In view of my appointment as general agent for the trustee of the Shamash Endowments (Anglo-Jewish Association)
pursuant to the general power of attorney certified by the Notary Public in London on
13/7/1953 and by the Royal Iraqi Consulate General in London under number
376 and dated 20/7/1953, sent to me attached to the letter dated 21/12/953
to carry out all fees, actions, works, and tasks related to the aforementioned endowments, therefore
I found it necessary to request the following from your esteemed committee:
First - Not to receive any amount of the funds belonging to the aforementioned endowments, whether the amount is
due rent or from old debts.
Second - To hand over to us the deeds and documents related to the aforementioned endowments.
Third - To hand over to us all accounting books related to the aforementioned endowments along with receipts
for expenses, especially property taxes, originals and copies.
Fourth - To provide a budget for the revenues of the aforementioned endowments for the period from 1/4/951 (which is the date
the community received them) until 31/12/1953, with a statement of the expenditure aspects of
those revenues and the remaining balance up to the date of this letter.
Fifth - I attach herewith for information a list of the aforementioned endowments as stated in the general power of attorney
referred to above.
I hope to receive the matters requested in this letter within one week
from the date of your notification of it.

In the city of Baghdad (Iraq) on Jadid Hassan Pasha Street, defined in the
real estate certificate issued by the Land Registry dated the eleventh day of September, year 1935 one
thousand nine hundred and thirty-five, documented as record number (2906), which is the house numbered according to the numbers
on the doors, one located on Al-Rashid Street numbered 50/B/1 and the other on the public road
numbered 25/A/17, and the buildings that form a part of it, which consist of seventeen shops and a Musafirkhana
(a lodging place for foreigners), a pharmacy, and the buildings located on Al-Rashid Street are six shops: the first
number 50/E/1, the second number 50/H/1, the third number 50/D/1, the fourth number 50/Z/1, the fifth
number 50/E/1, and the sixth number 50/E/1/2. The Musafirkhana is located adjacent to the shops under the mark
number 50/W/1, and the pharmacy number 50/Z/1, and the rest are located on the public road situated behind the house
mentioned above, and the shops, numbering eleven, are: the first number 17/19, the second number 17/21,
the third number 17/23, the fourth number 17/25, the fifth number 25/Y/17, the sixth number

Second ⟦line⟧ We had requested from you ⟦line⟧ and the rest of the tenants ⟦line⟧ according to our letter dated 21 / 1 / 1954 and delivered to you

by hand, pursuant to your signature on its date, to deliver the amount due from you to the person assigned by us — who is the lawyer Shaul
Moussa — and when the aforementioned person approached you regarding the payment of the due rent installments, you did not provide what would pay them to him.
It is noted that the second installment of the rent due from you is (400 Dinars), which became due for payment on
22 / 12 / 1953 according to the lease agreement concluded with you. Furthermore, you did not deposit the due amount with the Notary
Public within the legal period in implementation of the provisions of paragraph (c) of Article Four, which refers to the second paragraph
of Article Three of the Real Estate Lease Decree, which specified that period as seven days only from the due date.
Therefore, your failure to perform this legal duty led to the right to demand your eviction from the leased property and your lack of benefit from
the first paragraph of Article Three of the aforementioned decree. As for — according to what we have learned — your delivery of three hundred and fifty
dinars out of the second installment amounting to four hundred dinars (400 Dinars) to the Presidency of the Jewish Community in Baghdad
on 8 / 2 / 1954, it is not such as to exempt you from the legal duty above for the following legal reasons:
A — Delivering the amount to a party other than its legal reference is not considered a legal delivery or deposit in view of our legal authority as a reference
legal for you to receive the amount as stated in the first paragraph of the general power of attorney, the text of which was mentioned in the previous paragraph of this notice.
B — Also, the Presidency of the Jewish Community in Baghdad has been officially notified by us through the Notary Public not to receive any
amount of the rent payments for the Shamash Endowments that are due or will become due, pursuant to the notice served to it under notice number
12159 dated 4 / 1 / 1954, based on the legal authority granted to us under the first paragraph of
the power of attorney mentioned above. Thus, your action contrary to that is considered an illegal act, and the receipt by the Presidency of the Community of the mentioned amount
from you on the interpretation that it is a loan from these endowments to it is incorrect from a legal standpoint and is not such as to justify the mentioned
receipt. This makes the matter of receipt an act concerning you and them, and these endowments have no relation to it.
Result — In view of the legal reasons mentioned above, it has become our right to request eviction against you, and we at the same time
reserve our right to demand from you the rent payments due from you until the date of this notice, and as for the period from the date of this
notice until the actual eviction occurs, we reserve our right to demand from you the fair market rent for it. In addition to charging you all
lawsuit fees and other judicial expenses resulting therefrom.
Note — We submit this notice in three copies: the first is served to the Inspectorate of Iranian Schools, the second is kept at the Notary Public's office,
and the third is returned to us with the notice of service.

1- The Committee of the Heskel Menachem Daniel Vocational School for Girls was formed pursuant to an explicit article of the endowment deed.
The existence of the committee and its continuation in its work is a fundamental pillar of this endowment and its permanence.
2- We requested your esteemed committee in our letter dated ⟦25 / 9 / 1954⟧ to approve the internal regulations submitted by
our committee (the Committee of the Heskel Menachem Daniel School) to be a basis to be followed in implementation of the endowment conditions.
Until the writing of this letter, your committee has not approved the mentioned regulations and has not even expressed any opinion about them, which implies
that it is not in your committee's intention to give this aspect any attention.
3- The method followed by your esteemed committee regarding the return of the tools borrowed by the playground from the school of
Heskel Menachem Daniel was not according to the procedures observed in these cases between committees whose goal is the public interest.
4- Despite our repeated approaches to you regarding the necessity of taking the necessary measures for the continuation of the school in a manner that ensures its permanence
as an institute or institution of benefit to the members of the community, your esteemed committee has not taken the steps to ensure that. And
this institution has remained paralyzed, which will lead to the decay of the endowment and the hopes built by the endower.
Based on all of the above, I find it difficult for me to continue working as a member of the mentioned school committee.
Therefore, please consider me resigned definitively.
