Sub. Amendment of the contract passed with
the Jewish Hospitals Committee.

Dear Dr. Tokar,
This is to confirm our agreement for the amendment of the
contract dated the 1.7.1940 passed between you and the Jewish Hospitals
Committee governing your conditions of service in the Meir Elias Hospital,
Baghdad.
You will be entitled notwithstanding anything to the contrary in
the Contract referred ⟦to⟧ above to open a private clinic outside the Hospital to
be run by you daily in the afternoons subject to the following conditions:-
1- The daily working hours in the Hospital shall be six: five hours
and a half in the morning and half an hour in the evening provided that
the daily work at the Hospital will be taken care of notwithstanding the
said time limit. The time at which the daily working hours shall begin
and end shall be fixed from time to time by the Directorate of the Hospital.
2- You will not be entitled to pay medical visits to outside patients
during the working hours in the morning.
3- You will always be available at the Hospital for emergency or
when needed at any time.
4- The private clinic shall always be outside the Hospital compound,
which include the house now occupied by you, and should under no
circumstances be used as private nursing home for in-patients.
5- In consideration of the alteration of your conditions of service
referred to in this letter the Jewish Hospitals Committee shall be entitled
to deduct from the amounts due to be paid to you under the Contract
referred to above whether by way of salary, fees etc... the sum of I.D. one
hundred and fifty per annum. The latter amount shall be deducted monthly
at the rates of I.D. twelve and a half.
6- The alteration of the conditions of the Contract referred to
above as stated in this letter shall come into force from 9/12/1945.
It is being understood that all the other conditions of the Contract under
reference, in so far as they have not been amended by the provisions of
this letter, shall remain in force.
Please confirm your agreement to the contents of this letter in
writing.

Agreement is hereby made between Meir Moshi Dangoor in
his capacity as President of the Jewish Hospitals Committee
of Baghdad hereinafter called the First Party and Doctor Sofia
Tokar hereinafter called the Second Party whereby it has been
mutually agreed as follows:-

In this agreement the term "Hospital" means the Meir
Elias Hospital and the term "salary" means the monthly fixed
pay as prescribed in section 2 of this agreement.

1. The First Party undertakes to employ the Second Party as
a physician for women and children diseases in the Hospital for a
period of one year commencing on the first day of July 1940 and
ending on the last day of June 1941 . The First Party shall be
entitled notwithstanding anything herein to engage the services
of other doctors in the Hospital for children or for women
diseases or for both, whether in respect of out-patients or the
patients lying at the Hospital, on the terms and conditions he may
deem convenient in all respect at his absolute discretion.

2. The First Party undertakes to pay the Second Party a
fixed monthly salary of twenty eight Iraq Dinars during the whole
period of this Agreement payable at the end of every month.

3. The First Party undertakes to provide the Second Party
with free house at the hospital during the whole period of this
Agreement.

4. The First Party undertakes to pay to the Second Party
during the whole period of this Agreement at the end of every
week a percentage of the total fees collected by the Hospital
in connection with the medical works performed by the Second
Party at the Hospital as shown in sub-paras (a) and (b) herein-
below. The First Party further undertakes to pay to the Second
Party fixed fees in connection with the medical works to be
performed by the Second Party as shown in sub-para (c) herein-
after. It is being agreed upon that all such medical fees shall
be collected from the patients by the Hospital only and that

and that the Second Party shall not be entitled to collect
herself direct any fees for any medical work performed by her
within the Hospital. All such fees in so far as paras (a) and
(b) herein are concerned shall be fixed by the First Party from
time to time in consultation with the Second Party.
(a) fifty per cent of the total fees collected by the
Hospital from the paying out-patients who come to
the Hospital daily for examination by the Second
Party.
(b) twenty per cent of the total fees collected by the
Hospital for curetage made in the Hospital by the
Second Party to the paying patients.
(c) Five hundred fils for each accouchement carried out
at the Hospital in respect of first class paying
patients and two hundred and fity fils in respect of
second class paying patients. It is being understood
that these fixed fees shall cover all medical works
carried out by the Second Party in connection with
such accouchements or inherent thereto.

It is also being agreed upon that the
Second Party shall be personally present in all such
accouchements.
5. The First Party undertakes to grant to the Second
Party one month leave on full salary to be taken at the end of
this contract i.e. the Second Party undertakes to work in the
Hospital for a period of eleven months consecutively and to take
her
<del>this</del> leave at the end of that period.
6. The Second Party shall be entitled in case of illness
to sick leave for a period not exceeding one month on full
salary during the whole period of this agreement.
7. The Second Party undertakes to examine and treat free
of charge all the patients lying in the wards of women and
children diseases, whether paying or non-paying patients.

8. The Second Party undertakes to examine, free of
charge, all the poor outpatients of the Jewish Community who
come to the Hospital daily for medical examination.

9. The Second Party is entitled to pay medical visits
outside the Hospital within the municipal limits of Baghdad on
condition that the Hospital's ordinary work shall not suffer
or be affected in any way. All fees collected by the Second
Party from such visits remain in full with <del>him</del> her and she is
not obliged to give any account about them to the First Party.
The Second Party may, with the previous agreement of the First
Party, pay medical visits to patients outside the municipal
limits of Baghdad. The fees to be collected by the Second Party
for such visits shall be agreed upon between the two contracting
parties and shall be divided between them equally.

10. The Second Party undertakes not to open a private
clinic or to work in any other private clinic outside the
Hospital. The Second Party also undertakes not to treat
patients whether paying or poor in her private house.

11. The Second Party undertakes to comply with all
general administrative orders or instructions issued to the
medical staff by the First Party or by any person representing
him from time to time for the proper management of the
Hospital.

12. After the normal expiry of this agreement and if
not renewed the First Party undertakes to provide the Second
Party with a Second Class through passage from Baghdad to
Grodno in Poland on condition that the Second Party shall
leave the country within two months from the date of the
expiry of the contract.

13. The First Party shall have the right to cancel
this agreement without prior notice being given to the Second
Party and without any compensation whatsoever if the Second
Party becomes ill for a consecutive period of three months
provided that the First Party shall pay the Second Party during

the period of illness her salary for the period of the sick of
and ordinary leaves referred/in section 5 and 6 of this
Agreement only. It is being understood that the free passage
to which the Second Party is entitled under section 12 hereabove
shall be paid to her if she leaves the country within two months
of her recovery.

14. This Agreement shall be considered to have
automatically terminated and to have become null and void
without prior notice being given by either Party to the other
and without any compensation whatsoever if the Second Party
shall cease or shall be unable to work at the Hospital for
reasons beyond her control, other than illness, for a period
exceeding two months. The Second Party shall not be entitled to
receive any salary during that period but she shall be entitled
to her ordinary leave under section 5 hereabove, in proportion
to the period of her actual services at the Hospital.

15. If either of the contracting Parties does not
wish to renew this Agreement on its normal expiry, they should
notify each other in writing subject to a minimum of two months
before the expiry of this Agreement. In case no such notice whatso
ever will be given by either Party this Agreement will hold
good for an indefinite period provided that either Party shall
have the right of its termination at any time he desires after
its normal expiry by giving two months notice in writing.

16. If the Second Party fails to comply with the
terms of this Agreement or refuses to work without a legal
reason with the intention to annul this agreement she shall be
liable to pay a compensation of two hundred Iraq Dinars to the
First Party, but if the failure is on the part of the First
Party, the latter is bound also to pay to the Second Party an
amount of two hundred Iraq Dinars as compensation.

17. As both the contracting parties have willingly
come to this agreement under the above mentioned terms it was
duly signed by both parties, so that each may have a copy of

Dear Sir,

I am in receipt of the translation of the letter of the President
of the Meir Elias Hospital Committee dated the 12th instant in answer to ⟦my⟧
letter of the 9th instant.

In reply I beg to point out that in my letter of the 9th instant,
I have given the subject detailed and <del>un</del>exhaustible explanations from the
medical point of view. May I recapitulate the essential points as follows?

My examination of the patient would have only had sense if I
could have accommodated her suitably for confinement and in accordance with
my responsibility as a doctor. As such I only acted in the interests of
the health of the patient in telling her that there was no free place -
a consideration which is practicable in every health institution. Thereto
I would like to add quoting my previous letter: "The woman in question was
standing and talking quietly without any manifestation of pain". Nothing,
therefore, urged my examination.

To the remark of the President that the administration "should
prepare for necessary places", I would like to point out that at this ti⟦me⟧
nobody of the administration is present in the Hospital. Besides, as I ⟦ve⟧
already stated in my last letter, one patient was delivered a night before
in the corridor, a fact which proves that an appropriate place was not
provided for.

Finally I believe that the judgment of examining or admitting a
patient should be left to the discretion of the doctor.

As to the behaviour of midwife Naima, the unfounded and ill-
willed denouncement in this incident speaks for itself and shows that
smooth collaboration is not possible.

Dear Sirs,

We regret to state that in spite of many oral demands
we have not been paid again for almost four months. Therefore
we beg to ask you to pay us immediately the total sum of the
arrears.

Owing to the serious and deplorable events of which the
Committee is well aware we have to insist this time on full pay-
ment without any delay. We have to send to our nearest relations
regular financial supports for their living.

We are sure that the Committee will recognize the full
importance of our request.
