contract. If either party reneges on implementing the terms of this contract,
he undertakes to pay double the brokerage fee mentioned above. Also, in the event of ⟦mutual consent⟧ of the two parties to cancel this contract,
they shall both be obliged to pay the mentioned brokerage fee regardless of the amount.
