I have reviewed the objections submitted by the lawyers, agents of the creditors Aziz Lulu and Jules Strak
and the Ismail Khashab Company. Since the brief of colleague lawyer Dhafer Nouri, agent of the creditor Aziz Lulu, included
all the objections and elaborated on the explanation, commentary, and comparison, I have therefore found it necessary to refute what was stated in the
aforementioned brief.
First - The date the debt was officially established
The colleague agent conceded at the beginning of page 3 the principle established by your honorable presidency, which states (taking into account the date the debt was officially established). The Waqf authority bases its request on the Sharia deed issued by the Court of Personal Status in Baghdad under number 220 / Sh / 1961 and dated 12/25/1956, supported by the Sharia deed issued by the Court of Personal Status in Karrada under number 18 / Sh / 1958 and dated 8/3/1959, as well as the two contracts certified by the Notary Public of South Baghdad, the first dated 1/2/1957 and 8/7/1958.
Based on these two contracts and the two Sharia deeds, the Musataha right was registered on the plot sequence 6/6 at the Land Registry Department in the names of the partners Majid Kashif al-Ghita, Hassan al-Kahaji, Muhammad, and Ali al-Qattan, considering the first owns 18 shares and the others own 22 shares out of 40 shares.
As for the date of the internal check belonging to the creditor Aziz Lulu, it is 11/30/1960. From this, your honorable presidency can see that the Waqf authority's document predates the document of the creditor Aziz Lulu by approximately four years.
And when the Karrada Sharia Court calculated the rent, it relied on the Sharia deeds and official contracts, and for this reason, it addressed its letter 5/5/1970 to your honorable presidency requesting the disbursement of the Waqf debt as it has no relation to the estate. In the second letter, it corrected the number and referred to the debt items and the fact that it consists of three items. This alone is sufficient to respond to what was stated in the objection briefs.
Second - The Waqf debt has no relation to the estate
The Sharia Court stated in its letter dated 5/5/1970 the following:-
