Reference to your letter No. 3615 dated 3/15/1961 in response to our letter No. F/61/67 dated
3/5/1961.
Please be informed that the subject of training a teacher or instructor is not applicable to private schools, including
our school. This is because the appointment of a teacher or instructor (Iraqi and foreign alike) to work in private
schools is only done after obtaining the approval of the Ministry of Education, and that is after the teacher or instructor possesses the
educational certificates that qualify them to perform the teaching mission. This is also done according to specific regulations and laws for teachers
and instructors, and these regulations organize the conditions of their employment, determine their salaries, and secure their interests. From this it is clear
that it is not possible to employ an Iraqi as a teacher or instructor initially unless they meet the eligibility requirements for teaching
and unless the Ministry of Education approves their appointment. The mentioned Ministry cannot approve any candidate for teaching
unless that candidate first possesses the necessary eligibility competence for education. Accordingly, there are no cases in private
schools where it is appropriate to speak about training a teacher or instructor in the sense in which a
worker or employee is trained in factories or in other departments.
Furthermore, the need of private schools to employ foreign teachers, their number, and their specialization is decided by the Ministry of Education
as it is the official body specialized in this matter. As for the inclusion of schools under the provisions of Labor Law No. 1
of 1958 as public facilities, this point was the subject of research by officials in the Ministry of Education in
the recent period. It is clear that the mentioned Ministry is of the opinion that the appointment and employment of teachers and instructors and the care of
their interests and the organization of their affairs from administrative and living aspects in addition to educational aspects is purely the
specialization of the Ministry of Education. Especially since there are regulations and laws applied by that Ministry that secure the rights
of these employees in a sufficient manner.
