17 / 7 / 67 and 24 / 11 / 68 and our letter numbered T / 75 / 66 dated 13 / 1 / 66 that this property does not belong to
the community, but rather the property belonging to it is the house numbered doors 94/393 Torat, and we provided your secretariat with a copy of the registration
the map, and the endowment deed for this property, and the Secretary of the Community Presidency also followed up with you on the subject. Despite this
your secretariat has seized it.
Accordingly, since this house belongs to the Presidency of the Community, we have stored in it more than 300
Sefer Torah - Holy Books - manuscript on leather, and each Sefer is kept in a wooden box covered with silver
silver-plated, and given the value and sanctity of these books, this house was insured against fire for an amount of -/3000
dinars, and all the assets in this house, in addition to the holy books, including an X-ray machine
belong to this Presidency.
Therefore, please order the lifting of the seizure on this property and the delivery of the assets deposited in it to us.

We inform your honorable secretariat that all your correspondence was focused on the property No. Doors 14/391 Torat. We clarified according to our numerous letters, including the two letters of the Administrative Committee numbered L/1452/67 and L/83/68 dated 7/17/67 and 11/24/68, and our letter numbered T/75/66 dated 1/13/66, that this property does not belong to the community, but the property belonging to it is the house No. Doors 14/393 Torat. We provided your secretariat with a copy of the registration, the map, and the endowment deed for this property, and the Secretary of the Community Presidency followed up with you on the matter. Despite this, your secretariat has seized it.
Accordingly, since this house belongs to the Presidency of the Community, we have stored in it more than 300 Sefer Torah - Holy Books - handwritten on parchment, and each Sefer is kept in a covered wooden box, some of which are silver-plated. Greetings,
With reference to your letter No. 27522 dated 10/2/1969 regarding
the ownership of the immovable property in house No. 94/294 Tauraat
Sivin, we explained for your esteemed information in our letter No. 147/69 dated
9/8/69 that house No. 94/294 in the Tauraat neighborhood is an endowment (waqf) by
the late Ezra Menachem Daniel according to the endowment deed issued by the Personal Status Court in Baghdad
under No. 27/44 dated 4/20/44, and that the judiciary has not yet issued a ruling
regarding ⟦us⟧ concerning the shelves and the unregistered papers in the Land Registry
kept in this house.
And the immovable property <del>⟦has⟧</del> we clarified in our letter referred to above
that it belongs to the Presidency of the Community and was kept in this house, and it was kept
in this house <del>⟦in a way⟧</del>
and they are (200) Sefer Torahs.
1- Given the sanctity of some of them, (200) Sefer Torahs handwritten on parchment and kept
in special silver and non-silver cases, these books do not belong to any person
but are the property of the synagogues (property of God Almighty), and it is a duty to preserve them and their sanctity
and not to touch them.
2- The family of Hashim Naoum or Meir Elias Hospital (Presidency of the Mosaic Community) has kept
in this house since 1952, i.e., after the hospital was closed.
Therefore, please preserve the holy books (Sefer Torahs) and do not touch
them, and for your information ⟦regarding what might⟧ fall ⟦upon the responsibility of⟧ the persons who committed

Reference to your letter No. 627 dated 1961/1/6 addressed to Rosa Haroun and her group regarding the necessity of vacating the property No. Doors 391 / 14 Torah.
The aforementioned and her group are among the poor of the Jewish community and reside in property No. Doors 393 / 14 and not 391 / 14, which belongs to the Fattal family.
Property 393 / 14 Torah neighborhood and Land Registry sequence 312 Torah was pure property in the name of Menachem Saleh Daniel, and his son Ezra Menachem Daniel had endowed it (Waqf) according to the endowment deed issued by the Personal Status Court in Baghdad under No. 67 / 944 dated 30 / 4 / 944. This deed is registered and marked in the Land Registry records. We have previously provided your honorable Secretariat with a copy of this endowment deed attached to the Administrative Committee's letter No. 1452 dated 27 / 6 / 67. In addition, we attach to this letter of ours a copy of the Land Registry record for property sequence 312, a map, a copy of the endowment deed referred to above, ⟦a copy⟧ and the real estate tax receipt to verify the matter. I also request to ask the Rusafa Land Registry Directorate to confirm these two properties on-site (391 / 14 sequence 310 Torah and property 393 / 14 sequence 312 and their ownership) and to allow the occupants of the house to remain in their residence and not deport them.

issued by the Personal Status Court in Baghdad under number 67 / 944 and dated 30 / 4 / 944, and we have previously
informed your respected General Secretariat of this in our letter numbered 67/1452 and dated 27 / 6 / 967
and we attached a copy of the endowment deed to it.
2 - The house mentioned above has been allocated by our committee since the past to house widows and orphans
from the poor of the community (Rosa Haron and her group) whom the Administrative Committee undertakes to support in addition to
their free residence without paying any rent.

On this day, Ezra Menachem Daniel appeared, and after being identified by the identification witnesses Meir Hakham Moshe Dangoor and Ezra Meir
Baruch, he stated the following: -
I, of my own free will and choice, and in full possession of my mental faculties and maturity, have agreed to remove the house located in the Taura neighborhood in Baghdad, which is subdivided into
two houses by an informal subdivision and numbered with door numbers 73/139 and 94/393 according to the Tabu deed dated June 323 and sequence 312
and registered in the name of my late father Menachem Salih Daniel and transferred to me by inheritance according to the two distributions from the Judge of Personal Matters under number
136/40 Sh dated 11/12/40 and 34/43 Sh dated 29/3/43 from my own property, and I have endowed it as a valid, final, and perpetual endowment
for the rest of the soul of my late mother Rifka daughter of Abdullah Shalum, provided that it be used as a clinic for the medication and treatment of the sick among the poor
of the Mosaic community, and that this clinic be named after my late mother Rifka Menachem Daniel. The trustee of this endowment has the full right
and absolute opinion to do what he deems appropriate by using the entire endowed property as a clinic or a part of it, and any surplus he obtains, he may lease it
and spend the yield obtained from it, first on paying taxes, maintenance, and necessary reconstruction for the endowed property, and secondly on the medication and treatment of
the patients who visit that clinic. In the absence of poor visitors to the aforementioned clinic, it shall be spent on the poor Israeli patients
in Baghdad.
Furthermore, I have endowed, restricted, and delivered into the hands of the trustee of this endowment a sum of money amounting to three thousand dinars, of which two thousand
and five hundred dinars are for the purpose of spending them on building the clinic endowed by this endowment deed, furnishing it, and preparing it to be suitable for the aforementioned purpose, and that
at the earliest time the trustee deems appropriate. Until the commencement of the reconstruction, the trustee may utilize the aforementioned amount by purchasing government bonds
or similar guaranteed methods. The interest obtained from those funds shall be added to the endowed amount and used for the same purpose of
reconstruction. As for the remaining five hundred dinars, they shall be spent for the necessary maintenance of the endowed property from time to time until the commencement of building the clinic
required by its endowment.
I have assigned the trusteeship of this endowment to the Lay Council of the Israeli community in Baghdad, and in the absence of such a council
at any time, the trusteeship shall then transfer to the authority that takes its place.
The trustee must entrust the management and operation of this clinic, including the spending of the endowed amount for the purposes for which it was endowed, to
the person or body that manages the Meir Elias Hospital within the limits set for it.
The person named Eliyahu Hayyim Tawfiq, the current President of the Israeli Lay Council in Baghdad, appeared according to the certificate paper
presented, which states that he is the President of the Israeli Lay Council in Baghdad at the present time, issued by the Presidency of the Israeli Community
on 26/4/1944. After being identified by the identification witnesses mentioned above, he stated: I have received in full and complete
the endowed amount of three thousand dinars from the aforementioned endower, Mr. Ezra Menachem Daniel, and I pledge to preserve it and spend it
according to the conditions set forth in the endowment deed listed above.
Based on the above, they requested the issuance of a deed for the aforementioned endowment.
The Decision: - In view of the above, the endowment has been completed, become binding, and adjudicated according to the conditions listed above, and it has become a valid
legal endowment. What occurred was recorded upon request on 30/4/1944 AD.

for the rest of the soul of my late mother Rifka daughter of Abdullah Shlomo, provided that it be used as a clinic for the medication and treatment of the sick among the poor of

40/136 dated 11 / 12 / 40 and 34 / 43 Sh dated 29 / 3 / 43 from my own property, and I have endowed it as a valid, final, and perpetual endowment
for the rest of the soul of my late mother Rifka daughter of Abdullah ⟦known⟧, on the condition that it be used as a clinic for the medication and treatment of the poor
of the Mosaic community, and that this clinic be named after my late mother Rifka Menahem Daniel. The trustee (Mutawalli) of this endowment shall have full freedom
and absolute discretion in what he deems appropriate regarding the use of the entire endowed property as a clinic or a part of it, and any surplus that remains, he may lease it
and spend the yield obtained from it, first on paying taxes, maintenance, and necessary repairs for the endowed property, and secondly on the medication and treatment of
the patients who visit that clinic. In the absence of poor visitors to the mentioned clinic, it shall be spent on poor Israeli patients
in Baghdad.
Furthermore, I have endowed, restricted, and delivered into the hands of the trustee of this endowment a sum of money amounting to three thousand Dinars, of which two thousand
and five hundred Dinars are for the purpose of spending them on building the clinic endowed by this document, furnishing it, and preparing it to be suitable for the mentioned purpose, at
the earliest time the trustee deems appropriate. Until the commencement of construction, the trustee may utilize the mentioned amount by purchasing government bonds
or similar guaranteed methods; the interest obtained from those funds shall be added to the endowed amount and used for the same purpose of
construction. As for the remaining five hundred Dinars, they shall be spent for the necessary maintenance of the endowed property from time to time until the commencement of building the clinic
intended for endowment.
I have assigned the trusteeship of this endowment to the Lay Council of the Israeli community in Baghdad, and in the absence of such a council
at any time, the trusteeship shall then transfer to the authority that takes its place.
The trustee must entrust the matter of managing and inspecting this clinic—and this includes the spending of the endowed amount for the purposes for which it was endowed—to
the person or body that manages the Meir Elias Hospital within the limits set for it.
The person named Eliyahu Hayyim Tawfiq, the current President of the Israeli Lay Council in Baghdad, appeared according to the certificate paper
presented, stating that he is the President of the Israeli Lay Council in Baghdad at the present time, issued by the Presidency of the Israeli Community
on 26 / 4 / 1944. After being identified by the two identification witnesses mentioned above, he stated: I have received in full and complete
the endowed amount of three thousand Dinars from the endower, the aforementioned Mr. Ezra Menahem Daniel, and I pledge to preserve it and spend it
according to the conditions set forth in the endowment deed listed above.
Based on the above, they requested the issuance of a deed for the mentioned endowment.
The Decision: - In view of the above, the endowment has been completed, become binding, and was adjudicated according to the conditions listed above, and it has become a valid
legal endowment, and what occurred was recorded upon request on 30 / 4 / 1944 AD.

On this day, Ezra Menahem Daniel appeared, and after being identified by the identification witnesses Meir Hakham Moshe Dangoor and Ezra Meir

I, by my own will and choice, and in full mental capacity and maturity, have agreed to allocate the house located in the Taura neighborhood in Baghdad, which is divided into
two houses by an informal division, located at door numbers 139/73 and 14/393 according to the Tabu deed dated June 323 and sequence 312,
registered in the name of my late father Menahem Salih Daniel and transferred to me as inheritance according to the two distributions from the Judge of Personal Matters under number
40/136 Sh dated 11 / 12 / 40 and 34 / 43 Sh dated 29 / 3 / 43 from my own property, and I have endowed it as a valid, final, and perpetual endowment
for the rest of the soul of my late mother Rifka daughter of Abdullah Shlomo, provided that it be used as a clinic for the medication and treatment of the sick among the poor of
the Mosaic community, and that this clinic be named after my late mother Rifka Menahem Daniel. The trustee of this endowment ⟦full authority⟧
and absolute discretion in what he deems appropriate regarding the use of the entire endowed property as a clinic or a part of it, and any surplus he obtains, he may lease it

3 - That property number 137/125 was previously a shop and has been merged with the house number doors 137/25 (explained
its sequence above) and that this shop is registered in the Land Registry (Tabu) as an endowment (waqf) under Tabu sequence 566, Torah District.
The guardianship over these properties, as established in the Land Registry, is the Communal Council (Administrative Committee) and the Chief

The aforementioned and her group are among the poor of the Jewish community and reside in property No. Doors 393 / 14 and not 391 / 14, which belongs to the Fattal family.
The property 393 / 14 Torah neighborhood and Land Registry sequence 312 Torah was pure property in the name of Menachem Salih Daniel, and his son Ezra Menachem Daniel had endowed it according to the Endowment Deed issued by the Personal Status Court in Baghdad under No. 67 / 944 and dated 30 / 4 / 1944, and this deed is registered and marked in the Land Registry records. We have previously provided your respected Secretariat with a copy of this endowment deed attached to the Administrative Committee's letter No. 1452 dated 27 / 8 / 67. In addition to that, we attach to this letter of ours a copy of the Land Registry record for property sequence 312, a map, a copy of the aforementioned endowment deed, and a copy of the real estate tax receipt to verify the matter. I also request to ask the Rusafa Land Registry Directorate to confirm these two properties on-site (391 / 14 sequence 310 Torah and property 393 / 14 sequence 312 and their ownership) and to allow the occupants of the house to reside and not deport them.
