With reference to the letter of the Ministry of Social Affairs mentioned above and the letter of the Ministry of Education addressed to the Ministry of
Social Affairs No. 232 dated 2 / 1 / 962. A dispute arose between the Ministry of Education and the General Directorate of
Labor in the Ministry of Social Affairs regarding the employment of foreigners in teaching in private schools,
including Shamash Preparatory School and Frank Iny Intermediate School. The General Directorate of Labor considered that Article (134) of the
Labor Law No. 1 of 1958 stipulates in its text that the Labor Law regulates all works and professions in Iraq,
and that they are the right of Iraqis alone, whether the person, worker, or employee is covered by the provisions of this law
or not covered by it. This requires that a foreigner not be employed in any government department, whether cultural, industrial,
or commercial, except after obtaining a work permit from the General Directorate of Labor, and that is what must be applied to
foreign employees in private schools. As for the Ministry of Education, it considered that the Ministry of Education Law No.
(39) of 1958 included the provisions that regulate the employment of teachers and instructors in state schools
and in private schools. The Council studied the subject of this dispute and found that the Labor Law specified the persons
and legal entities covered by its provisions, as it specified in Article Two thereof the persons who are not covered by
those provisions. This law did not address the regulation of work in teaching matters for foreigners, leaving
it to its own special law and to the ministry concerned with spreading culture and education and managing it, which is the Ministry of Education Law.
This law stipulated in several of its articles that the establishment of schools, their management, and the monitoring of work in them, whether
private or foreign, is one of the tasks of the Ministry of Education. It also extended this oversight for private schools to
obtaining written permission from the Ministry of Education. Article (24) thereof stipulated that no private or foreign school
of any type or academic level shall be established except with written permission from the Ministry of Education. Article (25) also stipulated
thereof the obligation of private and foreign schools not to employ anyone except Iraqi teachers in certain subjects, and allowed
them to employ foreigners in subjects other than those. Article 27 stipulated the appointment of the directors and teachers of those schools,
requiring the approval of the Ministry of Education for their appointment specifically. Article 26 required private and foreign schools
to submit their annual staff lists and budgets to the Ministry of Education for approval before the start of the school year.
Article 30 thereof prohibited private schools from accepting aid from foreign sources except with the approval of the Ministry of Education.
Other articles in Chapter Eight of the law regulated all administrative, educational, and financial affairs and the oversight
thereof properly, and established punishment for every private or foreign school that commits a ⟦violation⟧ of certain acts stipulated in
Article (5) of the law. From the foregoing, it became clear to the Council that private schools are subject, regarding the establishment of schools,
the organization of their staff, the appointment of their employees (Iraqis and foreigners), and the oversight of their financial affairs, to the Ministry of Education Law No.
(39) of 1958 and not to the provisions of Labor Law No. (1) of 1958 in general.
