BAGHDAD: 26th June 1958
His Eminence,
The President,
The Jewish Community,
Calcutta,
INDIA.
Dear Mr. President,
Upon the request of Mr. David Solomon, Baghdad,
I would kindly solicit your valuable assistance in furnishing me
with an official certificate to the effect that his late brother
Abdullah Shlomo Abdullah Shlomo (alias ALBERT SOLOMON) of 4
Dacre's Lane, Calcutta, has died in Calcutta on 11/12/1949. The
certificate is further required to state the deceased's civil
status (indicating if he left any wife or children in India) and
nationality at the time of death.
In the event you would need some reference
regarding the deceased, I would suggest that you may solicit that
from the family of the late Sir David Ezra, to whom the deceased
was acquainted.
As the required certificate will have to be
presented to the Court in Baghdad, for obtaining a Probate Decree,
it will be however necessary to have it attested at the Iraqi
Embassy in Bombay; or at the Indian Foreign Ministry, in a way
that it can then be legalised at the Indian Embassy in Baghdad.
As the certificate is needed urgently, I shall
be extremely obliged if you will be kind enough to expedite its
preparation.
With my sincere compliments and cordial thanks
I remain, Dear Mr. President,
Very sincerely yours,

Calcutta - India
Dear Mr. President,
At the request of Mr. Daoud Shlomo - Baghdad - I hope to seek your
valuable assistance in providing me with an official certificate stating that his late brother Abdullah Shlomo Abdullah Shlomo (known as
Albert Solomon) of No. 4 Deckers Lane, Calcutta, had passed away in Calcutta on 12/11/1949.
It is also required that the certificate mentions the personal status (with reference to whether he left ⟦illegible⟧
children or other heirs in India) and the nationality he held at the time of death.
In case you need information about the deceased, I suggest contacting the family of the late
Sir David Ezra, of whom the deceased was an associate.
Since the requested certificate will be presented to the court in Baghdad for the purpose of obtaining
a succession decree, it will be necessary to have it legalized by the Iraqi Embassy in Bombay, or by the Indian Ministry of External Affairs
so that it can subsequently be legalized by the Indian Embassy in Baghdad.
As the certificate is required urgently, I would be very grateful if you would kindly expedite
its preparation.
With my sincerest wishes and heartfelt thanks, I remain, Mr. President,
Sincerely,
Rabbi Sassoon Khedouri

His Excellency the President of the Jewish Community in Baghdad, respected
After greetings and respect,
Since my brother Abdullah Shlomo Abdullah Shlomo (known by the name Albert Solomon)
had passed away in the city of Calcutta, India, on December 11, 1949, and to my knowledge he was divorced
and without offspring, for the purpose of organizing the inheritance distribution, I request your mediation with the Jewish community in the aforementioned city
to obtain a certificate confirming the date of death and the personal status he was in at the time of death (i.e., married
or divorced, etc.) and whether he had children to inherit from him, while indicating his nationality at the time of death. Provided that
the aforementioned certificate is certified by the Iraqi Embassy in India or by the Indian Ministry of Foreign Affairs
so that it can be certified by the Indian Embassy in Iraq for the purpose of presenting it to the competent authorities
when needed.

His Excellency the Honorable Minister of Justice
Greetings and respect,
Law No. 77 of 1931 and the two regulations issued thereunder in the years 1931 and 1932 possess sufficient flexibility to organize the Jewish community in its present state legally, and there is no necessity to leave its affairs to negligence or to treat them with illegal instructions. ⟦line⟧
The law, along with the two regulations, is based on the consideration of Iraqi Jewry as five groups. It is obvious that the current situation of the community justifies only one single group encompassing all of Iraq. A decision to that effect can be made by a regulation if it is considered a purely legal decision, or by a decision from the Council of Ministers if it is considered a political decision.
If it is decided that the Jewish community is one single group, it is naturally necessary, in order to facilitate the implementation of the text of the law, that the decision specifies the equivalence of this group with one of the groups designated in the law. There is no doubt that equivalence with the former Baghdad group is incorrect, but equivalence with the Basra group, in terms of the number of people and the importance of administration, represents a realistic equivalence. In any case, whether in terms of population or importance, the current Iraq group exceeds the Mosul group or the Diyala group.
The legal basis for this decision is analogy, which is the legitimate pillar upon which interpretation (ijtihad) can be based when a wide gap occurs between the text and the reality of the situation for which that text was established. The condition for the validity of analogy and interpretation is that they aim to safeguard the implementation of the law and do not serve as a pretext for neglecting it. The most likely of two interpretations is the one closer to the law and the one requiring the least alteration of it.
Accordingly, it appears that such a decision, once taken, is alone sufficient to restore the legal status to its proper course, whereby there would be an Acting President, a General Council, and a Lay Council. The election that recently took place can be considered as leading to the election of a Lay Council without the need for a new election, and all that remains to restore matters to their proper course is the election of a General Council and the restriction of the Ministry's relationship with the community to the existing legal and regulatory texts.

Greetings and respect,
Law No. 77 of 1931 and the two regulations issued under it in 1931 and 1932 have
sufficient flexibility to organize the Jewish Community in its present situation legally, and there is no necessity to leave its affairs
to neglect or to treat them with illegal instructions.
The law with its two regulations is based on the consideration of the Iraqi Jews as five groups. It is obvious that the
current situation of the community justifies only one group covering all of Iraq. The decision for that can be taken by regulation if it is considered
a purely legal decision, or by a decision from the Council of Ministers if it is considered a political decision.
If it is decided that the Jewish community is one group, it is naturally necessary, in order to facilitate the execution of the law verbatim, to specify in the
decision the equivalence of this group with one of the specific groups mentioned in the law. There is no doubt that equivalence with the previous Baghdad group
is incorrect, but equivalence with the Basra group in terms of the number of people and the importance of administration represents a realistic equivalence.
In any case, whether in terms of population or importance, the current Iraqi group exceeds the Mosul group or the Diyala group.
The legal basis for this decision is analogy, which is the legal pillar on which jurisprudence can be based
when a vast gap occurs between the text and the reality of the situation for which that text was placed. The condition for the validity of analogy and jurisprudence
is that they aim for and ensure the implementation of the law and do not serve as a pretext for neglecting it. The weightier of two interpretations is the one closest to the law
and requiring the least modification of it.
Therefore, it appears that such a decision, once taken, is alone capable of restoring the legal situation to its proper order, so there would be
an acting president, a general council, and a lay council. The election that took place recently can be considered leading to the election of a lay
council without the need for a new election, and all that remains to return matters to their proper order is the election of a general council

The law along with the two regulations is based on the consideration of Iraqi Mosaicists as five groups. It is self-evident that the current situation of the community justifies only one group encompassing all of Iraq. The decision for this can be taken by a regulation if it is considered a purely legal decision, or by a decision of the Council of Ministers if it is considered a political decision.
If it is decided that the Mosaic community is one group, it is naturally necessary, in order to facilitate the implementation of the law literally, to specify in the decision the equivalence of this group with one of the groups specified in the law. There is no doubt that equivalence with the previous Baghdad group is incorrect, but equivalence with the Basra group in terms of the number of souls and the importance of administration represents a realistic equivalence. In any case, whether in terms of population or importance, the current group of Iraq exceeds the Mosul group or the Diyala group.
The legal basis for this decision is analogy, i.e., the legitimate pillar upon which legal reasoning (Ijtihad) may be based when a wide gap occurs between the texts and the reality for which that text was established. The condition for the validity of analogy and reasoning is that it aims at and succeeds in implementing the law and does not become a pretext for neglecting it. The preferred choice between two reasonings is the one closest to the law and requiring the least modification of it.
Accordingly, it appears that once such a decision is taken, it alone is sufficient to restore the legal status to its proper course, whereby there would be an Acting President, a General Council, and a Lay Council. The law is among the laws that consider the Iraqi Mosaic community to be five groups. It is obvious that the
present situation of the community affects only one group that includes the whole of Iraq. A decision on this can be taken by regulation if it is considered
