The honorable Sharia Council convened on 20/5/43 under Judge Mr. Mahmoud Izzat
and issued the following decision:-
The Endower - Khatoun Youssef Masri
Based on the verified excuse, I attended the house of Khatoun daughter of Youssef Masri located in the neighborhood
of Al-Bataween at four o'clock in the afternoon, accompanied by the clerk Muhammad Said
and the process server Abbas, in order to take the confession of Khatoun daughter of Youssef Masri regarding the endowment of plot (3)
numbered sequences 7/9, 8/9, and 9/9. Accordingly, Khatoun Youssef Masri attended the council and after
her identification by the identification witnesses, who are the lawyer Salman Sheina, Haroun Ibrahim Ovadia, and Hamid
son of Kadhim, the Mukhtar of Al-Bataween neighborhood, the aforementioned Khatoun stated, while in full possession of her mental faculties and maturity, that she owns
the plot of land numbered 3, sequence numbers 7/9, 8/9, and 9/9 located in Al-Bataween neighborhood,
on part of which a two-story building is constructed for use as a synagogue, i.e., a Torah, by
worshipers of the Israelite community, while the other part of the land is still vacant without construction.
She has endowed the aforementioned land with the buildings established upon it as a perpetual, eternal endowment under the following conditions:-
First - That the aforementioned synagogue be named after her late husband Meir Ibrahim Tweig, provided that this
name does not change.
Second - That the aforementioned synagogue be used by Israelite worshipers in the manner and method
followed in Iraq.
Third - That Mr. Daoud Ishaq Tawfiq, of Iraqi nationality and residing in Baghdad, shall be the trustee
over the aforementioned synagogue for his lifetime, and he has the absolute right to supervise the synagogue from both
administrative and religious perspectives, as he is authorized to form a committee to carry out administrative work under his chairmanship
or supervision, and he may replace committee members from time to time according to his opinion or dissolve the committee,
and the administration remains without any person or any official in the community having the right to interfere
in the affairs of the synagogue, and that the following procedures be observed:-
A - All revenues obtained from donations of worshipers and others, including subscriptions
and others that are paid in any form whatsoever.
B - Appointing employees and servants with the salary he designates, dismissing them, and appointing others.
C - Spending the necessary expenses for construction, renovation, purchasing furniture, and others.
D - That the aforementioned Mr. Daoud shall be the trustee for his lifetime, and after him, the trusteeship passes to
his male children, then to his grandsons and his grandsons' grandsons, generation after generation, provided that
the trusteeship is assigned to the eldest and most rational among them, and then to any male of his offspring, and upon their extinction,
the trusteeship shall be given to the head of the Spiritual Council of the Israelite community.

Fourth - As for the land vacant of construction, I have agreed and permitted that a school be established on it and
that Mr. Selim Daoud Isaac Tawfiq be the trustee over it under the following conditions:-
A - That the aforementioned school be established from donations or any other source in the opinion of the trustee, Mr.
Selim mentioned above, and that the construction be of the area, amount, engineering, and form that
he deems appropriate in his absolute opinion.
B - That the school be used for the purpose of teaching and receiving religious sciences by the children of
the Israelite community in Iraq in the manner and principles that the trustee deems appropriate, provided that
the laws established by the Iraqi government are observed in this regard.
C - That among the lessons taught in the aforementioned school shall be the study of the Torah -
at least six hours per week.
D - That the school be named Meir Ibrahim Tweig School, and this name shall not be changed
over the passage of years and generations.
E - It is permissible to accept the number decided by the trustee and in the proportion he designates of the children of the poor
for free, and as for the school fees obtained from those who are able to pay them, as well as
donations, if any, they shall be spent first on the renovation and maintenance of the building and second on paying the salaries
of teachers and servants, and if there is a surplus, it may be allocated to the aforementioned synagogue named
after her husband for the purpose of paying the expenses required for its management, and if the revenues increase
in the synagogue, they shall be allocated to cover the school's expenses.
F - The trustee may seek the assistance of a committee appointed by him to carry out the affairs of the school's management under
his chairmanship, and he has the right to replace them from time to time or abolish the committee entirely, and he also has the right to give
the management of the school to the Israelite community in Baghdad or to any body from the community
whether existing or requested to be formed for the aforementioned purpose, provided that the trusteeship remains in his hand
absolutely, and he has the right to change the school management body if he finds it necessary.
G - The trusteeship shall be to the aforementioned Mr. Selim for his lifetime, and after him to his children,
males or females, and his children's children, generation after generation, provided that the eldest
and most rational among them is considered, then to any person from his lineage, and upon their cessation, the trusteeship shall pass to
the President of the Lay Council of the Israelite Community in Baghdad.
In this manner, she requested the issuance of a deed for the endowment, and she confirmed the contents of the request, then
the two trustees, Mr. Daoud Isaac Tawfiq and Mr. Selim Daoud Isaac Tawfiq, stated, after
being identified by the identification witnesses, that they accepted the trusteeship over the aforementioned synagogue and over the school
that will be established on the aforementioned land, and they pledged to the condition of the endower completely and requested the issuance of a deed for the aforementioned
endowment. Then the endower requested to recede from the aforementioned endowment and requested not to issue a deed for it,
whereupon each of the trustees present in the council stated that the endower has no right to recede from the endowment.

The Decision
Inasmuch as the fatwa is that the endower, after she endowed and handed over the endowment property to the two trustees while fulfilling
the conditions required for the validity of the endowment, does not have the right to revoke the endowment; and whereas it has been established from
the confession of the endower that she endowed the property plot (3) numbered serial 7/9, 8/9, and 9/9 located
in the Battaween neighborhood with the building on it as a synagogue (oratory) or what will be established on it as a school for teaching
religious sciences to the children of the Israelite community in Iraq, and appointed Mr. Daoud Isaac Tawfiq
as a trustee over the synagogue and Mr. Selim Isaac Tawfiq as a trustee over the religious school and handed over the endowment
to them according to the conditions written above, and that the two aforementioned persons shall be trustees over the mentioned endowment
and accordingly the endowment has been completed and become binding and it is so judged according to the conditions set forth above, thus it has become a valid and legal endowment.

worshippers of the Israelite community, while the other part of the land remains vacant without construction.

First - That the mentioned synagogue be named after her deceased husband Meir Ibrahim Tweig, provided that this
name shall not be changed.
Second - That the mentioned synagogue be used by the Israelite worshippers in the manner and method
followed in Iraq.
Third - That Mr. Dawood Ishaq Tawfiq, of Iraqi nationality and residing in Baghdad, shall be the trustee
over the mentioned synagogue for his lifetime, and he has the absolute right to supervise the synagogue from both the
administrative and religious aspects, as he is also authorized to form a committee to carry out administrative tasks under his presidency
or supervision, and he may replace committee members from time to time according to his opinion or dissolve the committee
and the administration shall remain without any person or any official in the community having the right to interfere
in the affairs of the synagogue, and that the following principles be observed :-
A - All revenues obtained from donations of worshippers and others, including subscriptions
and others that are paid in any form whatsoever.

A - That the aforementioned school be built from donations or any other resource according to the opinion of the trustee, Mr.
Selim, and that the construction be of the area, amount, engineering, and shape that
he deems appropriate in his absolute opinion.
B - That the school be used for the purpose of teaching and receiving religious knowledge by the children of
the Jewish community in Iraq in the manner and principles that the trustee deems appropriate, while
observing the laws established by the Iraqi government.
C - That among the lessons taught in the aforementioned school shall be the study of the Torah
for at least six hours a week.
D - That the school be named Meir Ibrahim Tuwayq School, and this name shall not change
over the passage of years and generations.
E - It is permissible to accept the number decided by the trustee, and in the proportion he determines, of poor children
free of charge. As for the school fees collected from those who are able to pay, as well as
donations, if any, they shall be spent first on repairing and restoring the building, and second on paying the salaries
of teachers and servants. If there is a surplus, it may be allocated to the aforementioned synagogue named
after her husband for the purpose of paying the expenses required for its management. If the revenues
in the synagogue increase, they shall be allocated to cover the school's expenses.
F - The trustee may seek the assistance of a committee appointed by him to carry out the school's administrative affairs under
his chairmanship, and he has the right to replace them from time to time or to abolish the committee altogether. He also has the right to give
the management of the school to the Jewish community in Baghdad or to any body from the community,
whether existing or requested to be formed for the stated purpose, provided that the trusteeship remains in his hands
absolutely, and he has the right to replace the school's management body if he finds it necessary.
G - The trusteeship shall be held by the aforementioned Mr. Selim during his lifetime, and after him by his children,
males or females, and their grandchildren generation after generation, provided that the eldest
and most capable among them be considered, then to any person from his descendants. If they cease to exist, the trusteeship shall pass to
the President of the Lay Council of the Jewish community in Baghdad.
In this manner, she requested the issuance of an endowment deed (Hujja), and she confirmed the contents of the request. Then
the two trustees, Mr. Daoud Isaac Tawfiq and Mr. Selim Daoud Isaac Tawfiq, stated, after
their identification by witnesses that they accepted the trusteeship over the aforementioned synagogue and the school
to be built on the aforementioned land, and they pledged to fully comply with the conditions of the endower and requested the issuance of a deed for the
aforementioned endowment. Later, the endower requested to revoke the aforementioned endowment and requested not to issue a deed for it.
Thereupon, both trustees present in the council stated that the endower has no right to revoke the endowment.

religious sciences to the children of the Israelite community in Iraq, and appointed Mr. Daoud Ishaq Tawfiq
as a trustee over the synagogue and Mr. Salim Ishaq Tawfiq as a trustee over the religious school, and handed over the endowed property
to them according to the conditions written above, and that the two mentioned persons shall be trustees over the mentioned endowment,
accordingly, the endowment has been completed and became binding, and it was ruled upon according to the conditions stated above, becoming a valid legal endowment.

17 and dated December 1944, Volume 466, and currently occupied by the Directorate of
Travel and Nationality in Baghdad, are an endowment (waqf) of the endowments of Meir Ibrahim Tweig Charity, endowed according to
the endowment deed issued by the Personal Status Court in Baghdad on 30 / 5 / 1943, number
56 / 43 Sh. In my capacity as the trustee (Mutawalli) of the aforementioned endowment, I have appointed as my attorney and substitute through this
Mr. ⟦...⟧ son of ⟦...⟧ in his capacity as the Chairman of the Administrative Council for the Administration of General Property
of Iraqi Jews. The Council formed according to instructions issued by the Ministry of Justice which

officially to manage the general property of Iraqi Jews. My attorney, according to what is stated above, shall act in my place
with all powers granted to me under the aforementioned endowment deed in a general, absolute, and delegated manner
without exception. He shall act in my place in my capacity as the trustee of the mentioned endowment in any lawsuit, case, or official
transaction of whatever kind and in whatever capacity, and shall exercise all legal powers, rights, and reviews -
ordinary and extraordinary - and follow up on them until the final decision is reached and implemented in
the specialized departments, including placing and lifting preventive and procedural seizures, the right of receiving, collecting, reconciling, discharging,
and waiving. He has the right to appoint others for all these powers or some of them and dismiss them repeatedly. The
details mentioned above do not limit the authority of my attorney in any way, but rather he has, regarding the above, the right to act

Matters in Baghdad on 30/5/1943, number 56/43 Sh. As for the guardianship (tawliya) of the synagogue,
it belonged to my late father Daoud Ishaq Tawfiq, who died on 16/7/1958, and then it passed
to me after his death. As for the guardianship of the mentioned school, it was mine originally under the mentioned deed.
Since I am unable to carry out the mentioned guardianship and there is no one among my descendants who can handle it, I
have waived the guardianship of the two mentioned endowments to the Administrative Council for the Administration of Public Funds
of Iraqi Jews, the council formed under the Ministry of Justice instructions published in the
Official Gazette under number 4104 dated February 25, 1958, and after it to any committee or ⟦I appointed⟧
other body that may be officially formed to manage the public funds of Iraqi Jews. To implement the above, I have
appointed as my representatives and deputies the lawyers Mr. Sion Shua Giji and Munshi Yousef Cohen, jointly and severally,
to approach the courts or any other competent official body to complete my mentioned waiver. For the mentioned purpose,
each of my agents may act in my stead in any lawsuit, case, or official transaction of any kind and in any
capacity, and to exercise all legal powers, rights, and appeals, ordinary and
extraordinary, and to follow them up until a final decision is reached and implemented in the competent departments. Each of them
has the right of taking, receiving, reconciliation, acquittal, dropping claims, and appointing others in all or some of these powers,
and dismissing them time after time. The details mentioned above do not limit the authority of my two agents in any way, but rather
each of them regarding the above may act in my stead in everything I can legally do personally in a general,

Second - That the mentioned synagogue be used by Israelite worshippers in the manner and method
followed in Iraq.
Third - That Mr. Daoud Ishaq Tawfiq, of Iraqi nationality and residing in Baghdad, shall be the trustee
over the mentioned synagogue for the duration of his life, and he has the absolute right to supervise the synagogue from both
administrative and religious aspects, and he is authorized to form a committee to carry out administrative tasks under his chairmanship
or supervision. He has the right to replace committee members from time to time according to his opinion or to dissolve the committee
and the administration remains without any person or any official in the community having the right to interfere
in the affairs of the synagogue, and the following principles shall be observed:-
A - All revenues obtained from donations of worshippers and others, including subscriptions
and others paid in any form whatsoever.
B - Appointing employees and servants with the salary he assigns, dismissing them, and appointing others.
C - Spending necessary expenses for construction, renovation, purchasing furniture, and others.
D - That the mentioned Mr. Daoud shall be the trustee for his life, and after him, the trusteeship shall pass to
his mentioned children, then to his grandchildren and his grandchildren's grandchildren, generation after generation, provided that
the trusteeship is assigned to the eldest and most mature among them, and then to any male of his descendants. Upon their extinction,
the trusteeship shall be given to the President of the Spiritual Council of the Israelite community.

Fourth - As for the land vacant of building, she has agreed and permitted that a school be established on it and
that Mr. Salim Daoud Isaac Tawfiq be the trustee (Mutawalli) over it according to the following conditions:
A - The aforementioned school shall be built from donations or any other source according to the opinion of the trustee, Mr.
Salim aforementioned, and the building shall be of the area, size, engineering, and shape that
he deems appropriate in his absolute discretion.
B - The school shall be used for the purpose of teaching and receiving religious knowledge by the children of
the Israelite community in Iraq in the manner and principles that the trustee deems appropriate, provided
that the laws established by the Iraqi government are observed in that regard.
C - Among the subjects taught in the aforementioned school shall be the study of the Torah -
at least six hours per week.
D - The school shall be named Meir Ibrahim Twayq School, and this name shall not be changed
over the years and generations.
E - It is permissible to accept the number decided by the trustee and in the proportion he designates of the children of the poor
free of charge. As for the school fees obtained from those who are able to pay them, as well as
donations, if any, they shall be spent first on the construction and renovation of the building, and second on paying the salaries
of teachers and servants. If there is a surplus, it may be allocated to the aforementioned synagogue named
after her husband for the purpose of paying the expenses required for its management. If the income increases
in the synagogue, it shall be allocated to pay the school's expenses.
F - The trustee may seek the assistance of a committee appointed by him to manage the school's affairs under
his chairmanship, and he has the right to replace them from time to time or abolish the committee altogether. He also has the right to give
the management of the school to the Israelite community in Baghdad or to any body from the community,
whether existing or requested to be formed for the stated purpose, provided that the trusteeship remains in his hands
absolutely, and he has the right to replace the school's management body if he finds it necessary.
G - The trusteeship shall be held by the aforementioned Mr. Salim during his lifetime, and after him by his children,
males and females, and the children of his children, generation after generation, provided that the eldest
and most competent of them is observed, then to any person from his descendants. Upon their cessation, the trusteeship shall pass to
the President of the Lay Council of the Israelite community in Baghdad.
In this manner, she requested the issuance of an endowment deed (Hujjat Waqf), as she confirmed the contents of the request. Then
the two trustees, Mr. Daoud Isaac Tawfiq and Mr. Salim Daoud Isaac Tawfiq, testified after
their identification by the identification witnesses that they accepted the trusteeship over the aforementioned synagogue and the school
to be established on the aforementioned land and pledged to fulfill the conditions of the endower completely and requested the issuance of a deed for the
aforementioned endowment. Then the endower requested to withdraw from the aforementioned endowment and requested not to issue a deed for it,
so each of the two trustees present in the session stated that the endower has no right to withdraw from the endowment.

After she endowed and they accepted the conditions contained in the endowment deed, and both the endower and the two trustees insisted on
their request. Therefore, as there is nothing left to be said, the conclusion of the session was announced.
The Decision
Since the legal opinion is that the endower, after having endowed and handed over the endowed property to the two trustees, meeting
the conditions required for the validity of the endowment, has no right to revoke the endowment; and since it has been established from
the endower's confession that she endowed the property, plot (3) numbered sequence 7/9, 8/9, and 9/9, located
in the Al-Bataween neighborhood, including the building on it as a synagogue (place of prayer) or what will be established on it as a school for teaching
religious sciences to the children of the Israelite community in Iraq; and she appointed Mr. Daoud Ishaq Tawfiq
as a trustee over the synagogue and Mr. Selim Ishaq Tawfiq as a trustee over the religious school, and she handed over the endowed property
to them according to the conditions written above, and that the two mentioned persons shall be trustees over the mentioned endowment;
accordingly, the endowment has been completed and become binding, and it is ruled upon according to the conditions set forth above, so it has become a valid and legal endowment.

depositing money in banks in my name and withdrawing it, and withdrawing money deposited by me or in my name in banks or with
persons or institutions or any person whatsoever, and signing checks, transfers, and all commercial papers and letters of whatever
kind, including papers and bonds that may bind me to a debt of whatever kind and amount, and receiving letters, telegrams, and parcels that
reach me through post and telegraph offices and persons or from any person whatsoever, and to pay fees and taxes incurred by me, and
to retrieve the deposits I have in official or semi-official departments, and I have authorized him to sell my immovable property at the price he sees
fit to any person whatsoever, and to collect the sale price, and to appear before the Land Registry offices, to acknowledge receipt, and to carry out the report in the names of the buyers,
and to sign the knowledge notices, expertise reports, and necessary registers, and to pay all expenses and fees necessary for that, and I have authorized him to attend all
general meetings of limited liability companies in which I hold shares, to vote on my behalf in those meetings,
and I have authorized him to collect the interests due to me from those shares and sell them at the price he deems appropriate to any person whatsoever, and to sign all
receipts, transfers, and documents for the mentioned purposes. Furthermore, as I am the trustee of the endowment known as the (Meir Ibrahim
Twayq) endowment according to the endowment deed numbered 43/56 Sh dated 5/20/1943, and as the mentioned endowment includes the synagogue
known as the (Meir Ibrahim Twayq) synagogue and the school known by the same name and currently occupied by the Directorate of Travel
and Nationality, I have authorized him to exercise all powers granted to me under the aforementioned endowment deed to manage the mentioned endowment
in the manner he deems appropriate, and he has the right to lease the school currently occupied by the Directorate of Travel and Nationality at the price
or rent he deems appropriate and for the period he deems appropriate to whomever he wishes, and to collect the rent, and he has the right to carry out the constructions
necessary for it and its restoration at his absolute discretion, and to conclude construction contracts with contractors or persons for this purpose.
And to represent me in all lawsuits filed and to be filed by me or against me in all courts, whether Sharia, civil, or criminal,
or legal, and to follow up on my interests before all official and semi-official departments and authorities, including Income Tax offices,
audit committees, and other financial authorities, and to litigate and defend at the first instance, appeal, and cassation stages, in person or in absentia, and to enter into
lawsuits as a plaintiff, defendant, third party, objector, or third-party objector, and to request default judgments and the dismissal of lawsuits and the tendering of
the oath and its acceptance, and the selection of experts, arbitrators, and evaluators and their dismissal, and the placement of provisional attachment on movable and
immovable property and its release, and to draft all memos and petitions, and he may exercise them with his signature, and notification and being notified, taking and receiving, settlement and discharge,
withdrawing warnings, and delegating others for all or part of what he is authorized for, and dismissing them time and again, and for this purpose, I have given him this general power of attorney.

Court in Baghdad on 5/20/1943, No. 56/43 Sh. As for the ⟦private⟧ guardianship over the synagogue,
it belonged to my late father, Daoud Isaac Tawfiq, who passed away on 7/16/1958, then it devolved
to me after his death. As for the guardianship over the mentioned school, it is mine originally according to the mentioned deed.
And since I am unable to carry out the mentioned guardianship and there is no one among my descendants who can undertake its guardianship, I
have waived the guardianship of the two mentioned endowments to the Administrative Council for the Administration of General Funds
for Iraqi Jews, the Council formed according to the Ministry of Justice instructions published in the
Official Gazette under No. 4104 dated February 25, 1958, and after it to any committee or entity
that may be officially formed to manage the general funds of Iraqi Jews. To implement the foregoing, I ⟦appointed as attorney⟧
on my behalf and delegated my place to the lawyers Mr. Zion Shohet Gigi and Munshi Yusuf Cohen, jointly and severally,
to approach the courts or any other specialized official authority to complete my mentioned waiver. ⟦For the mentioned purpose⟧,
each of my "attorneys" shall stand in my place in any lawsuit, case, or official transaction of whatever type and in whatever
capacity, and to use all powers, rights, and legal reviews, whether ordinary or extraordinary,

Court in Baghdad on 5/30/1943, No. 56/43 Sh. As for the guardianship over the synagogue,
it belonged to my late father, Daoud Isaac Tawfiq, who died on 7/16/1958, and it then devolved
to me after his death. As for the guardianship over the aforementioned school, it originally belongs to me according to the said deed.
