These are archival documents from the Baghdadi Jewish community. Included are correspondence from the Burial Society (Ḥevrah Ḳadishah), the Lay Council, the President of the Jewish Community, the Spiritual Council, and the Chief Rabbi. There are letters about the Jewish Hospitals, the rules of the Burial Society, and accounting rules of the Jewish community. There are also four booklets: 2 in Judeo-Arabic printed by Elias Shoḥeṭ for the Burial Society, printed in 5690 (1929 or 1930); 2 are in Arabic printed in 5709 (1948 or 1979) and 5708 (1947 or 1948). Regarding the application of Article 29b of the Community Regulations
and the status of the Hebra Kadisha Association.
The Honorable President of the Hebra Kadisha Association
Baghdad
Greetings and respect, it is not hidden from you that Article 29b of the Jewish Community Regulations No. 36 of the year 931
stipulates the following:
"To carry out the matters of preparation, shrouding, and burial, a committee shall be appointed consisting of a chairman from the members of the Spiritual Council and six
lay members, three of whom are elected by the [Spiritual] Council and the other three by the Lay Council, and it shall operate under the supervision of
the Spiritual Council."
Upon considering the matter of applying this article, the Lay Council found that your esteemed association has carried out some of
the matters specified therein according to what is stated in your association's regulations, and in order to enable the reconciliation between your association's status
and the aforementioned legal text, the Lay Council had formed a subcommittee to study the subject from its legal perspective.
After study, it was suggested that it is possible to reconcile your association's status and the legal text if
your association amends its bylaws in the following manner:
First - Cancellation of Article 2 of the association's regulations and replacing it with the following:
(This association is composed of seven persons according to the second paragraph of Article twenty-nine
of the Jewish Community Regulations No. 36 of the year 931, namely a chairman from the members of the Spiritual Council and six
lay members, three of whom are elected by the Spiritual Council and the other three by the Lay Council, and it shall operate
under the supervision of the Spiritual Council. There shall be among the members a vice-president, a treasurer, and a secretary elected by
the members of the association by majority vote.)
Second - Cancellation of Article 6 of the association's regulations and replacing it with the following:
(This association is considered the committee intended in the second paragraph of Article 29 of the Jewish Community Regulations
No. 36 of the year 931 and follows the provisions of the Jewish Community Law and the regulations issued pursuant to it regarding it.)
If your esteemed association carries out the aforementioned amendment, the association will remain as it is
and at the same time, the application of Article 29 of the regulations will be in effect.
Therefore, the Lay Council requests to present the aforementioned proposal to the members of your association to consider
completing the required amendment in your association's bylaws and informing us of the result. The Council will set a date
for deliberation with your association's body at the earliest time and will inform you of the appointed date.

After studying the case from a legal perspective, we believe that it is possible to reconcile the status of the association
with the legal text if the association amends its internal bylaws in the following manner:
First - Repealing Article 2 of the association's bylaws and replacing it with the following:
"This association consists of seven persons in accordance with the second paragraph of Article twenty-nine
of the ⟦Bylaws⟧ of the Jewish community No. 36 of 1931, consisting of a chairman from among the members
of the Spiritual Council and six lay members, three of whom are elected by the Spiritual Council and the other three
by the Secular Council, and it operates under the supervision of the Spiritual Council. Among the members shall be a vice president,
a treasurer, and a secretary elected by the members of the association by a majority of votes."
Second - Repealing Article 7 of the association's bylaws and replacing it with the following:
"This association is considered the committee intended in the second paragraph of Article 29 of the Bylaws of the Jewish
Community No. 36 of 1931, and it follows the provisions of the Jewish Community Law and the regulations issued thereunder
concerning it."
If the association carries out the aforementioned amendment, the association will remain as it is and at the same
time the wording of Article 29 of the Bylaws will be in effect.

Minutes of the extraordinary meeting of July 25, 946
The Hebra Qadisha Society met under the chairmanship of His Eminence Rabbi Salman Hoke Aboudi and the members Messrs. Heskel
Salman Meir, Ezra Salman Nissan, Sasson Shaul Nawi, Joseph Heskel Ishaq, and Dawood Heskel Alweiseh
and Shaul Ibrahim Hayawan at the headquarters of the Presidency of the Jewish Community at six o'clock on Thursday evening,
corresponding to July 25, 946. After deliberation with His Excellency the Head of the Community and the Lay Council, which held a session
at the same time, the Society decided to amend its internal bylaws as follows:-
First - Cancellation of Article 2 of the Society's bylaws and replacing it with the following:-
"This Society shall be composed of seven persons in accordance with the second paragraph of Article 29
of the Jewish Community Regulation No. 36 of 1931, consisting of a chairman from the members of the Spiritual Council and six
lay members, three of whom are elected by the Spiritual Council and the other three by the Lay Council, and it shall operate
under the supervision of the Spiritual Council. Among the members shall be a vice president, a treasurer, and a secretary elected by
the members of the Society by a majority of votes."
Second - Cancellation of Article 7 of the Society's bylaws and replacing it with the following:-
"Upon the resignation of the president or one of the members of the Society and in other circumstances, a replacement shall be elected
by the Spiritual Council or the Lay Council, as the case may be, in accordance with the amended Article 2
of these bylaws, and the appointment of the new member shall be after consulting the Society."
The Society has decided to notify the Ministries of Social Affairs and Interior of these amendments to its bylaws,
as well as the Presidency of the Community, the Spiritual Council, and the Lay Council. In approval thereof, this resolution was signed.

In view of my knowledge of the sympathy and zeal you carry within you for

In accordance with Article 29 (b) of the Jewish Community Bylaw No. 36 of 1931
and the amended Article 2 of the Internal Bylaws of the Hevra Kadisha Society pursuant to the
Society's letter addressed to your esteemed Ministry on July 28, 946, the
Lay and Spiritual Councils met at the headquarters of the Jewish Community Presidency in Baghdad on
August 19, 946, for the purpose of electing the members of the Hevra Kadisha Society, and the election results
resulted in the selection of His Eminence Rabbi Salman Hoqi Aboudi as President, and the following members: Messrs. Sasson
Shaul Nawi, Heskel Salman Mushir, Rabbi Yosef Ishaq, Salman Daoud Sumerly,
Ezra Salman Nissan, and Shail Ibrahim Haywan as members of the aforementioned society, according to
the minutes of the meeting, a copy of which is attached herewith. This society shall act in place of the committee
stipulated in Article 29 (b) of the Community Bylaw referred to above.
I am honored to submit this letter of mine to inform Your Excellency of this, and please Your Excellency
accept the assurance of my highest respect.

August 19, 946 for the election of the Hevra
Kadisha Society
1 - The Spiritual and Temporal Councils met under the chairmanship of His Eminence the Head of the Community, Rabbi Sassoon Khedhouri
And in the presence of Their Eminences Rabbi Raphael Isaac Hayyim, Rabbi Salman Huqi Aboudi, Rabbi
Sassoon Isaac, Rabbi Daoud Ezra Musfi, Rabbi Eliya Yehoshua, Rabbi Yehoshua Moshi Hezekiel
And Rabbi Joseph Rabi', Rabbi Daoud Shaul, and members of the Temporal Council, Messrs. Eliyahu Hayyim Tawfiq
And Moshi Daoud Shohet, R. Shaul Basri, Sion Shohet Giji, Kurji Yaqoub Matalon, and Sassoon Aboudi
Bashi. The two councils decided to choose His Eminence Rabbi Salman Huqi Aboudi as President of the Hevra
Kadisha Society Committee in accordance with Article Twenty-Nine, Paragraph Two of the Jewish Community Regulation No. 31 of the year
936. Then the Spiritual Council decided to elect Messrs. Sassoon Shaul Nawi, Hezekiel Salman Meir, and Rabbi
Joseph Hezekiel Isaac. The Temporal Council also decided to choose Messrs. Salman Daoud Samerli, Ezra
Salman Nissan, and Shaul Ibrahim Haywan to be the committee for the aforementioned society in accordance with the same article. This
minute was organized as an acknowledgment of that.

Greetings and respect,
We wish to inform Your Excellency that our association (Hevra Kadisha Association), authorized by your esteemed ministry
pursuant to its order issued on February 7, 1929, No. (2075), held an extraordinary meeting
on July 25, 946 (enclosed is a copy of the meeting minutes) and unanimously decided to approve the amendment of its internal
bylaws to align with Article 29 of the Communal Regulation No. 36 of 1931, as follows:
First - Repealing Article Two of the Association's bylaws and replacing it with the following:
"This association shall be composed of seven persons in accordance with the second paragraph of Article 29 of the
Jewish Communal Regulation No. 36 of 1931, consisting of a president from the members of the Spiritual Council
and six general members, three of whom are elected by the Spiritual Council and the other three by the
Lay Council. It shall operate under the supervision of the Spiritual Council. Among the members shall be a Vice President,
a Treasurer, and a Secretary, elected by the members of the association by majority vote."
Second - Repealing Article Seven of the Association's bylaws and replacing it with the following:
"Upon the resignation of the President or one of the members of the association, or in other cases, a
replacement shall be elected by the Spiritual Council or the Lay Council as the case may require
in accordance with the amended Article Two of these bylaws. The election of the new member shall be conducted after
consulting the association."
