Defendant - Yusuf Shlomo Shamash, residing in the Al-Senak neighborhood, trustee of the Shamash School endowments.
The defendant is the trustee of the Shamash School endowments pursuant to the deed of trusteeship issued by your
respected court under number 94 / 1936 dated July 1, 1936. The aforementioned trustee is unable to manage
the affairs of the mentioned endowment due to his old age, and his son Saleh is outside Iraq, and has recently
acquired a foreign nationality. Fearing the loss of the endowment, I request the defendant be summoned to court, dismissed from the trusteeship, and the President of
the Lay Council, his deputy, or his successor be appointed as the trustee of the aforementioned endowments.

Lease Contract for Shamash School First Party (Lessor): Mr. Naeem Ibrahim Zubaida, Vice President of the Lay Council, by virtue of his power of attorney for the trustee Mr. Yusuf Shlomo Shamash, certified by the Notary Public of North Baghdad under number 243 and dated 3/5/1951. Second Party (Lessee): Mr. Mustafa Zamani, Supervisor of Iranian Schools in Iraq. This agreement has been concluded between the First Party and the Second Party according to the following conditions:- 1- The First Party has leased to the Second Party the school building known as Shamash School in Baghdad, located on Al-Rashid Street, Jadid Hassan Pasha quarter, for a period of one year from the date of June 22, 1951, until June 21, 1952, for an annual rent amounting to eight hundred Dinars. 2- The Second Party has agreed to lease the mentioned building for the period and rent mentioned in the previous paragraph. 3- The rent for the school building known as Shamash School does not include the shops attached to it, whether they are located on Al-Rashid Street or on the back side of the mentioned building, nor the traveler's inn (Musafirkhana) overlooking Al-Rashid Street. Also, this lease does not include the ground basement, provided that the First Party shall not have the right to use it from the door located inside the school; rather, this door shall be firmly sealed. 4- The annual rent amounting to eight hundred Dinars shall be paid in two installments. The first installment, amounting to four hundred Dinars, shall be paid by the Second Party to the First Party upon the certification of this contract by the Notary Public. The second installment shall be paid after six months from the date of the start of the lease contract, i.e., from (June 22, 1951). The First Party acknowledges that he has received the first installment amounting to four hundred Dinars in cash. 5- The Second Party undertakes to pay the second installment of the rent, amounting to four hundred Dinars, on the due date, i.e., on (December 22, 1951). If he is late in payment, the First Party has the option to demand it immediately or to terminate the lease without the need for a formal notice. 6- After the end of the lease period, if no official notice is issued by the Second Party two months before the end of the lease period, the lease shall be considered concluded and continuous under the same rent and conditions listed in this agreement. This arrangement shall be effective and valid in subsequent years. Likewise, if the First Party does not wish to renew the contract, he must inform the Second Party in writing two months before the end of the lease. 7- The Second Party may not sublease the property to others without obtaining the written consent of the First Party, nor may he use it for a purpose other than the purpose for which he leased it, which is to use it as a school for teaching students. In the event of failure to do so, the First Party has the right to terminate and vacate the property without the need for a formal notice. 8- The Second Party is responsible to the First Party for delivering the electrical fixtures and the windows with their glass in sound condition at the end of the lease period. 9- The property tax is the responsibility of the First Party, while water fees, security fees, and the customary fees for tenants shall be the responsibility of the Second Party. 10- At the end of the lease period and its non-renewal, the Second Party must vacate the property and deliver it to the First Party free of all occupants. If the Second Party fails to deliver the property accordingly, he shall be obliged to pay two Dinars and two hundred and fifty Fils for each day he occupies the property to the First Party without the need for a notice until the actual eviction occurs, whether by consent or by court order. This agreement was drafted in two copies, one for each party, in Baghdad on 1/6/1951.
