Subject: Petition of Mr. Albert Naji Yaqoub Beneri
With reference to the petition of Mr. Albert Naji Yaqoub Beneri dated January 2, 1960, regarding
his brother Bashir Naji Yaqoub Beneri, the student dismissed from the third intermediate grade at Frank Iny Intermediate School. We attach
herewith a copy of the decision of the Teachers' Council of this school taken on Thursday, December 31, 1959, regarding
the aforementioned student and regarding his brother Mushir Naji Yaqoub Beneri, currently attending the first year of the College of Engineering,
with the request to kindly review our following observations on the subject:
1- The petitioner, Albert Naji Yaqoub Beneri, was the first to attack the administration by telephone on Monday,
December 28, 1959, immediately after dismissal. The Director's response was to cut the call without answering
his attack, which had no justification. Note that the petitioner is not the student's guardian; rather, his father is
the guardian.
2- What was stated regarding the incident mentioned in the petition occurring on Tuesday, December 29, 1959,
is incorrect. In fact, the incident occurred on Monday, December 28, 1959.
3- The petitioner Albert Naji Yaqoub Beneri claimed that one of the teachers at Frank Iny School called his brother, the student
Bashir Naji Yaqoub Beneri, and that the latter did not hear the teacher's call until the third time, at which point his brother
apologized for not hearing due to a headache, but the teacher did not accept his apology. In fact, he (the student Bashir
Naji Yaqoub Beneri) hid in the classroom behind the students and did not respond to the teacher's repeated calls despite the teacher
searching for him inside and outside the classroom for a full ten minutes. This led to the disruption of classroom order
in a disturbing manner. He did all this with the intention of causing confusion and chaos inside the classroom and to evade the
oral exam being conducted by the teacher.
4- Albert Naji Yaqoub Beneri stated in his petition that the teacher summoned the school principal, Mr. Abdullah Owaidia, to
the classroom. In fact, the teacher removed the student Bashir from the classroom and sent him to the administration, and the principal was not present in
his room at that time as he was teaching Algebra to the fourth secondary grade.
5- Albert claims in his petition that the school principal went to the classroom at the teacher's request and called his brother Bashir,
saying to him, without knowing anything about what had happened, "I will make an example of you for the class, etc." In fact, the student
Bashir Naji Yaqoub Beneri, when he came to the administration and did not find the principal there, returned to the teacher and asked him to
close the case. When the teacher refused, he said to him (Don't make it a fuss!). So the teacher submitted a letter to the school principal
as follows:
Honorable Principal,
The student (Bashir Naji Yaqoub) from the third grade, I asked him to take the oral exam and I was told
that he was absent and he did not answer my request. When I counted the students, I found the number of students to be complete, so I asked him
to answer. He stood up and claimed he did not hear, even though I spent ten minutes searching for him and sent the monitor to
the assistant to ask about him. Then he dared to say to me (Don't make it a fuss!!). Please punish him as
he deserves, and thank you in advance.

Presented to your Excellency:
On Tuesday, December 29, 1959, one of the teachers at the Frank Iny School called my brother, the student
Bashir Naji Bashiri, in the third intermediate grade at the aforementioned school. He did not hear the teacher's call until
the third time, at which point my brother Bashir apologized for not hearing due to a headache. The teacher did not accept his apology
and called the school principal, Mr. Abdullah Oudia. As soon as the principal entered the classroom, he called my brother Bashir, saying, without
knowing anything about the subject of what had occurred: "I will make an example of you for the class, and you know the relationship between me and
your family" (referring to a misunderstanding between him and our father for a reason unknown to us). He uttered words that defy
good taste and the principles of teaching and education, as he said, addressing my brother Bashir: "You are a donkey, and you are all
degraded and donkeys (meaning the family), etc... and I will refer you to the disciplinary committee."
The next day (Wednesday), my brother Bashir went but was prevented from entering the classroom, being told that the principal
had requested that. The same was true for the following day (Thursday). We were surprised on Thursday
evening by a telephone request for Bashir from the school administration to investigate him before the teachers' council. When he went
to the council meeting held at the school, the principal greeted him with the most foul insults and curses. When nothing
was proven against him (meaning against my brother Bashir), he left the school. The next day, an announcement was posted in
the school expelling the student Bashir Naji for the remainder of the current year. The principal spoke in one of the classes,
saying, "I will expel any student whose family speaks ill of me," without us knowing what he meant by that.
I would also like to mention to you that my brother Bashir is of good conduct and has never been expelled or given any reprimand,
warning, or notice throughout his school years.
In placing these lines before your Excellency, I hope you will kindly cancel the aforementioned teachers' council decision,
which is unjust and unsupported by any fact, and which slaughters a precious year of the life of a student who committed no sin in our
eternal Republican era. Therefore, I hope you will kindly order that he be provided with a transfer certificate to another school.
This is for your Excellency's order. Please accept my utmost thanks and respect.

The following day (Wednesday), my brother Bashir went and was prevented from entering the classroom, being told that the principal had requested this. The same happened the following day (Thursday). We were surprised on Thursday evening by a telephone request for Bashir from the school administration to investigate him before the teachers' council. When he went to the council held at the school, the principal greeted him with the most vile insults and curses. When nothing was proven against him (meaning against my brother Bashir), he left the school. The next day, a notice was posted in the school expelling the student Bashir Naji for the remainder of the current year. The principal spoke in one of the classes, saying, "I will expel any student whose family speaks ill of me," without us knowing what he meant by that.
I would also like to mention to you that my brother Bashir is of good conduct and has never been expelled or given any warning, notice, or caution throughout his school years.
As I place these lines before your Excellency, I hope you will kindly cancel the aforementioned unfair decision of the teachers' council, which is not supported by any incident and wastes a precious year of the life of a student who committed no sin, especially in our eternal Republican era. Therefore, I request you kindly order that he be provided with a transfer certificate to another school.
This is for your Excellency to decide. Please accept my highest thanks and respect.

On Tuesday, December 29, 1959, I was sitting in the third intermediate class of the
Frank Iny School. The teacher called my name twice, but I did not hear his call because I was ill and
my temperature was high, and sharp pains were almost squeezing my head. When I heard his call for the
third time, I apologized to him, but he rejected my apology and summoned the school principal, Mr. Abdullah Oweidia.
Without verifying the news or knowing anything about it, his voice rose thundering, "I will make you an example for the class."
He continued with his foul language, describing me as a "donkey, degraded, and bad," then he moved on to my family and described them
with these same terms, and concluded his words... that he would refer me to the disciplinary committee.
On the second day, I went to school and was prevented from entering the class in implementation of the principal's orders,
and this also happened on the second and third days...
On Thursday evening, I was requested by the school administration by telephone for investigation.. and when I arrived at the school
I found the teachers' council meeting.. and as soon as I entered the meeting room, the principal launched into the foulest
insults, the worst words, and the worst descriptions. After they directed various questions to me, they found nothing that could
constitute a violation, offense, or assault, but they nevertheless took a decision to expel me until the end of the year.
I am explaining my case in its details and I ask the Union to intervene to stop the implementation of this unjust decision
and to restore my dignity as a student who was insulted and whose dignity was wounded in front of dozens of students, and whose rights were wasted and who was mistreated
in an unjust manner.
Finally, I would like to mention that the actions of the school principal since the beginning of the year have been hostile to the students and attacking
them, and directing the teachers who are subject to him by virtue of his command over them, to mistreat the students and limit the
activity of the Union committee in the school and freeze it so that he can act as he pleases and wishes.
