Commercial Law Curriculum for the Sixth Commercial Grade (1970 - 1971)
1- In the first half of the academic year 70 / 71, students were given an introduction to commercial law and its relationship
with other branches of law, particularly civil law, and the complete sources for deciding commercial lawsuits.
And then the extent of the applicability of commercial law rules, the subjective and objective doctrines, and the position of the Iraqi legislator
towards both.
2- Chapter One - Commercial acts and the most important criteria for distinguishing civil acts from commercial acts, such as speculation
and circulation. And the position of the Iraqi legislator towards these criteria.
Types of Commercial Acts
A - Original commercial acts. B - Incidental commercial acts. C - Mixed acts.
The importance of distinguishing between commercial and civil acts in terms of jurisdiction, proof, interest rate,
joint liability, notification, and the statute of limitations for the lawsuit.
3- Chapter Two - Merchants: The importance of distinguishing between a merchant and a non-merchant and the conditions that must be met
to acquire the status of a merchant. Such as legal capacity, the exceptions related to it, and the impediments that
restrict the freedom to practice commerce, and the person engaging in commercial acts in his own name and making commercial
acts his habitual profession.
Also, the duties of merchants in terms of keeping commercial books, adopting a commercial trade name, and registering in
the commercial register, and unfair competition.
The mid-year exam was up to this point.
And in the second semester of the year... we started with the subject of Part Two, which is commercial companies, and I have given
the students a comprehensive introduction to the subject, then the definition of companies, their types, and the rules governing them in terms of
the contract and the substantive and formal conditions therein, and then the legal personality.
And the characteristics of the company contract in terms of each partner providing a share in the capital, the intention of profit, and sharing in
profits and losses, and the intention to participate.
And then types of companies: partnership companies and capital companies... and now I have finished with partnership companies
and we started with capital companies and we will finish them next week.
As for the rest of the curriculum from 28 / 3 / 1971 until the end of the academic year 70 / 1971
1- The check and the policy ((commercial papers)), mandatory conditions, and the penalty resulting from their absence,
payment of the check, presentation period, refusal of payment, the crossed check, and the statute of limitations for the commercial
lawsuit.
2- Bankruptcy, introduction, its types, its conditions, its effects on the debtor merchant and his assets, commercial rehabilitation

Commercial Law Curriculum for the Sixth Commercial Grade (1970 - 1971)
