There are letters about the Jewish Hospitals, the rules of the Burial Society, and accounting rules of the Jewish community. There are also four booklets: 2 in Judeo-Arabic printed by Elias Shoḥeṭ for the Burial Society, printed in 5690 (1929 or 1930); 2 are in Arabic printed in 5709 (1948 or 1979) and 5708 (1947 or 1948). This item also includes documents concerning the foundation of the organization, a newspaper article about a dispute within the Baghdadi Jewish community, and the minutes from several meetings.

With reference to our letter No. 3278 dated 10 July 935
Upon auditing the status of the swamp named Bustan Qaddouri, it was found:
1- That according to the Tabu deed dated March 1926, sequence 59, the mentioned orchard
considering 320 shares, of which 310 are endowed to be a cemetery for the Israelite dead, and 6
shares to Yusuf bin Manshi Yusuf Sadqa, deceased, and 32 shares to Simha bint Moshi
Yusuf Sadqa, and 14 shares to Harun bin Manshi, and their location is unknown to us. And
the trustee over the endowed shares is the head of the Israelite community. It is thus evident
clearly that we have no connection to (110) shares of the mentioned property.
2- That the endowed shares of the mentioned property are not legally considered owned by the community, and that the head of
the community has the right of trusteeship over them only. The trustee in this case has the right to manage the endowment, and is not
obligated to spend on the development and management of the endowment except from what comes from the endowment's own yield. Since
the mentioned swamp does not yield any income, it was found upon auditing the case that it is not within the power of
the trustee to obtain the necessary funds for its development and the filling of its swamps, nor is he obligated
to bear these expenses personally.
3- Since the land under discussion is used as a cemetery for a significant number of the people of
Baghdad, it appeared to us that the filling of the swamps located therein, if they are harmful to public health,
falls to your respected department according to its jurisdiction. With further respect to Your Excellency.

As you know, the swamp under discussion has become a source of danger threatening public health, in addition
to being surrounded by inhabited buildings and located near places of public interest; therefore,
filling it has become of great importance. On this occasion, we would like to draw your attention to your letter No.
3278 dated July 10, 935, in which you state that you have issued instructions to bury this swamp,
while you now return and try to evade doing so under a pretext that has no basis in
reality, something we did not hope to receive from the Community Council—that council which should
treat such work with the care and attention it deserves. Furthermore, we do not believe that your guardianship over
the lands where that swamp is located is limited to managing and benefiting from them only, without bearing
the requirements of their development and the removal of the danger resulting from them. Therefore, as the remaining of the mentioned swamp
is a cause of harm to public safety, and leaving it as it is does not align with the plan the government has resolved
to follow in eliminating the swamps surrounding the capital entirely, we avoid resorting
to the use of the direct procedures authorized to us by law, which do not suit the moral status of the Community
Council, as we would with other individuals. We hope, finally, that you will do what is necessary to bury it during
the necessary period;

filling it has become of great importance. On this occasion, we would like to draw your attention to your letter number
3278 dated July 10, 935, in which you state that you have instructed the filling of this swamp,
while you now return and attempt to evade doing so under a pretext that has no basis in
reality, something we did not expect to receive from the Community Council—that council which should
give such work the care and attention it deserves. Furthermore, we do not believe that your guardianship over
the lands where that swamp is located is limited to managing and benefiting from them only, without bearing
what is required for their improvement and the removal of the danger arising from them. Therefore, since the persistence of the mentioned swamp
causes harm to public safety, and since leaving it as is does not align with the plan the government has decided
to adopt in eliminating the swamps surrounding the capital entirely, we wish to avoid resorting
to the use of the direct measures authorized by law, which would not be appropriate for the moral standing of the Community

Greetings and Respect,
I wish to draw your attention to the violations you have committed during the period of your work in our association and the actions
you have taken in violation of the bylaws, which have become intolerable to remain silent about due to their impact on the progress of the association's work
as it should be. Therefore, I find myself faced with a fait accompli to remind you of a brief summary of the violations and behaviors harmful to the interest
of the association, as follows: -
First - It is strange that while the association accepted your assistance in place of your father, who is officially a member, you
intervened in many matters, including making yourself Vice President, contrary to the method outlined in the association's bylaws.
See Article ⟦ ⟧ of the bylaws.
Second - You have exceeded the limits of your position by interfering in the secretarial matters with which I am entrusted. See
Article 6 of the bylaws.
Third - You have executed lease contracts for the association's real estate without my knowledge and without the association's knowledge.
Fourth - Since Article 9, paragraph (c) of the association's bylaws requires the association to decide on the necessity of
expenditure and then spend it; contrary to this method, you spent sums from the association's fund, and when the matter became clear, you organized
a decision for the actual expenditure and requested a signature on it while I refused to sign.
Fifth - While you and I bargained for the sale of the car belonging to the association according to the association's decision and concluded
the sale and purchase without an intermediary (broker), and after we received the sale price, you fabricated the existence of an intermediary, who is your cousin employed at
the company's premises. Upon your insistence and plea, the association was forced, out of concern for the safety of its affairs, to pay one and a half
percent to this person who was not a broker and was in Basra at the time.
These actions and others we do not wish to mention in this haste demonstrate your breach of the association's bylaws
and your lack of concern for its interests. We have suspended proceedings until the return of the association's president, who is outside Iraq, and we have sent
this letter to you to state the facts until you withdraw from the association, as its bylaws do not qualify you to continue
its work. Otherwise, I will be forced to report the matter to the venerable Ministry of Interior. I request that you hand over the papers
and books belonging to the association that are in your possession to the specialized clerk as soon as possible to be kept at the association's headquarters
according to the rules. With my utmost thanks and respect, sir.

1 - This regulation is called the Internal Regulation of the Hebra Qadisha Association
2 - This association consists of seven persons: one of whom is the President (Rabbi), the second is the Vice President, the third
is the Treasurer, the fourth is the Secretary, and three members
3 - The President has the authority to sign letters, telegrams, etc., and he is the reference for all communications and transactions of this
association. He shall not sign any paper before stamping it with the association's seal, and this seal is kept with the association's secretary
4 - In the absence of the President, the Vice President shall act in his place, and in the absence of both the President and the Vice President, the Secretary shall act in their place
5 - This association meets at its headquarters in Midrash Beit Zilkha once every week, and when necessary, it meets
by invitation from the presidency in an extraordinary manner
6 - The Secretary must organize a minute book for decisions and ledgers for revenues and expenditures, and organize a schedule containing the revenues
and expenditures of this association and announce it to the public from time to time
7 - In the event of the resignation of the President or some members of this association, those who will take their place shall be elected by this
association and the Israeli Spiritual Council jointly
8 - The President and the Treasurer must:
a - Always keep one hundred rupees in the association's fund for spending when necessary
b - Deposit the revenues of this association in one of the banks in its name
c - Withdraw what is required from the banks from the revenues of this association with the signature of the President (or whoever acts in his place
according to this regulation) and the Treasurer after a decision is made regarding the necessity of spending it
d - Document expenditures with a receipt, and in the absence of a receipt, the amount is considered unspent, and the President and the Treasurer
shall be held responsible for it individually and jointly
9 - The association performs the following tasks:
a - Preparing and providing the necessary supplies for washing, shrouding, and burial for the deceased of the Mosaic community
b - Organizing and improving the procedures adopted for this purpose and its branches
c - Arranging and appointing the staff for washing, preparation, and burial, and allocating their wages
d - Purchasing the necessary movable and immovable property and maintaining it to improve, achieve, and complete
this project
10 - The management of this association is entrusted with collecting subscriptions, aid, and donations from generous people
11 - The receipts of this association shall be against a receipt signed by the President and stamped with the association's seal
12 - The supplies required for this purpose are purchased by the association after a decision is issued regarding their necessity and are kept in
a special place under the disposal of the president of this association
13 - The association must replace and change its workers when necessary
14 - Decisions that are not signed by the majority of the opinions of this association have no value
15 - The Spiritual Council has the right to monitor the work and management of the association from time to time. Baghdad.

employed at the police station. Upon your persistence and insistence, the association was forced, for the sake of the safety of our affairs, to pay
one and a half percent to this person who was not a broker and was in Basra at that time.
These actions and others we do not wish to mention in this brief summary demonstrate your violation of the association's bylaws
and your lack of care for its interests. We have suspended the procedures according to the head of the association, who is outside Iraq, and we have sent

have overstepped in many matters, including making yourself a vice president contrary to the method outlined by the association's bylaws.

Second - You have exceeded the limits of your position by interfering in secretarial matters with which I am charged. See
Article 6 of the bylaws.
Third - You have executed lease contracts for the association's properties without the knowledge and awareness of the association.
Fourth - Since Article 9, paragraph (b) of the association's bylaws mandates that the association must decide on the necessity of
expenditure and then spend it, contrary to this method, you spent sums from the association's fund. When the matter became clear, there was no
decision for the actual expenditure, and you requested a signature on it while I refused to sign.
Fifth - When you and I agreed on selling the car belonging to the association according to the association's decision ⟦and when⟧
selling and buying without a broker, and after we received the sale price, you fabricated the existence of a broker, who is your cousin employed at
the company's premises. Upon your insistence and plea, the association was forced, for the sake of the safety of its affairs, to pay one and a half
percent to this person who was not a broker and was at that time in Basra.
These actions and others we do not wish to mention in this haste demonstrate your violation of the association's bylaws
and your lack of concern for its interests. We have suspended procedures pending the arrival of the association's president, who is outside Iraq, and we have sent
this letter to you to state the facts until you withdraw from the association, as its bylaws do not qualify you to continue
its work. Otherwise, I will be forced to inform the esteemed Ministry of Interior of the situation. I request the handing over of the papers
and ledgers belonging to the association in your possession to the specialized clerk as soon as possible to be kept at the association's headquarters
according to the rules. With much gratitude and respect, sir.

1 - This regulation is called the Internal Regulation of the Hebra Qadisha Association
2 - This association consists of seven persons: one of them is the President, Rabbi Zalkhani is the Vice President, the third is
the Treasurer, the fourth is the Secretary, and three members.
3 - The President has the authority to sign letters, telegrams, and others, and he is the reference for all communications and transactions of this
association. He shall not sign any paper before stamping it with the association's seal, and this seal is kept with the association's secretary.
4 - In the absence of the President, the Vice President shall act in his place, and in the absence of both the President and the Vice President, the Secretary shall act
in their place.
5 - This association meets at our center in Midrash Beit Zilkha once every week, and when necessary, it meets
by invitation from the presidency in an extraordinary manner.
6 - The Secretary must organize a book for decisions and books for revenues and expenses, and organize a table containing the revenues
and expenses for this association and announce it to the public from time to time.
7 - Upon the resignation of the President or some members of this association, those required to replace them shall be elected by this
association and the Israeli Spiritual Council jointly.
8 - The President and the Treasurer must:
a - Always keep one hundred rupees in the association's safe for spending when necessary.
b - Deposit the revenues of this association in one of the banks in its name.
c - Withdraw what is required from the banks from the revenues of this association with the signature of the President or whoever acts
in his place according to this regulation and the Treasurer after a decision is made on the necessity of spending it.
d - Documenting wills with a receipt, and when a receipt exists, the ⟦...⟧ on its back shall be considered, and the President
and the Treasurer shall be responsible for it individually and jointly.
9 - The association performs the tasks we mentioned:
a - Preparing and providing the necessary supplies for washing, shrouding, burial, and ⟦...⟧ of the deceased of the Mosaic
community.
b - Maintaining and improving the principles adopted for this purpose and its branches.
c - Organizing and appointing a staff for washing, preparation, and burial, and allocating their wages to them.
d - Purchasing necessary movable and immovable property and renovating it to improve, achieve,
and complete this project.
10 - The management of this association is dependent on collecting subscriptions, aid, and donations from generous people.
11 - The receipts of this association shall be against a receipt signed by the President and stamped with the association's seal.
12 - The necessary supplies for this purpose are purchased by the association after a decision is issued on their necessity and are kept
in a special place under the disposal of the president of this association.
13 - The association must undertake to even feed its workers when necessary.
14 - Decisions that are not signed by the majority of the opinions of this association have no value.
15 - The Spiritual Council has the right to monitor the communication and management of the association from time to time in Baghdad.

Regarding the application of Article 29 of the Community Bylaws
and the status of the Hebra Qadisha Society.
His Eminence, President of the Respected Hebra Qadisha Society
Baghdad
Greetings and respect. It is not hidden from you that Article 29 (b) of the Jewish Community Bylaws No. 36 of 1931
states the following:
"To carry out the matters of preparation, shrouding, and burial, a committee shall be appointed consisting of a chairman from the members of the Spiritual Council and six
lay members, three of whom are elected by the Council and the other two by the Lay Council, and it shall operate under the supervision of
the Spiritual Council."
Upon considering the matter of applying this article, the Lay Council found that your respected society has carried out some of
the matters specified therein, according to what is stated in your society's bylaws. In order to harmonize the status of your society
with the legal text mentioned above, the Lay Council had formed a subcommittee to study the subject from its legal aspect.
After the study, it was of the opinion that it is possible to harmonize the status of your society with the legal text if
your society amends its internal bylaws in the following manner:
First - Repealing Article Two of the society's bylaws and replacing it with the following:
(This society shall consist of seven persons in accordance with the second paragraph of Article twenty-nine
of the Jewish Community Bylaws No. 36 of 1931, namely a chairman from the members of the Spiritual Council and six
lay members, three of whom are elected by the Spiritual Council and the other two by the Lay Council, and it shall operate
under the supervision of the Spiritual Council. There shall be among the members a vice-president, a treasurer, and a secretary elected by
the members of the society by a majority of votes.)
Second - Repealing Article Six of the society's bylaws and replacing it with the following:
(This society shall be considered the committee intended in the second paragraph of Article 29 of the Jewish Community Bylaws
No. 36 of 1931, and it shall follow the provisions of the Jewish Community Law and the regulations issued pursuant to it regarding it.)
If your respected society carries out the aforementioned amendment, the society will remain as it is
and at the same time, Article 29 of the effective bylaws will be applied.
Accordingly, the Lay Council requests that the aforementioned proposal be presented to the members of your society to consider
completing the required amendment to your society's internal bylaws and informing us of the result. The Council will set a date
for deliberation with your society's body as soon as possible and will inform you of the appointed time.

With reference to your letter No. 3551 dated March 10, 946
We have studied the issue of applying Article twenty-nine of the Jewish Community Statute No. 36 of the year
1931 in light of its provisions and the status of the Hebra Qaddisha Society, and we found the following:-
That the Hebra Qaddisha Society was formed in accordance with the Law of Associations No. 45 of 1922, and that
Article two of its internal bylaws stipulated that (this society consists of seven persons:
one of whom is the President, a Rabbi; the second is a Vice President; the third is a Treasurer; the fourth is a Secretary; and three members)
And according to this article, the society was formed of the following named individuals:
President - Rabbi Salman Hoki
Vice President - Salman Heskel Meir
Treasurer - Shaul Abdullah Nawi
Secretary - Ezra Salman Nissan
Members - Shaul Ibrahim
Yosef Heskel Sahayek
Daoud Heskel Loya
Due to the advanced age of the Treasurer and his retirement from work, his son Mr. Sassoon
Shaul Nawi was recently appointed in his place, and the lawyer Heskel Salman Meir performs the duties of his father, the Vice President.
Article seven of the society's bylaws stipulates that (upon the resignation of the President or some
members of this society, their successors shall be elected by this society and the Jewish Spiritual Council
jointly.)
And this society, in its capacity as a legal entity according to the law, has the right to own real
estate for its purposes, and it has indeed owned several properties and registered some of them directly in its name, i.e., in the name of the "Hebra
Qaddisha Society of the Mosaic Community in Baghdad," and the other part is endowed to it and for its purposes and has been registered in the Tabu in the name of
"Endowment of the Hebra Qaddisha Society Endowments." It is not hidden that the society may dispose of the properties registered in its name,
but it may not change anything ⟦illegible⟧ of the conditions of the endowed properties, as the text of the endower is like the text of the Legislator. Therefore, even if
it is the intention of the Lay Council to appoint the same members of the society to carry out what is required in Article 29 (b) of
the Statute, it is not correct to abolish the name of the society. Therefore, the status of the society must be harmonized with Article 29 (b)
of the Jewish Community Statute No. 36 of 1931, which stipulates the following:
"To carry out the matters of preparation, shrouding, and burial, a committee shall be appointed consisting of a president from the members of the Spiritual Council
and six members from the laity, three of whom are elected by the Council and the other three by the Lay Council, and it shall operate under
the supervision of the Spiritual Council."
