5. The Lessee has agreed to pay in advance to the Lessor on the
date of handing over the building complete to the Lessee the sum of
ID. 8750 (Eight thousand seven hundred and fifty Dinars) being the
equivalent to five years rental.
6. The Lessor undertakes to hand over the building complete to the
Lessee on or before 31.12.1950. The date of completion shall be the
date on which the architects deliver a certificate that the building
is ready for occupation from which date the period of the lease
shall commence.
7. While the Lessee undertakes to supply certain materials at prices
and conditions hereinafter defined in the shortest period possible he
does not accept any responsibility financially or otherwise if by
delay in delivery of these materials for reasons outside his control
the building is not handed over for occupation by 31.12.1950. In case
of such delay the date of handing over (viz. 31.12.1950) shall
automatically be extended by a period corresponding to the period of
delay in delivery of the aforesaid materials by the Lessee provided
always that the period of delay shall not exceed six months. If the
Lessee shall fail to supply these materials during the extended
period of delay the Lessor shall then become entitled to use the
materials available locally.
8. (a). If the Lessor fails to hand over the building complete to
the Lessee on 31.12.1950 or on any other extended date under the
provisions of Clause (7) above he shall be liable to pay to the Lessee
the amount of ID. 10 (Ten Dinars) for each day of delay up to 20
(Twenty days). If the delay exceeds 20 days the Lessor shall pay to
the Lessee by way of compensation an amount of ID. 5000 (Five thousand
Dinars) only ( the two hundred Dinars of the twenty days delay
including) and the Agreement shall be considered as automatically
cancelled. Payment of compensation shall become due without notarial
notice or any other legal or official formality whatsoever.
(b). If, on the other hand, the Lessee fails to take over the
building and pay to the Lessor the sum of ID. 8750 (Eight thousand
seven hundred and fifty Dinars) within twenty days from the date
on which the architects considered the building as ready for
occupation, he shall pay to the Lessor the amount of ID. 10 (Ten
Dinars) for each day of delay up to 20 days. If the delay exceeds
20 days the Lessee shall pay to the Lessor by way of compensation
an amount of ID. 5000 (Five thousand Dinars) and the Agreement shall
be considered as automatically cancelled. Payment of compensation
shall become due without notarial notice or any other legal or
official formality whatsoever.
9. The Lessor undertakes to use the following materials which the
Lessee has agreed to import and/or supply to the Lessor at cost
against documents:

(a). Pre-fabricated steelwork or heavy joists from Aston Construction
Co. Ltd., for the main beams and stanchions.
(b). Doors, shop-fronts and standard steel windows by the Crittall
Manufacturing Co. Ltd.
10. The Lessor will be responsible for the normal wiring of the whole
building. Such wiring will be of external type. All extra wiring will
be at the Lessee's expense. All lighting, Cooling (including fans) and
heating appliances will be supplied by the Lessee and fixed at the
latter's expense. If the Lessee wants internal wiring, the difference
of cost between both external and internal types will be borne by the
Lessee. The Lessor will use electrical materials by G.E.C. England.
11. The Lessor undertakes to engage Messrs. Hirst and Fetto as
architects and engineers in charge of supervising the building work
until completion. Messrs. Hirst and Fetto will make free use of the
abovementioned materials and to make such minor adjustments and
alterations in the drawing referred to in Clause (1) above as compatible
with first class building practice.
12. The Lessor undertakes to supply all materials made or purchased
locally of the first class quality and also to employ skilled workmen
or contractors to complete the building in first class workmanlike
manner to the entire satisfaction of the architects and the Lessee.
13. The Lessee shall have the right to sub-let.
14. The Lessor shall construct stairs leading from the back street to
the first floor and thence to the roof and the Lessee shall have,
subject always to the provisions of Para.(c) Clause (4) above, the sole
right to use these stairs during the tenure of the lease. The Lessor
shall also construct, to design of architects, stairs leading from the
showroom to the Offices on the first floor.
15. The Lessor undertakes to obtain permit to build on the two plots
mentioned in Clause (1) above and shall bear during the currency of this
Agreement or any extension thereof all land and property taxes as well
as other taxes on immovable properties which may at any time be
introduced.
16. The Lessor shall design and build a suitable sewage and drainage
schemes; he also undertakes to make all alterations and connections
to any sewers and/or drains installed as and when ordered under legis-
-lation by the competent Authority.
17. The Lessor shall be responsible for normal maintenance of the
building in good repair but shall not be responsible for any damage
or wilful negligence caused by the Lessee. The Lessee will be
responsible for necessary repairs of any damage caused by him. Such
repairs have to be carried out to the original standard of the building.

The Lessee shall be responsible for clearing sewage. If additional
floors are added, then the clearing of sewage for the whole building
will be for lessor's account.
18. This Agreement has been drawn in English and Arabic and in case
of any difference between the two texts, the English text shall
prevail.

Instructions to Bidders
Regarding the contract for completing the Noam and Toubia Nouriel building in the Sinak district.
1- The contract documents consist of the following: -
(a) Contract Form: 1 page
(b) General Conditions of Contract: 6 pages
(c) Technical Specifications: 7 pages
(d) Bill of Quantities and Prices: 6 pages
2- The bidder must sign every page of the aforementioned documents and in all places where
manual corrections have been made.
3- The bidder must provide the security deposits stipulated in paragraph (3) of the General Conditions of Contract in cash,
and may provide them in the form of a bank guarantee check from one of the banks to the President of the Jewish Lay Council
in Baghdad.
4- Contract documents must be submitted in a sealed envelope at or before 12:00 PM on Tuesday,
corresponding to March 27, 1951, addressed to: -
"President of the Jewish Lay Council - Trustee of the Noam and Toubia Nouriel Endowments in Baghdad"
And written on the envelope: "Tender for completing the Noam and Toubia Nouriel building in the Sinak district"
5- The Trustee reserves the right not to accept the lowest bid and may reject any bid without giving reasons
for doing so.
6- Any bid not submitted by the appointed time or not accompanied by the stipulated security deposits shall be liable
to rejection.

Contract Form
Completion of the Noham and Toubia Nouriel building in the Al-Sinak district.
This contract was concluded between the President of the Israeli Corporeal Council and the Trustee of the Noham and Toubia Nouriel Endowments
hereinafter referred to as (the Trustee) and ⟦Engineer Yusuf Yusir⟧ known
hereinafter as (the Contractor or Undertaker) who stated for the purpose of this contract the existence of his place of business in ⟦Al-Nahr Street⟧
⟦Baghdad⟧
And this address shall be considered valid for what is directed to him of registered letters or what is delivered to him by hand of warnings, orders, and instructions,
directing or delivering them is correct.
The term (the Trustee) wherever mentioned in this contract means (the President of the Corporeal Council, the Trustee of the Endowments of
Noham and Toubia Nouriel).
The term (the Building) means - the building belonging to the endowments of Noham and Toubia Nouriel on the two Al-Sinak plots numbered
34 and 39 / 18.
The term (the Engineer) means - the engineer who executes this contract on behalf of the Trustee, who is Mr.
Namazi Fatto or whoever represents him or any other engineer or engineers appointed by the Trustee in writing in this capacity and notifying
the Contractor of their names to execute the work stipulated in this contract. The Contractor has also agreed hereby that
he shall perform according to the provisions and conditions contained herein and in the specifications, price schedules, and maps, which are the documents stipulated
in the contract, providing all workers, machinery, equipment, tools, instruments, places, senses, and everything necessary
or that may be necessary for the works and services covered by this contract and their complete achievement to the highest degree of
perfection and craftsmanship in execution.

The Contractor acknowledged that he visited the work site and reviewed fully, accurately, and precisely all the maps and
what has been completed of the work so far and what remains to be completed according to this contract, and that he has reviewed the work area

General Conditions of the Contract
Specialized in completing the Nuhem and Toubiya Nourael building in the Al-Sinak district.
1- Generalities
This contract includes the completion of the ground floor, the first floor, and some structures on the roof for the
Nuhem and Toubiya Nourael building located in the Al-Sinak district, of which the foundations, casting of steel beams, foundation
walls, the steel structure, two concrete pillars, and the plumbing installations for the ground floor have been completed so far, except for
manholes and backfilling, according to the blueprints, specifications, and the schedule of prices.
2- The blueprints currently available in this contract and fixed on page numbered ( ⟦4⟧ ) of these conditions,
and the detailed blueprints that are required to be provided during the course of work, shall be equally binding with the technical specifications,
the schedule of prices and quantities, the schedule of materials, and any other details, instructions, directions, and clarifications that
the engineer may mention as necessary to provide during the progress of work.
The bidder may inspect these blueprints at the Trustee's office or Engineer Namazi's office during
working hours. Upon awarding the contract, the contractor will be provided with a full set of these blueprints against a payment of (5) Dinars.
3- The successful contractor must provide an old fence ⟦illegible⟧ by the Secretariat of the Capital and submit an application to the
Secretariat of the Capital to take over the work. It is noted that the Secretariat of the Capital's permit for the full building is currently held by
the Trustee, and the contractor must bear all the necessary expenses for this process.
4- Duration of the Contract.
A- The contract date begins seven days after the date the contractor receives a written order to commence work,
and he must complete it within (130) days from the aforementioned commencement date.
B- The contract may be extended if the engineer deems it necessary due to the failure or delay of the Trustee in providing the materials
required for the work, estimating the period involved therein, or due to the suspension of work for any reason by the will
of the Trustee. The contractor shall not be entitled to claim any compensation for such delays, and the engineer's opinion in determining
the period of delay shall be final.
5- Guarantees
Upon submitting his bid, the contractor must deposit with the Trustee a cash guarantee of (200) two hundred
dinars. This guarantee shall be kept throughout the duration of the contract and the maintenance period and returned to the contractor without interest after
satisfactorily fulfilling the obligations of this contract, provided that all compensations and other expenses
duly incurred by the contractor under the terms of the contract are deducted from it.
6- Work Site
The building is located in Al-Sinak, opposite the Al-Rafidain Oil Company and adjacent to the Al-Pachachi building. The contractor must
visit the work site before submitting his bid and obtain all necessary site information. It should be understood
that obtaining all information related to the work site is the responsibility of the contractor, and he is considered to have satisfied himself
with all information necessary to complete the work in a satisfactory manner and according to the terms of this contract, whether he inspected the work
himself or through his representative, or failed to inspect it, or did not obtain the correct information himself.

7- Workers
The contractor must include in his bid all workers and what is needed for the execution of the work in terms of transportation, equipment, scaffolding,
tools, and machinery, especially concrete mixers, as may be required for the procurement and execution of the works shown in the
maps, specifications, and price schedules. He must also include in his bid the temporary structures required for the execution of
the work and transport all that belongs to him to the work site and remove it upon completion.
8- Materials
The Trustee shall provide all construction materials necessary to complete the mentioned building, noting that the iron
for reinforcing the pillars has already been tied and is currently present in the yard.
9- Delivery of Materials by the Trustee
The Trustee undertakes to deliver all materials for which he is responsible to the work site. Materials provided
by the Trustee are considered, upon arrival at the yard (the land formerly known as the Industrial School), as if delivered to
the contractor. He shall be responsible for their safety, storage, guarding, and transporting them from the delivery site to the place of use
at his own expense. The contractor specifically must build a warehouse to protect the cement from rain.
10- Layout
The engineer shall carry out all necessary layouts for the work, and the contractor must provide all materials and equipment
necessary for this process and bear all the costs resulting from it.
The engineer may lend the contractor a leveling instrument (Level), provided it is used in his presence only.
11- Dimensions
All or most of the provided maps have measurements based on feet and inches, and the contractor must provide the measuring
tapes, rulers, and scales necessary for carrying out the layout and measurement at his own expense.
12- Temporary Structures and Others
All structures, tools, machinery, and equipment provided by the contractor for the purposes of this contract shall be
to complete the work in a satisfactory and final manner according to the provisions of this contract. All aforementioned items shall remain present
at the work site and may not be removed without the engineer's approval; however, the contractor must remove them immediately upon receiving an order to remove them
from the engineer.
13- Guards
The contractor must provide the necessary guards to protect permanent and temporary structures, including
machinery, tools, equipment, scaffolding, and other related items, as well as all materials delivered to him by
the Trustee. He shall be responsible for any theft or shortage that occurs in them.

Restoration Building and Brickwork of Nourail
Specifications
1- Forms
a- Forms must be constructed so that their dimensions match what is shown in the detailed concrete drawings, and they must
be well-made of wood, free from cracks and holes, and prevent the leakage of concrete mortar during work.
The contractor, before starting work, must submit to the specialized engineer a drawing showing the method of installing these
forms and their supports for approval. The face of the form in contact with the concrete must be clean and free
from dirt and well-moistened with water immediately before placing the concrete. The inner surfaces of the forms must be coated with light
oil or soap.
b- Forms must not be removed except after the contractor obtains the approval of the specialized engineer, and they must be removed
in a manner that ensures no damage or breakage occurs to the edges of the concrete. The forms must remain in their locations
for the following periods:
Seven days for each pour regardless of its span, plus one day for every foot exceeding seven days
up to a maximum of (28) days. As for the vertical sides of beams and supports, their forms may be removed
after (48) hours have passed.
c- Concrete surfaces must be free of cavities and protrusions. After removing the forms, if there are
excessive holes or cavities, the engineer has the right to demolish the concrete and re-cast it at the contractor's expense.
2- Concrete
a- Concrete must be mixed in specified proportions using a mechanical mixer, provided that the duration of each mix is not less than two minutes.
The engineer determines the necessary proportions of water according to the concrete mix.
b- Baghdadi river sand may not be used at all. When it is necessary to use fine sand,
the contractor must sift what is needed of fine sand from the available Habbaniyah sand.
c- The contractor must prepare special (measures) in the form of boxes for cement, gravel, and sand, the dimensions of which are specified by
the engineer. The wooden boxes must be sturdy, well-made, and tightly sealed.
d- Concrete must be poured immediately after mixing. Any concrete that begins to harden before use ⟦must⟧
be rejected and removed from the work site. Therefore, the time between mixing the concrete and placing it in its final location
must not exceed fifteen minutes. If the engineer is forced to reject a layer of concrete, the contractor will bear the cost of the cement
and other materials used in it.
e- Concrete is placed in layers, the thickness of each layer not exceeding (15) cm or as the engineer deems appropriate, and it is tamped
well until the forms are completely filled. The concrete must be free of air holes, and all
necessary precautions must be taken to prevent changing the position of the bars or steel meshes used for reinforcement or the vibration of the forms
during the pouring or tamping of the concrete.

The concrete mix ratio shall be 1:2:4, and before starting the casting, the iron columns must be wrapped
with an iron mesh (wire mesh). The formwork sections must be according to the engineer's instructions. The
contractor, before starting the casting, must ensure that the iron mesh is tied perfectly. Payment will be made according
to the external measurements without deducting the iron allowance.
15 - Plastering beams with cement to protect from fire effects.
All beams shall be wrapped with an iron mesh and tied perfectly according to the plans, then plastered with cement
at a ratio of (1) cement to (3) sand with a thickness of one inch.
16 - Parapet concrete
The mix ratio for parapet concrete shall be 1:2:4, with an average depth of 3 inches. The contractor must
prepare the necessary clean molds for this purpose, with the obligation to place long grooves on both sides of the
parapet casting to prevent rainwater from leaking onto the walls. The parapet covers must be cast on the ground
in lengths that can be lifted in the future and placed on the high roof parapets when other floors are constructed.
17 - Brickwork and cement
a - Bricks must be submerged in clean water in barrels or basins immediately before use, and the
bricks must remain submerged in water for at least one hour until they are completely saturated. The bricks must be moved from the basins
and used directly in the construction.
b - The bricks must be built using the best known methods, and each brick must be placed on the mortar and tapped with the
builders' trowel lightly so as not to break it, until the mortar emerges from all sides. The joint thickness should be
about ½ inch.
c - Buildings built with cement must be sprayed with sprinklers during and after construction for a period
of at least (7) days so that they remain moist. The cement ratio shall be (1) cement to (5) sand in all
buildings constructed with brick and cement. Before starting the brick and cement construction, the existing
external wall belonging to the neighbor must be plastered with cement at a ratio of (1) cement to (5) sand at no
additional cost. All external walls from the ground floor level to the first floor level shall be built
with brick and cement. The contractor must place the tunnels and grooves in the walls for pipes and cables and then
close them at no additional cost. The contractor must also cooperate with the electricians to place the wires inside
the walls.
18 - Building with hollow bricks and gypsum for internal or external walls.
Hollow bricks 9 by 9 by 4 ½ inches shall be used for constructing internal walls according to
the plans, and they shall be built with gypsum mortar. The joint thickness shall be about ½ inch ⟦gypsum⟧
