1- Pursuant to the provisions of the second clause of the commitment contract dated 1/28/1961, certified by the Notary Public of North Baghdad under general number (1533), in view of the completion of the construction of the building subject to the aforementioned commitment, it has been handed over to the contractor Mr. Hashim Al-Sayyid Saeed Al-Musawi, who in turn acknowledges receiving it in full and approved it on today's date, Friday, May 5, 1961.
2- Accordingly, May 5, 1961, is considered the beginning of the commitment stipulated in the aforementioned second clause.
3- Pursuant to the provisions of the fifth clause of the aforementioned contract, the contractor Mr. Hashim Al-Sayyid Saeed Al-Musawi has handed over to the Waqf trustee Mr. Salman Daniel, Chairman of the Administrative Committee for Iraqi Jews in his official capacity, five promissory notes to his order dated May 5, 1961, each valued at (2125) Dinars (two thousand one hundred and twenty-five Dinars), due for payment after 6, 12, 18, 24, and 30 months respectively, and Mr. Salman Daniel acknowledges receipt of them.

11- The First Party has the right to use the door and stairs of the building subject to the obligation and open doors from it for the apartments he constructs on
the adjacent property currently used as headquarters for the presidency of the Mosaic Community, and the Second Party may not object to
that, as these apartments do not at all fall within the building subject to this contract and its provisions do not include them.
12- a- Upon the expiration of the <del>⟦illegible⟧</del> contract period, the contractor must hand over the building subject to the obligation with all its floors and contents
free of occupants and in a sound condition regarding the doors and their locks, windows, glass, electrical installations,
water, sanitary, and the described tiles, and he must compensate the First Party for any damage, deficiency, or destruction
therein.
b- If the contractor delays in handing over the building free of occupants and in sound condition upon the expiration of the contract period,
he shall pay damages amounting to twenty-five dinars daily for each day of delay from the date of the contract expiration until the date
of actual evacuation without the need for a formal notice.
13- If the contractor violates any condition of the terms of this contract, he shall be liable to pay compensation amounting to (1000) one thousand dinars
without the need to issue a formal notice, and the First Party has the right to terminate the contract in this case.
14- If the First Party refuses to hand over the building subject to the obligation to the Second Party upon its completion, he shall be liable
to pay monetary damages amounting to (1000) one thousand dinars in addition to the necessity of returning the securities mentioned in clause
four.
15- The contractor acknowledges that he has waived the right to request an oath from the First Party regarding false admission and other oaths
related to this contract.

Commitment Contract
First Party (Endowment Trustee) Mr. Salman Daniel - Chairman of the Administrative Committee of the Mosaic Community, the Trustee of
the ⟦endowments⟧ of the aforementioned community in addition to his position
Second Party (The Contractor) Mr. Hashem Al-Sayyid Saeed Al-Musawi.
Contract Terms
The two contracting parties agreed on the following terms:-
1- The Second Party has contracted from the First Party the newly constructed building on the two properties Tapu sequence 137 and
138 and door numbers 148 and 113/150 located in the Qanbar Ali neighborhood.
2- The duration of the commitment is three years starting from the date of delivery of the building - referred to in the first clause above and whose
descriptions and contents are detailed in the third clause below - provided that the delivery date is determined by a ⟦report⟧ signed by
the two contracting parties, which shall be considered an annex to this contract.
3- The building subject of this contract consists of three floors as follows:-
a - The ground floor - which is a market with (12) shops plus a small shop adjacent to the building door.
b - The first floor - which consists of (17) rooms.
c - The second floor - which consists of (17) rooms.
4- The Second Party shall deliver to the First Party upon signing this contract an amount of (1000/-) one thousand dinars
to remain with the First Party as security, provided it is deducted from the last installment of the commitment fee.
5- The commitment fee for the three-year period shall be (12750/-) twelve thousand seven hundred and fifty dinars
to be paid by the Second Party in six installments, each amounting to 2125/- dinars, provided that the first installment is paid in cash
upon delivery of the building, the second installment by a promissory note due after six months, the third installment by a promissory note
due after one year, the fourth installment by a promissory note due after eighteen months, the fifth installment by a
promissory note due after twenty-four months, and the sixth installment by a promissory note due after thirty months
from the date of delivery of the building. Since the delivery date occurs after the date of concluding this contract, and for the purpose of securing the five
installments by the aforementioned promissory notes, the Second Party has pledged to sign the five promissory notes in the amount of
2125/- dinars each to the order of the First Party and deliver them to him upon the delivery of the building to the Second
Party.
6- If the contractor delays in paying any of the installments due at its time, he shall be liable for paying compensation in the amount of
ten dinars per day from the date of its maturity until the date of payment, in addition to the rent, without the need
to issue a formal notice, and the First Party has the right to terminate the contract in this case.
7- The contractor has the right to exploit the building subject of the commitment by leasing its contents under the following conditions:-
a - That the lease period does not exceed the commitment period of three years.
b - That his contract with others be in addition to this contract and that this be mentioned in all contracts
concluded with the tenants.
c - That he leases the ground floor as warehouses or shops for wholesale or retail commercial sale, and he has no right to lease them
to be occupied as blacksmith shops and the like. And that he leases the first and second floors to be occupied
as offices and the like.
8- The contractor may partition some shops and rooms or merge them at his own expense without referring the cost to the First Party,
provided that he obtains the approval of the First Party in advance.
9- The contractor shall be responsible for the maintenance and renovation of the building subject of the commitment during the contract period without any recourse to the First
Party for what he spends in this regard, and he has no right to remove any repairs he may add to the building upon
the end of the contract.
10- a - Only the real estate tax shall be on the First Party, and other taxes, fees, and charges such as water and
electricity fees, sewage, security, cleaning, and municipal fees shall be on the contractor.
b - Upon the end of the contract period, the contractor must deliver to the First Party all receipts proving the payment of all
fees and charges mentioned in paragraph (a) above.
