Further to our telegram dated 5 / 6 / 58, we received today your letter No. 314 dated 27 / 5 / 58 and its copy regarding the expropriation by the Reconstruction Board of the cemetery endowed by the late Khadduri Al-Ani. Based on your request, we answer your questions: ⟦line⟧
1 - It is permissible to bury the five bodies mentioned in your letter in the community cemetery.
2 - Each one must be buried separately and of course the remains must be placed in a bag, preferably of linen.
3 - It is desirable to build a grave for each one.
4 - If none of their relatives attend, it is necessary when burying them that ten people are present, and one of them reads the Kaddish, followed by the reading of "Hashkaba" ( ⟦line⟧ ) for the soul of each one of them.
5 - There is no objection to escorting the bodies in a coffin.
Please specify the day and date of the burial to inform their relatives. ⟦line⟧

Summary of the conditions under which inland telegrams are accepted
1 - This telegram is sent in accordance with the inland telegraph regulations published in the Iraqi Post and Telegraph Guide.
2 - The Iraqi Post and Telegraph Administration shall not be responsible for paying any compensation for delay, damage, loss, or breakage that may occur to the telegram due to its non-transmission or non-delivery, during transmission or distribution.
3 - The sender of the telegram must record in the space provided on the left side of the address on the face of the form the signs under which they wish to send the telegram, such as (Urgent) or (Reply Paid). If the telegram is in the interest of the Iraqi Government, the word (Official) shall be recorded.
4 - The Iraqi Post and Telegraph Administration has the right to refuse to accept a telegram, and it also has the right not to send it even if it has been registered for transmission or distribution. In this case, the transmission fee is returned to the sender upon submitting a request for it.
5 - Applications related to the recovery of fees and all complaints of this kind are submitted to the General Directorate of Posts and Telegraphs in Baghdad.
6 - To prevent errors, this telegram shall be written in clear and legible handwriting.
CONDITIONS ON WHICH INLAND TELEGRAMS ARE ACCEPTED
1. This telegram shall be forwarded in accordance with the Inland Telegraph Rules published in the "Iraq Post and Telegraph Guide".
2. The Administration of Posts and Telegraphs, Iraq, shall not be liable to make compensation for any delay, error, loss, injury or damage arising from omission, non-transmission or non-delivery of the telegram.
3. The sender may write the instructions in the space provided at the left side of the address, on the face of this form, such as Urgent Reply Paid, or State of an Iraq Government Service.
4. The Administration of Posts and Telegraphs, Iraq, may decline to accept the telegram; it may also decline to forward it although it has been booked. In such case the amount paid for transmission shall be refunded to the sender on application.
5. Complaints and applications for refund should be addressed to the Directorate of Posts and Telegraphs, Baghdad.
6. To prevent mistakes this telegram must be legibly written.

Upon the request of Mr. David Solomon, Baghdad,
I would kindly solicit your valuable assistance in furnishing me
with an official certificate to the effect that his late brother
Abdullah Shlomo Abdullah Shlomo (alias ALBERT SOLOMON) of 4
Dacre's Lane, Calcutta, has died in Calcutta on 11/12/1949. The
certificate is further required to state the deceased's civil
status (indicating if he left any wife or children in India) and
nationality at the time of death.
In the event you would need some reference
regarding the deceased, I would suggest that you may solicit that
from the family of the late Sir David Ezra, to whom the deceased
was acquainted.
As the required certificate will have to be
presented to the Court in Baghdad, for obtaining a Probate Decree,
it will be however necessary to have it attested at the Iraqi
Embassy in Bombay; or at the Indian Foreign Ministry, in a way

Based on the request of Mr. Daoud Shlomo - Baghdad - I hope to seek your
valuable assistance in providing me with an official certificate stating that his late brother Abdullah Shlomo Abdullah Shlomo (known as
Albert Solomon) of No. 4 Deckers Lane, Calcutta, had died in Calcutta on 12/11/1949.
It is also required that the certificate mentions the personal status (with reference to whether he left a ⟦wife or⟧

and without offspring, for the purpose of organizing the inheritance distribution, I request your mediation with the Jewish community in the aforementioned city
to obtain a certificate confirming the date of death and the personal status he was in at the time of death (i.e., married
or divorced, etc.) and whether he had children to inherit from him, while indicating his nationality at the time of death. Provided that

Greetings and respect,
Law No. 77 of 1931 and the two regulations issued thereunder in the years 1931 and 1932 possess sufficient flexibility to organize the Jewish community in its present state legally, and there is no necessity to leave its affairs to negligence or to treat them with illegal instructions. ⟦line⟧
The law, along with the two regulations, is based on the consideration of Iraqi Jewry as five groups. It is obvious that the current situation of the community justifies only one single group encompassing all of Iraq. A decision to that effect can be made by a regulation if it is considered a purely legal decision, or by a decision from the Council of Ministers if it is considered a political decision.
If it is decided that the Jewish community is one single group, it is naturally necessary, in order to facilitate the implementation of the text of the law, that the decision specifies the equivalence of this group with one of the groups designated in the law. There is no doubt that equivalence with the former Baghdad group is incorrect, but equivalence with the Basra group, in terms of the number of people and the importance of administration, represents a realistic equivalence. In any case, whether in terms of population or importance, the current Iraq group exceeds the Mosul group or the Diyala group.
The legal basis for this decision is analogy, which is the legitimate pillar upon which interpretation (ijtihad) can be based when a wide gap occurs between the text and the reality of the situation for which that text was established. The condition for the validity of analogy and interpretation is that they aim to safeguard the implementation of the law and do not serve as a pretext for neglecting it. The most likely of two interpretations is the one closer to the law and the one requiring the least alteration of it.
Accordingly, it appears that such a decision, once taken, is alone sufficient to restore the legal status to its proper course, whereby there would be an Acting President, a General Council, and a Lay Council. The election that recently took place can be considered as leading to the election of a Lay Council without the need for a new election, and all that remains to restore matters to their proper course is the election of a General Council and the restriction of the Ministry's relationship with the community to the existing legal and regulatory texts.
