34 - Installation of steel partitions on the first floor

Instructions to Bidders
Regarding the contract for completing the Noam and Toubia Nouriel building in the Sinak district.
1- The contract documents consist of the following -
a) Contract Form 1 page
b) General Conditions of Contract 6 "
c) Technical Specifications 7 "
d) Bill of Quantities and Prices 6 "
2- The bidder must sign every page of the aforementioned documents and in all places where manual corrections have been made.
3- The bidder must provide the securities stipulated in paragraph (3) of the General Conditions of Contract in cash, and he may provide them in the form of a guarantee check from one of the banks to the President of the Jewish Lay Council in Baghdad.
4- The contract documents must be submitted in a sealed envelope at or before 12:00 PM on Tuesday
corresponding to 27 / March / 1951 and addressed to -
"President of the Jewish Lay Council - Trustee of the Noam and Toubia Nouriel Endowments in Baghdad"
and it shall be written on the envelope "Tender for the completion of the Noam and Toubia Nouriel building in the Sinak district"
5- The Trustee reserves the right not to accept the lowest bid and may reject any bid without providing reasons for doing so.

Completion of the Noam and Tobia Nurael building in the Sinak district
This contract was concluded between the President of the Jewish Lay Council and the Trustee of the Noam and Tobia Nurael Waqfs,
hereinafter referred to as (The Trustee), and ⟦line⟧ known
hereinafter as (The Contractor or Undertaker), who stated for the purpose of this contract the existence of a place of business for him in
and at this address, any registered letters sent to him or hand-delivered warnings, orders, and instructions shall be considered
valid direction or delivery.
(The Trustee), wherever mentioned in this contract, refers to (The President of the Lay Council, the Trustee of the Waqfs of
Noam and Tobia Nurael).
(The Building) means - The building belonging to the Noam and Tobia Nurael Waqfs on the two Sinak plots numbered
34 and 39/9 and 18.
(The Engineer) means - The engineer who executes this contract on behalf of the Trustee, who is Mr.
Niazi Fetto or his deputy or any other engineer or engineers appointed by the Trustee in writing in this capacity and the
Contractor is notified of their names to execute the work stipulated in this contract. The Contractor has also agreed hereby to
provide, pursuant to the terms and conditions contained herein and in the specifications, price schedule, and maps, which are the documents stipulated
in the contract, all workers, machinery, equipment, tools, instruments, scaffolding, guards, and everything necessary
or that may be necessary for the works and services covered by this contract and their complete accomplishment at the highest degree of
perfection and craftsmanship in execution.

General Conditions of the Contract
Specializing in the completion of the Noam and Toubia Nourail building in the Al-Sinak district.
1- Generalities
This contract includes the completion of the ground floor, the first floor, and some structures on the roof for the
Noam and Toubia Nourail building located in the Al-Sinak district, of which the foundations, the bases of the steel beams, the
foundation walls, the iron structure, two concrete pillars, and the drainage foundations on the ground floor have been completed so far, excluding
the manholes and the backfilling, according to the maps, specifications, and the price list.
2- The maps currently available for this contract and listed on page number ( ⟦illegible⟧ ) of these conditions
and the detailed maps required to be prepared during the progress of the work shall be equally binding with the technical specifications,
the price and quantity list, the materials list, and any other details, instructions, guidance, and clarifications that the
engineer may consider necessary to provide during the progress of the work.
The bidder may examine these maps at the Trustee's office or the office of Engineer Niazi Fetto during working
hours, and the contractor, upon being awarded the contract, will be allowed a complete set of these maps for a payment of (5) Dinars.
3- The successful contractor must provide a capable architect authorized by the Amanat Al-Asima (Capital Secretariat) and must submit an application to the Amanat
Al-Asima to take over the work under his responsibility, knowing that the building permit for the entire building from Amanat Al-Asima is currently held by
the Trustee, and he must bear all the necessary expenses for this process.
4- Duration of the Contract.
a- The date of the contract begins seven days after the date the contractor receives a written order to commence work,
and he must complete it within (130) days from the date of the aforementioned commencement.
b- The contract may be extended if the engineer deems it necessary due to the Trustee's failure or delay in providing the materials
required for the work for the duration involved, or due to stopping the work for any reason by the will of
the Trustee. The contractor is not entitled to claim any compensation for such delays, and the engineer's opinion in determining
the duration of the delay shall be final.
5- Insurances (Security Deposit)
When submitting his bid, the contractor must deposit with the Trustee a cash insurance amounting to (200) two hundred
dinars. These insurances shall be kept throughout the duration of the contract and the maintenance period and shall be returned to the contractor without interest after
satisfactorily fulfilling the obligations of this contract, provided that all compensations and other expenses
legally incurred by the contractor according to the terms of the contract are deducted from them.
6- Site of Work
The building is located in Al-Sinak, opposite the Rafidain Oil Company and adjacent to the Al-Pachachi building. The contractor must
visit the work site before submitting his bid and obtain all necessary site information, and it shall be understood
that obtaining all information related to the work site is the responsibility of the contractor, and he is considered to have satisfied himself
with all the information necessary to complete the work in a satisfactory manner and according to the terms of this contract, whether he inspected the work
himself or by someone representing him, or failed to inspect, or did not obtain the correct information himself.

7 - Labor
The contractor must include in his bid all labor and what is needed for the execution of the work in terms of transportation, equipment, scaffolding,
machinery, tools, and machines, especially concrete mixers, which may be necessary for the preparation and execution of the works shown in
the blueprints, specifications, and price schedules, and he must also include in his bid the temporary structures required for the execution of
the work and the transport of everything belonging to him to the work site and its removal upon its completion.
8 - Materials
The Mutawalli [custodian/trustee] shall supply all the construction materials necessary to complete the mentioned building, noting that the steel
for reinforcing the pillars has already been tied and is currently present in the yard.
9 - Delivery of materials by the Mutawalli
The Mutawalli undertakes to deliver all the materials that fall under his responsibility to the work site, and the materials supplied
by the Mutawalli are considered, upon arrival at the yard (the land previously known as the Industrial School), as if they have been delivered to
the contractor, and he must be responsible for their safety and is obliged to guard them and transport them from the delivery site to the place of use
at his own expense, and the contractor must specifically build a store to protect the cement from rain.
10 - Layout
The engineer shall carry out all the layouts necessary for the work, and the contractor must provide all the materials and equipment
necessary for this process and shall bear all the expenses resulting therefrom.
The engineer may lend the contractor a (Level) surveying instrument, provided it is used in his presence only.
11 - Dimensions
All or most of the provided blueprints have their measurements based on feet and inches, and the contractor must provide the measurement tapes,
rulers, and scales necessary to carry out the layout and measurement at his own expense.
12 - Temporary structures and others
All structures, tools, machinery, and equipment provided by the contractor for the purposes of this contract shall be for
completing the work in a satisfactory and final manner according to the provisions of this contract. All the mentioned items shall remain present
at the work site and may not be removed without the approval of the engineer, but the contractor must remove them immediately upon receiving an order to remove them
from the engineer.
13 - Guards
The contractor must provide the necessary guards to preserve the permanent and temporary structures, including
machinery, tools, equipment, scaffolding, and other related items, and for all materials delivered to him by
the Mutawalli, and he shall be responsible for any theft or shortage that occurs in them.

14 - Appointment of a Representative for the Contractor
In the event that the contractor does not reside at the work site for the purpose of executing and supervising it, he must appoint
permanently on the work and during its progress a capable representative who is good at reading blueprints and has knowledge of the work being performed, and he must
authorize such representative with the power to receive orders and instructions from the engineer.
15 - Dismissal of the Contractor's Employees
The engineer has full authority to request the contractor to dismiss or remove any of his employees, including the representative
referred to in paragraph (14) above, whom the Trustee deems undesirable to continue in the work, and the contractor must execute
those requests as soon as they are issued, and he has no right to claim any compensation or liability that may result from that in any way whatsoever.
16 - Delay Compensation
If the contractor fails, delays, or stops the completion of the work stipulated for him under this contract, he shall be liable
to pay the Trustee compensation in the amount of (5/-) five Dinars per day, and these compensations shall be deducted from his entitlements
or his securities.
17 - Withdrawal of Work from the Contractor
If the contractor defaults or fails to complete any item of the work items or the entire building in general, or fails
to observe any article of this contract, he shall be liable, in addition to paying ⟦full⟧ compensations stipulated
in paragraph (16) above, to having the work withdrawn from him after being warned in writing of the nature of the default or failure, and having it executed by any
method the Trustee deems appropriate, using all mechanical means and temporary structures prepared for this purpose
until the completion of the work, at which point the contractor's connection to the work is severed, and his account is settled after deducting the compensations
and all other amounts duly owed by him.
18 - Contractor's Partners
The person or partners whose names are mentioned in the contract throughout its duration shall have the status of "The Contractor", and the
Trustee does not recognize the involvement of other persons in the contract or the withdrawal of any individual partner, and the Trustee's dealing
with one partner in contract matters shall be considered as dealing with all partners, and these transactions shall have a binding effect unless
there are matters for which the partners may request in writing their joint signatures. The partners shall be jointly and severally liable toward
the Trustee for all responsibilities and obligations resulting from this contract.
19 - Bill of Quantities and Prices
The contractor must set prices against the units shown in the attached price schedule, and all work measurements
and its payments shall be carried out on the basis of these prices, and every work that does not have a price in the price schedule must be estimated by mutual consent
and agreement on its price before commencing it.
It must be understood that the purpose of the items shown in the ⟦schedule⟧ of prices does not serve as a guide for estimating

the work upon its completion, and that the existence of any item does not necessarily mean it must be carried out. The Trustee has the right to make changes
to any item of the schedule of prices and quantities, whether by reduction or increase, as the Engineer deems necessary for the work,
and has full choice in designating the items that are not intended to be carried out.
20 - Payments and Measurements
The work shall be measured and its payments made according to the prices shown in the price schedule. The contractor must
provide two bound notebooks for recording measurements. All work shall be measured by the Engineer and the contractor,
recorded and signed by both in the two measurement books, of which each party shall keep a copy.
All works that are to be covered must be measured before being covered, and all other works
must be measured according to the progress of the work. Upon completion of the work, the Trustee or the contractor may - if either wishes -
request a re-measurement of all the work, but in the case of such a request by the contractor, he must
pay a nominal sum of (20) twenty Dinars, and this amount shall be returned to him only if his claims
prompting the request for re-measurement are proven justified.
21 - The contractor is entitled to receive advances from the Trustee on the basis of 90% of all satisfactorily completed work.
Upon completion of the work, the contractor's full dues shall be paid, but the securities shall not be returned to him until the expiration of the maintenance period.
Advances granted to the contractor are not considered an admission of acceptance of the work by the Trustee; rather, the
terms and specifications of the contract apply to all completed and uncompleted work until its final handover to the Trustee.
22 - Inspection of Completed Work -
The Engineer may order the inspection of a part of the covered work if he believes there is a defect inside it, and
the contractor must comply with the order immediately. If defects are found, the costs of inspection and repair, including
the cost of materials, shall be borne by the contractor. However, if no defects appear, the costs shall be calculated for the contractor as extra work.
23 - Rejection of Work
The Trustee has the right to reject any work that, in the Engineer's view, is based on quality and workmanship that do not meet the required
standard or do not comply with the specifications or drawings related to the contract. The contractor must remove the rejected work
immediately and re-execute it at his own expense, including the value of materials present in the rejected site.
Any work carried out without authorization from the Engineer, in addition to the details given in the drawings or to
the issued instructions, will not be recognized by the Trustee nor measured, and the value of materials used
in executing such works shall be deducted from the contractor.
24 - Damages
The contractor is responsible for all damages that may occur to the structures related to this contract during
the progress of work, and he must repair such damages at his own expense, including the value of materials, and to the
Engineer's complete satisfaction.
25 - Water
The contractor must take over the water pipe as it currently is, and he must provide tanks of capacity

sufficient for the progress of his works, and if he wishes to expand the network of water installations or if the work requires an expansion
like this, he must bear the resulting expenses, and the Trustee shall provide the contractor with water free of charge.
26 - Arbitration
When any issue concerning this contract is a subject of disagreement or dispute between the Trustee or the Contractor, it shall be referred
to a committee composed of three persons: one appointed by the Trustee, one appointed by the Contractor, and the third, who is the umpire,
is appointed with the approval of both parties. If the two parties are unable to agree on an umpire, then the President of the
Court of Cassation shall be requested to appoint him.
The arbitration decision shall be final, and the arbitration fees and costs shall be paid in the proportion decided by the umpire.
27 - Notifications
The two contracting parties waive the right to issue notifications from one to the other through the
Notary Public regarding the affairs of this contract. Every notification sent by one of the parties must either be delivered to the address
of the other party or sent to them by registered mail.
28 - Maintenance Period
The contractor must maintain all the work for a period of six months starting from the date the Trustee receives
it from him as a provisional acceptance, and he must repair all deficiencies or defects that may appear during the maintenance period
at his own expense. The securities or what remains of them shall be returned to him after deducting the amounts duly owed by him
at the end of the maintenance period and after the contractor has fulfilled his obligations and the work has been finally accepted from him.
29 - Sanitary Arrangements
The contractor shall make his own sanitary arrangements for his workers and shall provide at his own expense the necessary
latrines or toilets for this purpose and shall maintain the cleanliness of the sites where the work is carried out.
30 - Labor Laws
The contractor is responsible for implementing labor laws regarding all labor matters and observing them regarding
wages for official holidays, feasts, and compensations, as he is also responsible for accidents that occur to his employees at
the work site, and he must pay all resulting compensations.

F- Concrete must be protected from rain or sunlight until it hardens and must be kept well
moistened for a period of no less than (15) days from the date of pouring.
G- It is recommended that the contractor pours the roof in one cycle; in any case, the pouring may not be divided into more
than two cycles, meaning the contractor must prepare formwork for no less than half of the roof area.
H- The contractor must place all holes for pipes, cables, and the like in the formwork in their correct
positions, as well as the hanging rods for the Baghdadi ceiling and electric fans, without additional cost.
3 - Steel
A- The contractor shall cut and bend the mild steel and (B.R.C.) steel and place it in the
designated locations according to the maps prepared for that, and the contractor must clean the steel with a wire brush if
there is a need for that.
B- The contractor must tie the reinforcement bars to each other and bind them well using
flexible wires provided by the Mutawalli.
4 - Damp-proof Concrete
The damp-proof concrete mix ratio shall be 1:2:4, and Sika No. (1) material shall be mixed with the mixing water
at a ratio of (1) Sika to (10) water. The contractor shall provide the necessary formwork for the edges of the pour, as well as provide suitable tanks
for mixing the Sika with water.
5 - Column Concrete
The concrete mix ratio used for columns shall be 1:1.5:3, and the contractor must place
the reinforcement bars in their correct position under the supervision of the engineer. The sections of the formwork used
for the columns must correspond to the column sections and according to the detailed maps prepared for that. If necessity dictates
pouring part of the columns in two stages due to concrete lintels above doors and windows, the
contractor shall implement that.
6 - Beam Concrete
The concrete mix ratio for beams shall be 1:2:4, and the contractor shall place the reinforcement bars
in their correct position under the supervision of the engineer. The contractor must bend the bars protruding from the concrete columns
and place them inside the beams, and he must place all holes and hanging rods for the Baghdadi ceiling if
necessity dictates.
7 - Concrete lintels above doors and windows.
The concrete mix ratio shall be 1:2:4, and the contractor shall place the reinforcement bars according to
the engineer's instructions. These lintels must protrude on both sides of the window or door opening for a distance determined by
the engineer. The contractor shall provide the formwork and connect the upper frame section to the pour using the (cleat) prepared
for this purpose.

8 - Roof Concrete
The concrete mix ratio for the roofs shall be 1 : 2 : 4. The contractor must cut and place
(B.R.C.) steel according to the guidance and supervision of the engineer and in the manner approved in accordance
with the detailed maps prepared for that purpose. He must prepare all the molds and scaffolding needed for this purpose.
Casting may not be completed except in locations approved by the engineer. (Please refer to
paragraph 2 g).
9 - Stair Concrete
The concrete mix ratio shall be 1 : 2 : 4. The contractor must place the reinforcement bars in
their correct location under the supervision of the engineer and according to the detailed maps. The contractor must prepare all necessary
molds for the purpose of casting, and the casting process shall be done once for each cycle of the stairs.
10 - Tie-Beam Concrete
The concrete mix ratio shall be 1 : 2 : 4. The contractor must place 4 reinforcement bars
with a diameter of 3/8 inch. The cross-section of the tie-beam shall be 5 inches by 6 inches. The level of the tie-beams shall be equal to the level of
the concrete lintels above the doors and windows. The contractor must prepare the molds for that.
11 - Pre-cast Concrete under the front parapet, light wells and roof
Pre-cast concrete slab under front parapet, light wells and roof.
The concrete mix ratio shall be 1 : 2 : 4. This concrete may be cast either in its final
location or cast on the ground and then installed in its original place after hardening. Reinforcement bars
must be placed, and their number and specifications must be according to the guidance and supervision of the engineer and in accordance with the detailed maps.
12 - Concrete slabs attached to the staircase opening
Pre-cast concrete slab for staircase.
The mix ratio shall be 1 : 2 : 4. The contractor must cast this concrete on the ground and leave it
until it hardens, and then it must be placed in its final location between iron (Joists) with a section
of 4 inches by 3 inches each. The casting depth and reinforcement bars shall be according to the maps. The contractor must saturate
the joints with cement and sand mortar in a ratio of 1 : 4 after placing the slabs.
13 - Sun-shade Concrete
The concrete mix ratio shall be 1 : 1 1/2 : 3. The thickness of the sun-shade shall be 3 inches. The
contractor must prepare the molds for that. As for the reinforcement bars, they must be placed according to the engineer's guidance and in accordance
with the detailed maps prepared for that purpose. (Refined) molds must be used, and the contractor must repair the faces
of the concrete and polish it at his own expense and without an additional price.

The concrete mix ratio shall be 1:2:4, and before starting the casting, the steel columns must be wrapped
with a wire mesh. The mold sections must be according to the engineer's instructions. The
contractor, before starting the casting, must ensure that the wire mesh is tied perfectly. The column shall be measured
by its external dimensions without subtracting the steel column.
15 - Plastering beams with cement to prevent fire impact.
All beams shall be wrapped with a wire mesh and tied perfectly according to the drawings, then plastered with cement
at a ratio of (1) cement to (3) sand with a thickness of one inch.
16 - Parapet concrete
The parapet concrete mix ratio shall be 1:2:4, with an average depth of 3 inches. The contractor must
prepare the necessary clean molds for this purpose, with the requirement of placing long grooves on both sides of the
parapet casting to prevent rainwater from leaking onto the walls. The parapet covers must be cast on the ground
in lengths that can be lifted in the future and placed on the high roof parapets when building other floors.
17 - Brickwork and cement construction
a - Bricks must be submerged in clean water in barrels or basins immediately before use, and the
bricks shall remain submerged in water for a period of no less than one hour until completely saturated, avoiding the direct
transfer of bricks from the basins and their immediate use in construction.
b - Bricks must be laid using the best known methods, and each brick must be placed on the mortar and tapped by the
masons' hands lightly so as not to break it until the mortar emerges from all sides. The thickness of
the joint should be about 3/4 inch.
c - Buildings constructed with cement must be sprayed with sprinklers during and after construction for a period
of no less than (7) days so that they remain moist. The cement ratio shall be (1) cement to (5) sand in all
buildings constructed with brick and cement. Before starting the brick and cement work, the existing
external wall belonging to the neighbor must be plastered with cement at a ratio of (1) cement to (5) sand without additional
price. All external walls from the ground floor level to the first floor level shall be built
with brick and cement. The contractor must place tunnels and grooves in the walls for pipes and panels and then
close them without additional price. The contractor must also cooperate with the electricians to place wires inside
the walls.
18 - Construction with hollow bricks and gypsum for internal or external walls.

19 - Polished and Unpolished Ground Floor Concrete
The mixture ratio for the concrete used for the floors is 1 : 2 : 4 and shall be 6 inches deep.
Before starting to pour the floors, the ground must be buried and well compacted, then spread thereafter with one layer of
10 cm thickness of crushed <del>⟦back⟧</del> brick, and it must be well pounded. Then, the pouring begins with dimensions determined by
the engineer.
The polished floors must be level and at the best degree of smoothness and perfection.
20 - Yellow Brick and Gypsum Masonry (Kaf Qayma) for front faces.
The masonry must be good, and the gypsum mortar must be sufficient and of equal thickness in
all parts of the building. The joints are to be defined using a ruler, and no broken or chipped brick should be used
in this type of masonry. The courses must be perfectly horizontal and then pointed with white cement, remaining
recessed about 1/4 inch. The price includes the dressing of the bricks to the required measurements.
21 - Cement Plastering for the rear side
After building the exterior wall for the rear side, the joints are raked and plastered with cement in a ratio
of (1) cement to (3) sand, then troweled with cement in a ratio of (1) cement to (3) sand as well. The
plaster is applied in the specified color, and the total thickness must not be less than 3/4 inch. If plastering is waived, the
specified color is applied with a brush in two coats.
22 - The skirting shall be 15 cm high and troweled with cement in a ratio of (1) cement to (3) sand, and the
troweling must be perfect, polished, and free of scratches. The face of the skirting shall be cement, recessed approximately 1/4 inch
from the face of the surface troweled with gypsum.
23 - Tiling with Mosaic Tiles for the ground floor, bathroom, and kitchens of the first floor
The ground floor, bathroom, and kitchens of the first floor are tiled with mosaic tiles using cement mortar
in a ratio of (1) cement to (3) sand, provided that the mortar thickness is not less than one inch. The
tiles must be soaked in water for one hour before use, and the tiling is done horizontally with joints of equal thickness.
It is left for three days, then the joints are grouted with colored cement. When performing the grouting process,
wooden boards must be placed for workers to walk on, and the floor must be soaked with water for seven days. The contractor
must clean the tile surfaces of all dirt.
24 - Baghdadi Ceiling
The Baghdadi ceiling consists of a metal mesh and iron or wooden straps suspended from
the ceiling and fixed to the main ceilings and beams according to the detailed drawings. The contractor must place the hanging rods
in the ceilings when pouring them in the designated places. The process of plastering the mesh is carried out in a ratio of (1) cement to
(1) sand and left until dry, then troweled with gypsum like the walls.
