Subject of Complaint: I was notified on ⟦11 / 5 / 922⟧ via the Shahraban Peace Court of the alimony judgment issued against me by the Jewish Spiritual Court in Baghdad dated ⟦11 / 5 / 922⟧
and numbered 828, ruling for the payment of alimony to my wife, the aforementioned respondent Samha, in the amount of forty-five rupees every month, so I object
to it for the following reasons:
First: The respondent claims that I left her in Baghdad and went away, yet I joined my said wife sixteen years ago in Shahraban and I
my place of residence is also in Shahraban and I have no place of residence in Baghdad.
Second: The mentioned Samha is the one who left my house without my permission and went to Baghdad without my consent and started taking away my dependents and children.
Third: I am a working man with no money, no property, no trade, nor anything, and my daily income does not exceed two rupees with which I support myself and my wife
from the family, and the estimated alimony is excessive and beyond my ability to pay, and alimony should be estimated according to the husband's status.
Fourth: As previously noted, my residence is Shahraban and I have no residence in Baghdad, and as the respondent filed the lawsuit against me
in Shahraban, the mentioned Spiritual Body should have rejected the respondent's lawsuit regarding jurisdiction, as it has no jurisdiction
over a claim in this matter except in Shahraban. I objected to this alimony jurisdiction on the lawsuit paper, and as it is known
that the August Ministry of Justice issued a special statement regarding the necessity of hearing lawsuits related to personal status matters in their locations, except
if the case involves matters that must be referred to a spiritual head for an opinion or inquiry according to the provisions of the said statement,
and the head was present in the place of judgment, yet the mentioned body did not pay attention to this argument.
Fifth: I request the referral of this lawsuit of ours to the Sharia Court or the Peace Court of Shahraban so the matter between us can be settled, as my residence is in
Shahraban and there is no spiritual head there according to the special statement mentioned above.
Sixth: I request the reversal of the aforementioned judgment through legal means and for the formal procedures to be completed ⟦...⟧
