- Reconciliation Contract -
The First Party - Mr. Salman Daniel, Chairman of the Administrative Committee for Iraqi Jews, in addition to his guardianship over the endowments
of Menachem and Sasson Saleh Daniel and the endowments of Ezra Menachem Daniel.
The Second Party - Mr. Khairi Hassoun Al-Ansari.
The Second Party had previously signed a paper with Edwar Yaqoub, according to his general power of attorney for the deposed trustee, Mr. Emile
Saleh Shlomo, for the endowment of Menachem and Sasson Saleh Daniel, named (a lease contract), which included the properties belonging to the endowment, namely
Khan Jassan Market located in the Bab Al-Agha district in Baghdad, and also included Khan Sasson Daniel located on Bank Street
and all the shares belonging to Mr. Emile Saleh Shlomo as his absolute private property in the Zia Hotel in Baghdad
for a period of two years starting from the first of January 1961 (year one thousand nine hundred and sixty-one) until
December 1962 (year one thousand nine hundred and sixty-two), for an annual rent of seven thousand dinars, which the
agent of the deposed trustee claimed to have received from the Second Party, Mr. Khairi Hassoun Al-Ansari, provided that the aforementioned
Second Party pays the second year's rent in two equal installments, the first at its beginning and the second six months after the date of
its beginning, in addition to other clauses of the mentioned paper certified by the Kadhimiya Notary Public under general number (2929)
and date 12/17/1960. The Second Party filed three lawsuits in the Kadhimiya Civil Court of First Instance under numbers
54/B/61, 55/B/61, and 56/B/61, demanding the prevention of interference by the deposed trustee and the shop tenants
(and given his removal, the litigation was directed at the First Party in addition to his guardianship over the mentioned endowment).
Whereas the previous trustee was deposed for his betrayal and his disposal of endowment funds in violation of the endowment deed and endowment provisions
pursuant to the two decrees numbered 29 and 30 / Sh / 959 dated 5/6/1961 and 6/11/1962, and the transfer of guardianship
to the First Party in addition to his position pursuant to the guardianship deed numbered 153 / Sh / 962 dated 9/15/1962
issued by the Personal Status Court in Baghdad, and given the desire of the two contracting parties to resolve and terminate the matter of the paper
mentioned above, specifically regarding the Second Party's rights with respect to the endowments mentioned above, offer and acceptance
took place, and it was agreed between the two contracting parties as follows:
First - Revocation of the paper organized between the agent of the deposed trustee, Edwar Yaqoub, called (a lease contract), and the Second
Party, which was certified by the Kadhimiya Notary Public under number (2929) and date 12/17/1960.
Second - All clauses and conditions of the mentioned paper are considered canceled, and therefore the Second Party has no remaining right, claim, or demand.
