Heskel Khedhouri submitted a petition to our court on 23 / 6 / 1954 stating that he obtained a judgment from the
Community Court under notification number 443 and basic number 371 / 49, ruling against the defendant Farha bint
Nassim for her recalcitrance (nushuz) and authorizing the plaintiff Heskel Khedhouri Isaac to marry another woman, and that the aforementioned judgment has acquired
final status, and that the petitioner approached your department to obtain a marriage permit and his request was rejected.
Therefore, it is necessary to clarify the reason for not authorizing the petitioner to marry despite the issuance of a judgment from the
Community Court granting him the right to marry another woman and the aforementioned judgment acquiring final status. Please inform us of
that so that the necessary measures regarding the request can be taken with the required speed.
