As we have requested in numerous urgent reviews for the demolition of the old wing of the school building
belonging to the Jewish Community in Baghdad, and we explained that the condition of the old wing is dangerous and cannot under
any circumstances allow the use of the rooms in it as classrooms or otherwise, especially since
that danger was confirmed by the local administration engineer and the Jewish Community engineer themselves, and
any repair or restoration will have no benefit whatsoever unless the old wing is removed and a new wing is built in its place.
Furthermore, the local administration promised to expropriate the building from the Jewish Community for the public
interest during the meeting held by the local administration with school principals last summer.
We hope this will be achieved at the earliest opportunity, especially since the school year is around the corner.

Subject - "The New Cemetery in Waziriyah"
Based on your verbal order, we have inspected the aforementioned cemetery in order to determine the cost required to repair the fence and make it
suitable for burial.
Most of the fence is demolished or leaning towards collapse, and the fence actually consists of two parts:-
A - The lower part, which is built of cement, and has suffered only minor damage.
B - The upper part, with a height of 2.00 m (two meters), which is the damaged part that is demolished or leaning towards collapse and must be repaired.
The costs of the proposed repairs are as follows:-

As for the land, it does not need leveling as it is good <del>its construction</del> and despite the presence of a trace of a low stream in the middle
of the cemetery, it does not affect the cemetery at all at the present time.
As for the roads leading to the cemetery, there are three roads:-
A- From Sheikh Omar Street - to the dike then the capital road - then to the cemetery. This road is the shortest
and takes one-third of an hour (20 minutes) starting from Bab Al-Sharqi, and this road is well-trodden, i.e., there are those who go and come, and this is
an important point, but its only drawback is passing through the capital, and on its sides a group of huts where there are many children who might harass the car
during its passage, and the distance of this road is 5 minutes.
B - The new Al-Rayas road ( ) and this passes through the factories and is very difficult and takes from Bab Al-Sharqi about
45 minutes, and cars cannot cross it in winter.
C - Shammaiya road, which is a long road that takes 60 minutes starting from Bab Al-Sharqi (truck) and it is a
good road in terms of car traffic, but it is not well-trodden, and this is a dangerous matter; if something happens to the car, it is very difficult to contact anyone,
especially in winter days, at night, and at noon when the sun is very hot in summer, in addition to the long duration.
I believe that the first road is the most suitable road despite the presence of children due to its shortness, suitability for cars, and the presence of a police
station at its beginning.

Based on your verbal order, we inspected the mentioned cemetery in order to carry out the necessary inspection
to restore the fence and make it suitable for burial.
The condition of the fence is threatened or leaning towards collapse. The fence actually consists of two parts:
1- The lower part, which is built with cement, and this has only suffered minor damage.
2- The upper part, with a height of 2.00 m (two meters), which is the damaged part that is collapsed or leaning

from the Eastern Gate. This road is frequented, meaning people go and come, and this is an important point, but
its only drawback is its passage through the public area, and in it and on its sides are a group of huts containing
many children who may harass the car while it is moving. The ⟦duration⟧ of this road is 5 minutes.
2- The ⟦new⟧ Races road, and this passes through the factories and is very difficult
and takes about 45 minutes from the Eastern Gate, and cars are not able to

from the Eastern Gate (by a Tourne car). It is a good road in terms of car movement
but it is not frequented, and this is a dangerous matter; if something happened to the car, it would be

noon when the sun is very hot in summer, in addition to the length of the duration.
I believe that the first route is the most suitable of the routes, despite the presence of
children, because of its shortness and suitability for cars and the presence of a police post at its beginning.

Greetings and respect,
Law No. 77 of 1931 and the two regulations issued thereunder in the years 1931 and 1932 contain sufficient flexibility to organize the Mosaic community in its present state legally, and there is no necessity to leave its affairs to negligence or to address them with illegal instructions.
The law, along with the two regulations, is based on the consideration of the Iraqi Mosaic [community] as five groups. It is obvious that the current situation of the community justifies only one group covering the whole of Iraq. A decision to that effect can be taken by regulation if it is considered a purely legal decision, or by a decision of the Council of Ministers if it is considered a political decision.
If it is decided that the Mosaic community is one group, it is naturally necessary, in order to facilitate the implementation of the law's text, to specify in the decision the equivalence of this group with one of the groups specified in the law. No doubt that equivalence with the former Baghdad group is incorrect, but equivalence with the Basra group in terms of population size and the importance of administration represents a realistic equivalence. In any case, whether in terms of population or importance, the current Iraqi group exceeds the Mosul group or the Diyala group.
The legal basis for this decision is analogy, i.e., the legitimate pillar upon which jurisprudence may be based when a vast gap occurs between the text and the reality for which that text was set. The condition for the validity of analogy and jurisprudence is that they aim to safeguard the implementation of the law and not be an excuse for neglecting it. The more likely of two interpretations is the one closer to the law and more complete in seeking the truth.
Accordingly, it appears that such a decision, once taken, is alone capable of restoring the legal status to its proper course, whereby there would be an Acting President, a General Council, and a Lay Council. The election that took place recently can be considered as leading to the election of a Lay Council without the need for a new election, and all that remains to return matters to their proper state is to elect a General Council and limit the Ministry's relationship with the community to the existing legal and regulatory texts.

Greetings and respect.
The house numbered above is registered in the Baghdad Land Registry (Tapu) in the name of Mrs. Rachel Elisha Benjamin Sheikh Sassoon
as absolute ownership. The aforementioned owner, during her lifetime, endowed (waqf) the house in question for the benefit of the poor and sick of Meir Elias Hospital
and appointed the Head of the Israelite Community as the trustee (mutawalli) over the said endowment in accordance with the conditions stated in the endowment deed No. 91 / 1933
dated 12 / 7 / 1933 issued by the Personal Status Court in Baghdad.
Upon the issuance of the freezing laws, the Secretary General of Frozen Assets seized the house and utilized it on the basis that it is a
frozen house belonging to denaturalized persons. The Community sent a letter to the Secretary General on 30 / 1 / 1952, number 2298 / 52
requesting the lifting of the seizure of the house and its handover to them. Due to the non-registration of the endowment in the Land Registry, the General Secretariat ignored the request.
When the case was referred to me by your Excellency, I immediately proceeded to obtain certified copies of the endowment deed and attached one
to my letter sent to the Secretary General, registered with him under number 2941 dated 4 / 3 / 1956, requesting the lifting of the seizure of the house. When
no reply was received, I deemed it appropriate to send a reminder to the Secretary General by registered mail on 20 / 5 / 1956, repeating my previous request as
well as demanding the return of all property rental payments received by him.
Based on the request of the General Directorate of Income Tax to expropriate the entire house, the Baghdad Governorate at the time requested the Community
to send a representative to the preliminary estimation committee. Given that the Secretary General had previously seized the expropriated house, he considered
himself the legal representative of the party from whom the property was expropriated and proceeded with the expropriation procedures according to due process.
Accordingly, and in view of the above, I believe that the actions to be taken at the present time are -
1 - Registering the endowment in the Baghdad Land Registry and issuing a new title deed for the property after correcting its classification from absolute ownership to a charitable endowment under trusteeship

Issa Abu Tabra, which I have not received until now.
4 - More than a year ago, I completed the expropriation transaction for the house numbered 144 / 177, sequence 391, Souq al-Ghazl, after I had increased
the expropriation compensation to the point where the secretary of your esteemed community, as well as the property officer Mr. Isaac al-Kabir, thanked and congratulated me.
And your esteemed community has not received the expropriation compensation due to a dispute between you and the Mayoralty of the Capital regarding paving fees, which are not my specialty.
It appears from the above that I have completed my duties as a lawyer and that the case is merely a matter of accounting. Therefore, I request your kind decision on the appropriate fees
in this regard, according to what I achieved in increasing the expropriation compensation.
In conclusion, please accept my utmost respect.

belonging to your presidency located in the Bani Said neighborhood, we have been able to carry out the forced eviction with the assistance of a force of police members with the station officer
and the area assistant. The mentioned property contains fifty-five rooms, in each room of which there is a family. It required me to go out with
the above-mentioned body and the procedural enforcement body twice, in the last of which we threw the occupants' furniture onto the street in implementation of the legal decision which
I obtained from the Presidency of the Baghdad Regular Enforcement.
. The expenses that I paid for this during the two mentioned times are 3/200 Dinars for each time.
Total expenses 6/400 Dinars .
Since this matter, due to its executive importance, supports our position in our keenness for the interests and safety of the community's endowed funds in relation

Some individuals have encroached on the Mosaic Cemetery and began demolishing graves
and using their bricks to build houses for themselves. This act is considered a violation of the sanctity of the deceased, which
all religions have prohibited, in addition to what Sharia and civil laws have mandated regarding the duty of sanctity
and respect for the dead. This act is considered a breach of security and public morals, and an encroachment that cannot
be justified. We ask Your Excellency to order the prevention of this encroachment.
