ج - اجور الاياب :
يستحق الدكتور سوكان اجور سفره
من بغداد الى برلين بالدرجة الثانية حسب المادة ١٢ من عقد
استخدامه . ان المومأ اليه طلب السفر بطريق الجو ولا مانع
من اجابة طلبه ان كانت اجور السفر بطريق الجو مساوية
او اقل منها في الدرجة الثانية . مع العلم ان اجور السفر بالدرجة
الثانية قدرها ١٠٤/- دنانير .

الموضوع : انهاء عقد استخدام الدكتورة توكار
بعد التحية
بالنظر لإنهاء عقد استخدام الدكتورة توكار في مستشفى مير الياس
بالنظر لاضطرارها الى مغادرة العراق ندرج ادناه المبالغ التي تستحقها
الدكتورة حتى نهاية شهر نيسان ٩٥٢ . سواء كانت تلك المبالغ
تستحقها عن الاجازات المتراكمة او من رواتبها المتراكمة .
١- الاجازات الاعتيادية
تستحق الدكتورة توكار بموجب المادة الخامسة من عقد
استخدامها المؤرخ في ٧ / ٢ / ٩٥١ مع مستشفى مير الياس شهر واحد
عن كل احدى عشر شهراً تقضيها في خدمة فعلية . ان هذه المادة وان
كانت لم تبين صراحة جواز تراكم الاجازة الا انها نصت في صدرها
على منح المديرة اليها بأجازة قدرها شهر واحد براتب كامل تمنح لها
عند نهاية عقد الاستخدام (وهو يتجدد سنوياً بصورة دورية) الا
ان هذه المادة ساكتة عن الراتب الاساسي الذي تحتسب بموجبه
الاجازات المتراكمة . وحيث ان هذه المادة نصت صراحة بمنح
المديرة اليها بأجازة قدرها شهر واحد عن كل احدى عشر شهراً تقضيها
في خدمة فعلية لذا اصبح من الواجب حساب تلك الاجازة على
اساس معدل الراتب الشهري للسنة التي تعود الاجازة اليها
وعليه ندرج ادناه اجازات المديرة اليها المتراكمة مبيناً في سطرها
على بيان ما يعادلها من الراتب .

jaundiced, rather severly, sneezing and got Cyanosed.
So, this case applies with para C of the decision
mentioned in your above letter and you were responsible
to look after this severe patient, and you are not entitled
to charge any consultation fee.

I remember that at 3.45 am on the
morning of the 11th inst, I was called to see
a baby in the maternity, room 11 (nursery)
The baby was jaundiced, rather severely
I found that the baby was well looked after +
there was not much to be added to the treatment
initiated by Dr Tokar.
The baby was sneezing + thought
chest was clear, I advised penicillin as
a prophylactic measure. The mother was

till Dr Tokar sees the baby in the
morning. I replied that there was
no immediate need for the penicillin
and there will be no harm in waiting
for few hours.
With the sneezing there was, I thought,
a suggestion of Cyanosis. I therefore asked
the sister in charge to get Oxygen ready
for any emergency.
Just I reached back to my room
a nurse again came to me + said that the
baby appeared to be getting cyanosed. I told
her to administer the Oxygen at once +
to continue to give it as needed.
I heard nothing further about the case
that night.

Decision No.4 taken in the
Committee's Meeting held on 22/5/46
It has been found necessary to fix the fees accuring to the
Doctor for medical consultations, and after discussion, the following
decisions were taken.
a- If the treating doctor, of his own will, calls upon one of the
Specialist Doctors of the Hospital duting office hoursx, to examine
a patient without the knowledge or the request of the latter; then
the usual procedures is that no fees accure (to the specialist) as
he was called in by the treating doctor.
b- If, however, the Specialist Doctor is called in ⟦at⟧ the request
of the patient, a fee of I.D.1/-- is payable for the consultation, to
be shared equally between the Specialist Doctor and the Hospital, if
the <del>the</del> consultation is during office hours.
If after office hours, the Specialist Doctor may retain the
fee completely and it should not exceed I.D. 2/--
c- In the latter event, i.e. ⟦in⟧ a consultation after office hours,
the treating doctor cannot claim a consultation fee, as he is the
doctor responsible for that particular patient.
d- In addition, if any exceptional cases occur, for example, the
patient requesting the treating doctor to call upon him at different
times outside of office hours, the Hospital has no objection to such
visits, and the agreement is to be concluded between doctor and patient
only, without the Hospital being in any way concerned with such visits.
