The Revolutionary Command Council decided in its session held on 12-8-1973
To issue the following law: -

Law
Amendment to Labor Law No. (151) of 1970
Article 1 - The percentage (50%) mentioned in Paragraph (a) of Article
One hundred and forty-seven of the law is deleted and replaced by (100%).
Article 2 - This law shall be published in the Official Gazette and the Ministers shall undertake the implementation of
its provisions.
Explanatory Memorandum
Since the need requires sending
workers abroad for training
and to acquire and improve
technical expertise, and due to the high cost of
living and residence expenses
abroad, and to avoid
deputized workers any financial loss
that may affect them as a result of this
deputation, this law was enacted.

Second of the interim Constitution and based on the judgment issued by
the Special Court on 7-7-1973 in the case
numbered (2) which included the conviction of the criminal Ali Reza Bawa
to imprisonment for a period of two years according to Article (247) of the Penal
Code.
The Revolutionary Command Council decided in its session held
on 15-8-1973 the following: -
1 - Dismissal of Ali Reza Bawa, the Director General in the Revolutionary Command
Council / Office of the Vice President, from service for a period of five
years starting from the date the judgment was issued
on 7-7-1973.
2 - The specialized ministers shall implement this decision.

Based on the provisions of paragraph (a) of Article Forty-
Second of the interim Constitution.
The Revolutionary Command Council decided in its session held
on 15-8-1973 the following: -
1 - Authorizing the Minister of Communications the power to grant engineers
and technicians working in telecommunications, wireless,
and postal services whose nature of work requires
working after official working hours additional
allowances without being restricted by the upper limit stipulated in
paragraph (b - 1) of Article Fifty-First of the
Civil Service Law No. (24) of 1960. Provided that
this is limited to cases of extreme necessity. And that
the total of allowances and wages in all cases does not exceed
(100%) of the salary or the wage prescribed instead of
the salary.
2 - The Ministers of Communications and Finance shall implement this
decision.

Company, to the Revolutionary Command Council - Office of Popular
Organizations, with the same current salary.
2 - The specialized ministers shall implement this decision.

on 16-8-1973 the following: -
1 - Adding the period from 30/9/1965 to 2/4/1966 to
the services of the deceased worker Faraj Hormuz Hamama
(the worker in the area of the irrigation factory and warehouse formerly)
for the purpose of his family's entitlement to a pension according
to the provisions of Law No. (140) of 1964.
2 - The Ministers of Irrigation and Labor and Social Affairs
shall implement this decision.

on 16-8-1973 the following: -

credited to his account, as an exception to
the provisions of Article (36) of Law No. (140)
of 1964.
2 - The Minister of Labor and Social Affairs shall implement this
decision.

Based on the provisions of paragraph (a) of Article Forty-
Second of the interim Constitution.
The Revolutionary Command Council decided in its session held
on 16-8-1973 the following: -
1 - The allowances of members of the boards of directors and committees
in departments and institutions affiliated with the Ministry of Finance and members
of the retirees' cases audit council are excluded from the Revolutionary Command
Council Decision No. (536) on 25-7-1972.
2 - This decision shall be effective from the date of its issuance and the Minister
of Finance shall implement its provisions.

In the name of the people
Revolutionary Command Council
Based on the provisions of paragraph (a) of Article Forty-Second
of the Interim Constitution and based on the approval of the President
of the Republic of the proposal of the Supreme Agricultural Council.
The Revolutionary Command Council decided at its meeting held
on 8-14-1973 as follows:
1 - The Land and Seizure Committees formed under
Agrarian Reform Law No. (117) of 1970 shall undertake
the confirmation of rights in agricultural lands and orchards
located within the boundaries of the Amanat al-Asima or municipalities
excluded from settlement or those that have not been settled under the
provisions of the Land Rights Settlement Law No.
(29 of 1938 repealed) and the provisions of the
Agrarian Reform Law and the instructions issued
thereunder shall apply to them.
2 - The committees mentioned in paragraph (1) of this resolution shall be competent
to decide the disappearance of the agricultural character from lands excluded
from settlement or those that have not been settled located within the
boundaries of the Amanat al-Asima or municipalities if their
previous records indicate that they were agricultural lands
or orchards and have been converted before the enforcement of
Agrarian Reform Law No. (117) of 1970 into
real estate lands.
3 - The provisions of paragraphs (1 and 4) of Article Twenty-Seventh
of the Agrarian Reform Law shall apply to decisions issued under paragraph (2).
The cases of confirming rights in the lands related to them shall devolve
after the decision acquires final status to the Real Estate Registration Departments
and the provisions of the Real Estate Registration Law
No. (43) of 1971 and the instructions issued
thereunder shall apply to them.
4 - The Supreme Agricultural Council shall issue the necessary instructions
to facilitate the implementation of the provisions of this resolution.
5 - This resolution shall be implemented from the date of its publication in the Official
Gazette and its provisions shall apply to cases whose registration
has not acquired final form in accordance with the provisions of the
Real Estate Registration Law.

Baghdad Governorate/Local Administration, for the purpose
of obtaining her pension.

resolution.

Republican Decrees
No. 716
Based on the provisions of paragraph (A) of Article Forty-
two of the Interim Constitution.
The Revolutionary Command Council decided at its session held
on 16-8-1973 the following: -
1 - Promoting First Policeman Mahmoud Najm Jarjis to
the rank of Fifth Commissioner as of 16-8-1973.
2 - The Minister of Interior shall implement this resolution.

No. 312
On 13-5-1973, the Permanent Military Court
of the Ministry of Defense, in case number (73/1802), sentenced
the conscripted soldier Wissam Abdel Sattar Abdel Jabbar affiliated
to the Provisions Department to a fine of (two hundred and ninety Dinars)
and in case of non-payment, rigorous imprisonment for a period of twenty-nine
months according to Article (41) of the Military Service Law
No. 65 of 1969 as amended, and this judgment became
final by the decision of the Military Court of Cassation
No. 73/1101 on 25-6-1973 after reducing the amount
of the fine sentenced against him to (two hundred and sixty Dinars).

Based on the provisions of paragraph (A) of Article Forty-
two of the Interim Constitution.
The Revolutionary Command Council decided at its session held
on 18-8-1973 the following: -
1 - Seizure of movable and immovable property belonging to
Hasib Qader al-Bayati.
2 - The Ministers shall implement this resolution.

affiliated to the Provisions Department is exempted from the penalty sentenced in case
(73/1802) Permanent Military Court of the Ministry of Defense.

The Revolutionary Command Council decided at its session held
on 18-8-1973 the following: -
1 - Referral of Khairallah Talfah, the Governor of Baghdad, to
retirement based on his request.
2 - The Ministers of Finance and Interior shall implement this
resolution.

two of the Interim Constitution.
The Revolutionary Command Council decided at its session held
on 18-8-1973 the following: -
1 - Exempting trainee doctors in the anesthesia branch from providing
the pledge stipulated in paragraph (3) of Article Three
and paragraph (3/B) of Article Five of the Medical
Graduation Law No. (99) of 1970 as amended.
2 - The Minister of Health shall implement this resolution.

Based on the provisions of paragraph (D) of Article Fifty-
eight of the Interim Constitution.
We have decreed the following:-
Appointment of Izzat Ibrahim al-Douri, Minister of Agriculture and Agrarian
Reform, as Acting Minister of Interior during the absence of Lieutenant General
Sa'dun Ghaydan, Minister of Interior, from Iraq.
Written in Baghdad on the seventh day of the month of Rajab
for the year 1393 Hijri, coinciding with the sixth day of the
month of August for the year 1973 AD.

Based on the provisions of Paragraph (a) of Article Forty-Two
of the Interim Constitution.
The Revolutionary Command Council decided in its session held
on 1973-8-12 as follows:-
First - Real estate lending for all personnel of official
and semi-official departments, public institutions,
and public sector companies shall be restricted to the Real Estate Bank, and the
word (employee) wherever it appears in this resolution shall apply to
officials, employees, and workers.
Second - Departments and institutions that have housing projects
for their personnel or that provide them with loans for the purpose
of building homes for them shall transfer all sums allocated for this
purpose annually to the Real Estate Bank to undertake the management
of these projects and their implementation according to the terms and rules
set by the Board of Directors of the Real Estate Bank. The
aforementioned sums shall be considered loans owed by the Real Estate Bank
at an agreed interest rate.
Third - A real estate loan is granted to an employee whose period of
service is not less than five years, not exceeding fifty
nominal salaries. Provided that the loan amount shall not exceed two thousand
five hundred dinars and not less than one thousand dinars, and it shall be repaid
within a maximum period of twenty years and at the interest rate
decided by the Board of Directors of the Real Estate Bank.
Fourth - The loan shall be repaid by means of monthly deduction from
the salary and in the manner decided by the Board of Directors of the Real Estate Bank,
and the borrowers' departments must adhere to implementation.
Fifth - An employee who has previously borrowed from
the Real Estate Bank or any other housing project may
borrow again according to lending rules if the
Board of Directors is convinced that the employee's circumstances require it.
Sixth - Non-real estate lending for employees shall be restricted to commercial
banks, and all sums allocated for this purpose
in official and semi-official departments, public institutions,
and public sector companies shall be transferred to commercial banks,
and interest settlements shall be made between commercial banks and those
entities at the end of each fiscal year. As for the interest on
marriage loans and medical treatment loans, they shall be borne by
the Ministry of Finance.
Seventh - An employee may not borrow or purchase from or
through the Real Estate Bank, commercial banks, or
any other government entity, or from cooperative societies
or public sector companies, amounts or materials that incur debts
against him such that their total monthly deduction
exceeds (50%) of his nominal salary
and cost of living allowances, except for what pertains to legal
alimony, deferred dowry, and Treasury debt.
Eighth - The provisions of Article (245) of the Penal Code shall apply to
the employee who provides false information for the purpose of obtaining
a loan in violation of the provisions of this resolution, as well as to
the employee who processes the transaction of such an employee
knowing the falsity of the information contained therein.
Ninth - The Board of Directors of the Real Estate Bank and the Boards of Directors
of commercial banks, each in its respective field, may issue
the necessary instructions to facilitate the implementation of the provisions of this
Resolution.
Tenth - No legal text that contradicts the provisions of this
resolution shall be applied regarding its purposes.
Eleventh - This resolution shall be published in the Official Gazette
and its provisions shall apply to lending transactions that take place
after its effective date, taking into account the provisions contained in paragraph
(Seventh) above. The Board of Directors of the Real Estate Bank may
include transactions organized on or after 1973-4-1
within the maximum lending limit after studying each case
individually.

We have decreed as follows: -
Younis Hussein Abdul Rahman, Director General of Civil Defense, is promoted to a salary of (180/-) Dinars per month.
The Minister of Interior shall implement this decree.
Written in Baghdad on the twelfth day of the month of Rajab for the year 1393, corresponding to the eleventh day of the month of August for the year 1973.

We have decreed as follows: -
Appointing Dr. Hisham Ibrahim al-Shawi, Minister of Higher Education and Scientific Research, as Acting Minister of Education during the absence of Dr. Ahmed Abdul Sattar al-Jawari, Minister of Education, from Iraq.
Written in Baghdad on the fifteenth day of the month of Rajab for the year 1393, corresponding to the fourteenth day of the month of August for the year 1973.

Amendment to Instructions No. 9 of 1970
Based on the provisions of Article Twelve of the Supreme Agricultural Council Law No. (116) of 1970, the Supreme Agricultural Council has issued the following instructions as an amendment to Instructions No. (9) of 1970:
Article One - Paragraph (a) of Article One of Instructions No. 9 of 1970 is deleted and replaced by the following:
a - A council shall be formed in each governorate under the name of the Agricultural Council, linked to the Supreme Agricultural Council, chaired by the Governor or his deputy, with the membership of each of the Head of the Agricultural Region, the Director of Agricultural Cooperation, the Irrigation Engineer, the Director of Agricultural Services, the Head of the Mechanical Unit, the Director of the Veterinary Hospital, and the Head of the Union of Farmers' Associations in the governorate.
The Council may include in its membership no more than three persons with technical expertise, and it may second experts from officials, members of organizations, and private citizens to seek their opinion whenever the need arises.
Article Two - These instructions shall be implemented from the date of their publication in the Official Gazette.

Offering Treasury Bills of the Republic of Iraq amounting to ten million dinars
for sale to the public under the Law on Borrowing and Issuance of Treasury Bills
No. (63) of 1958
1 - Based on the provisions of paragraph (b) of Article 1 of the Law on Borrowing and Issuance
of Treasury Bills No. (63) of 1958, it has been decided to offer for sale to the public
Treasury Bills of the Republic of Iraq totaling 10,000,000/- dinars
(ten million dinars and no other) until eleven o'clock in the forenoon
on Thursday, August 30, 1973. These bills will be issued
to the order of the buyer and will fall due for payment on November 29, 1973. The Central
Bank of Iraq in Baghdad will pay their full nominal value and interest on the date of performance
against the surrender of the bills.
2 - Interest shall be granted at a rate of 5.5% (five and a half percent per annum) on the Treasury
Bills offered for sale according to this statement, and the interest shall be paid on the maturity date
of the bills for payment.
3 - Purchase application forms (for licensed banks, institutions,
and members of the public) can be obtained from the Banking Department at the Central Bank of Iraq in Baghdad.
4 - Purchase forms must be completed correctly and signed by the buyer
in accordance with the rules to be considered fulfilling the conditions, and accompanied by checks drawn on
a licensed bank in Baghdad (if the buyer is a bank, the check must be drawn
on its account at the Central Bank of Iraq in Baghdad) for the total amounts of
the Treasury Bills to be purchased, or the mentioned amounts must be paid in cash, provided that these
forms are delivered to the Banking Department - Loans and Investments Directorate at the Central
Bank of Iraq in Baghdad at or before eleven o'clock in the forenoon on
Thursday, August 30, 1973.
5 - The lowest denomination for Treasury Bills will be (100/-) dinars, and no purchase offer
less than this amount or not expressed in multiples thereof will be accepted. The Central Bank of Iraq
shall have the right to accept the offer in whole or in part, or not to accept any part of it. The
denomination of the bills issued regarding accepted offers or any part thereof will be decided as
deemed appropriate by the Central Bank of Iraq.
6 - The Central Bank of Iraq will refund any excess amount received resulting from offers it accepted
partially or did not accept.
7 - The Central Bank of Iraq may discount or rediscount Treasury Bills issued under this
statement at the price it decides and as it deems appropriate.

Explanatory Reasons
The Tobacco Monopoly Administration used to issue a special regulation at the beginning of each fiscal year in which it determined
the amount of commission it grants to wholesale tobacco traders, along with a statement of the conditions and method of granting these sales licenses
and their number. Since no amendments have been issued to this regulation during the past ten years,
and to reduce routine, and because the Monopoly Administration is responsible for implementing
the provisions of its founding law, this law has been enacted.

Based on the provisions of the first paragraph of Article Three of
the Employees' Pension Fund Law No. 104 of 1960, it was decided to consider
the Ports Authority responsible for the implementation of the Social Security
Law as of the date of issuance of this statement.

Further to our statement No. 18 of 1973, and for the purpose of having
stone mills produce quantities that cover the needs
of consumers for first-grade flour, it was decided that the prices
of flour produced in stone mills shall be as follows:
1 - The price of one bag weighing 87 kg net
sold in the mills directly to the consumer shall not exceed
(2.900) Dinars.
2 - The Governors in provinces where silos are not
available are authorized to allow the addition of 50 fils to
the price of one bag when selling flour in
remote areas to cover actual transport costs, similar to
flour produced in technical mills.
All mill owners and intermediaries must comply with
what is stated in this statement. The instructions issued by the General
Grain Establishment regarding the application of prices and matters related to production
and distribution are considered binding and mandatory for implementation, and violators will be punished according
to the provisions of the Trade Regulation Law No. 20 of 1970.
